Ifyouexperience anyofthese forms ofmisconduct,youare stronglyencouraged to utilizethe various on andoff campusresourcesdescribed below. Your safetyandwell-beingis the University’spriority. Thispublication is intended to helpyouunderstandyour rights and options, as well asprovideyouwithinformationregardingsupportandassistance.2
WHATSHOULD I DO?
Call 9-1-1 if you arein the midst ofanykind of emergency,immediate harmorthreat of harm.
Ifyouhaveexperiencedsexual misconduct(e.g.,rape,acquaintance rape,orsexual battery),datingor domestic violence, or stalking,you are encouraged to seek immediate assistance frompolice and healthcare providersforyour physicalsafety,emotional support andmedicalcare.
Universitypolice canescortyou to asafeplaceand transportyou to a hospital orasexual assaultresponse center fora medicalexamination, if needed. Universitypolice can alsoprovide accessto a confidential Sexual AssaultVictim’sAdvocate. Ifyouwould prefernot to notifythe police,you arestronglyencouraged to seek assistance from the campusTitleIXCoordinator who canprovideyouwithinformation onyouroptions, rights andremedies, and/orthe CampusSexualAssaultVictim’sAdvocate. The campusTitleIXCoordinator is available toassistyou innotifyingthe police, ifyouwish. The Sexual AssaultVictim’sAdvocate listedbelow canalsoassistyou in notifyingthe police and/or thecampus TitleIX Coordinator.
Youhave theright to decide whomandwhen to tell aboutwhathappened. However, it is veryimportantthatyougetconfidentialmedical attention after being assaulted. Followingtheincident,youmaybephysicallyinjured, theremaybea chanceyoucontracted asexuallytransmitteddisease orthatyoumaybecomepregnant.

THE IMPORTANCEOF PRESERVINGEVIDENCE
It is importantthatyou take steps to preserve andcollectevidence; doingsopreserves the fullrange ofoptions available toyou,beit through the University’sadministrative complaintprocedures or criminalprosecution. Topreserve evidence:(1) do not washyourface or hands;
(2)do not shower orbathe; (3) do not brushyourteeth; (4) do not change clothes or straighten upthe area where theassault took place;(5) do not disposeof clothes orotheritemsthatwerepresent duringtheassault, orusethe restroom;and,(6) seeka medicalexam immediately. Ifyoualreadycleaned up from the assault,youcan still report the crime,aswell as seekmedical orcounselingtreatment. You mayconsultwith the CampusTitleIXCoordinatororSexual AssaultVictim’sAdvocate (seecontactinformation above) for assistance as well.
WHATREPORTINGOPTIONSDO I HAVE?
The University’sprimary concern is yoursafetyand the safety ofthe Campuscommunity.Theuseof alcohol ordrugs nevermakes the victimatfaultfor sexual misconduct.Ifyou haveexperienced sexual misconduct,datingordomestic violence, orstalkingyou should not bedeterredfrom reportingthe incident out ofaconcern thatyoumight bedisciplined for relatedviolations of drug, alcohol or other Universitypolicies. Except in egregiouscircumstances,Universitystudents oremployeeswho are victims ofsexual misconductwill not be subject todiscipline.
Youhave severalreportingoptions, andyoumaypursue oneormoreoftheseoptions atanytime.It isyour right to havea friend, familymember, Sexual AssaultVictim’sAdvocate,orother representative present withyouwhile reportingthe incident.Youalsohave the right to
have asexual assaultcounselor, Sexual AssaultVictim’sAdvocateand/or support person ofyourchoice presentwithyouduringarape examination.
The CampusTitleIX Coordinator orSexual Assault Victim’sAdvocate can assistyou innotifyingthe police ifyouchoose.
Criminal:Reportingto UniversityPoliceand/orlocalpolice is an option atanytime. Ifyouchoose not to report to the police immediatelyfollowingan incident,you can still make thereportat alater time. However,with the passageof time, theabilitytogather evidence to assistwithcriminalprosecution maybe limited.Dependingon thecircumstances, the police maybeable to obtain a criminalrestrainingorderonyourbehalf.
Administrative: Youmayreport to the CampusTitleIX Coordinator, who willprovideyouwithwrittenandverbalinformationregardingapplicable Universitycomplaint proceduresforinvestigatingand addressingthe incident.The TitleIX Coordinator will also provideyouwithinformationregardingresourcesavailable toyou, as wellasinformationregardingyour rightsand options. Contactinformationfor the TitleIXCoordinator is listedabove.
The CampusTitleIX Coordinator willalsodiscusswithyouanyreasonable interimremedies theUniversitymayofferpriorto conclusion of aninvestigation or potential disciplinaryaction toreduce or eliminate negative impact onyouand provideyouwithavailableassistance. Examplesinclude:adjustment to workassignments,course schedules orsupervisoryreportingrelationship;requiringthe Respondentto move fromUniversity-owned oraffiliatedhousing;immediatelyprohibitingtheRespondent fromcomingto the University; orprohibitingthe Respondentfromcontactingthe parties involved in the reported incident.These options maybe available toyouwhether ornotyouchooseto report theincident to Campuspolice or law enforcement.The TitleIXCoordinator remainsavailable to assistyouand provideyouwithreasonable remediesrequestedbyyou throughout the reporting,investigative,and disciplinaryprocesses,andthereafter.
Ifit is determinedthat Universitypolicy3wasviolated, the Respondentwillbe subject todiscipline, up to andincludingdismissalfrom Universityemployment orexpulsion from theUniversity. Youare entitled to be accompanied toanyrelated meetingorproceedingbyanadvisor ofyour choice, includingaSexual Assault Victim’sAdvocate ordomestic violence counselor. However, ifyou do not wish to participate in aninvestigation or hearingprocess,youhave the right to decline to do so.
Health/Counseling/Clergy: Youmaychoose toseek advice and assistance fromphysicians,psychotherapists,professionalcounselors,clergy,sexual assaultanddomestic violencecounselorsandadvocates,includingindividualswhowork orvolunteer forthem.
CivilLawsuit: You maychoose to file acivillawsuitagainst theRespondent, whether ornotcriminalchargeshave been filed. A civillawsuit providesyou theopportunityto recoveractualdamages,whichmayinclude compensationfor medical expenses, lost wages,pain,suffering,andemotionaldistress.
You mayalsochoose toobtain a protective or restrainingorder(suchasadomestic violencerestrainingorderoracivilharassmentrestrainingorder). Restrainingorders must be obtainedfrom a court in thejurisdiction where theincident occurred.Restrainingorderscanprotectvictimswhohave experienced orarereasonablyinfear of physicalviolence, sexual misconduct,datingor domestic violence, or stalking.UniversityPolice andyour Campus TitleIXCoordinator canofferassistance withobtaining aprotective orrestraining order.
Non-reporting:You arestronglyencouraged to reportanyincidents to thepolice and/orCampusTitleIXCoordinatorso thatstepsmaybe taken to protectyouand the rest ofthecampuscommunity. However, non-reportingis also an option.

CONFIDENTIALITY– KNOWYOUROPTIONS
We encourage victims ofsexual misconduct,datingordomestic violence,or stalkingto talk tosomeone aboutwhathappened – soyou canget the supportyou need,andso the Universitycanrespondappropriately. Whether – and theextent to which – aUniversityemployee mayagree tomaintainconfidentiality(and not disclose information to the TitleIX Coordinator) depends onthe Employee’s position andresponsibilitiesat the University.Thisinformation is intended tomakeyouaware ofthevarious reportingandconfidentialdisclosure options available toyou – soyou can make informedchoicesaboutwhere to turn for help.TheUniversityencouragesvictimsto talk to someone identified in oneor more ofthese groups.
Asexplainedbelow, some employees are requiredbylaw to maintain nearcompleteconfidentiality; talkingtothem is sometimescalled a “privilegedcommunication.”OtherEmployeesmaytalk to avictim in confidence,andgenerallyonlyreport to theUniversitythatanincidentoccurred without revealinganypersonallyidentifyinginformation. Some employees arerequired to reportall details of anincident(includingthe identities ofboth the victimandallegedperpetrator) to the TitleIX Coordinator. A reportto these employees constitutes a report to theUniversity,andgenerallycreates alegal obligationfor theUniversityto investigate the incidentandtake appropriate steps to address the situation.
Privileged and ConfidentialCommunications
Physicians,Psychotherapists,ProfessionalCounselors and Clergy4– Physicians,psychotherapists,professional,licensedcounselors,and clergywhoworkor volunteer on oroffcampus actingsolelyin those roles or capacity, inthe provision of medicalor mentalhealthtreatment orcounseling (including thosewho work or volunteer in thoseoffices)maynotreport any informationaboutanincident ofsexual misconduct to anyone elseat the University,includingthe TitleIX Coordinator,withoutyourconsent. Youcan seek assistance andsupportfromphysicians;psychotherapists,professional,licensedcounselors,andclergywithouttriggering aUniversityinvestigationthatcould revealyouridentityorthefact ofyour disclosure.However, see limited exceptions belowregardingwhenhealthcare practitionersmustreport tolocal law enforcementagencies. Ifyouspeakonlyto a physician,professionalcounselor, clergymember, sexual assaultcounselor,domestic violencecounselor oradvocate,you must understand that theUniversitywillbe unable to conduct aninvestigation into the particular incident orpursuedisciplinaryactionagainst the perpetrator, ifyou chooseto maintainconfidentiality.
Even so, these individualswill still assistyou in receivingothernecessaryprotectionandsupport,suchasvictimadvocacy,disability,medical/health or mental health services, or legalservices. Theymaynot,however,be able to assistyouwith Universityacademic support oraccommodations, or changes to University-basedlivingorworkingschedules, or assistwithadjustments to course schedules. OnlytheUniversityand the TitleIX Coordinator canassistwith those matters(see below). A victimwhoat first requests confidentialitymaylaterdecidetofile a complaintwith theUniversityor report the incident to the police,andthus have theincident fullyinvestigated.These counselorsandadvocatescan provideyouwiththatassistanceifyouwish.These counselorsandadvocateswillalso explain thatTitleIXincludesprotectionsagainstretaliation,and that theUniversitywill not onlytake steps to prevent retaliationwhen itknows orreasonablyshould knowofpossible retaliation, but willalsotake strongresponsiveaction ifit occurs.
EXCEPTIONS: UnderCalifornia law,anyhealth practitioner employedin a healthfacility,clinic,physician’soffice,or local or state publichealth departmentor clinic is required to makeareport to locallawenforcement ifheorsheprovides medicalservices foraphysicalconditiontoa patient/victimwho heorshe knows orreasonablysuspects is sufferingfrom: (1) a wound orphysical injuryinflictedbyafirearm; or (2) anywound or other physical injuryinflicted upona
victimwhere theinjuryis the result of assaultiveor abusive conduct (includingsexualmisconductanddating and domestic violence).6 Thisexceptiondoesnot applyto sexual assaultanddomestic violencecounselorsandadvocates. Healthcare practitionerswill explain thislimitedexception toyou,if applicable.
Additionally,under California law,all professionalsdescribed above (physicians,psychotherapists,professionalcounselors,clergy,and sexual assaultanddomestic violencecounselorsandadvocates) are mandatorychild abuse andneglectreporters,andarerequired toreportincidents involvingvictimsunder 18yearsof age to local lawenforcement.7 Theseprofessionalswill explain this limitedexceptiontoyou, ifapplicable.

Finally, someor all ofthese professionalsmayalso have reportingobligations under Californialaw to: (1) locallawenforcement in cases involvingthreats of immediate orimminentharm toself or otherswhere disclosureofthe information is necessaryto prevent the threateneddanger;8or (2) to thecourt if compelledbycourt orderorsubpoenain a criminal proceedingrelated to theincident.9 If applicable, these professionalswill explain thislimitedexception toyou.
ReportingtoUniversityor LocalPolice
Ifyoureportcertainsexoffenses to local orUniversityPolice, thepoliceare required to notifyyouthatyourname willbecome amatterofpublic recordunlessconfidentiality is requested.10Ifyourequestthatyour identitybekept confidential,yourname will not become amatterofpublic recordand thepolice will not reportyouridentityto anyoneelse atthe University,includingthe TitleIX Coordinator. UniversityPolice will,however,reportthe facts ofthe
incidentitself to the TitleIX Coordinator beingsurenot to reveal to the TitleIX Coordinatoryour name/identity,orcompromise their owncriminalinvestigation.
The Universityis required bythe federal CleryAct to reportcertaintypesof crimes (includingcertainsexoffenses) in statisticalreports. However,while theUniversitywill report thetype ofincident in the annual crime statisticsreport known as the Annual SecurityReport,yourname/identitywill not berevealed.
Reportingtothe Title IX Coordinator and Other UniversityEmployees
Most Universityemployeeshave adutyto report incidents ofsexual misconduct,datinganddomestic violence,and stalkingwhen theyareonnotice ofit.Whenyou tell the TitleIXCoordinator or anotherUniversityemployee aboutanincident,youhave the right to expect theUniversityto take immediate andappropriate stepsto investigate what happenedand to resolvethe matter promptlyandequitably.In all cases,westrongly encourage victims to reportsexualmisconduct, dating anddomestic violence, and stalkingdirectly to the Title IX Coordinator.
Asdetailedabove,all Universityemployeesexcept physicians,licensedcounselors, sexualassaultvictim’sadvocates must report to the Title IXCoordinator all relevant detailsaboutincidents of which theybecome aware.The Universitywill need to determine whathappened –andwillneed to knowthe names ofthevictim(s) and the perpetrator(s), anywitnesses,andanyother relevantfacts,includingthedate, time andspecific location oftheincident.
To theextent possible,informationreported to theTitleIXCoordinatororother Universityemployee will be sharedonlywithindividuals responsible for handlingtheUniversity’sresponse

to the incident. The Universitywillprotect theprivacyof individualsinvolvedexceptasotherwise requiredbylaworUniversitypolicy. A reportmayresult in the gatheringofextremelysensitive informationaboutyouand other individuals in the Campuscommunity.While suchinformation is considered confidential, Universitypolicyregardingaccess to publicrecordsanddisclosure of personalinformation mayrequire disclosureofcertain informationconcerning a reported incident.In such cases, efforts will be made to redact the records,asappropriate, in orderto protectyouridentityand privacyand theprivacyof other involvedindividuals.

Ifyourequest ofthe TitleIX Coordinator oranotherUniversityemployeethatyouridentityremain completelyconfidential, the TitleIXCoordinator will explain thatthe Universitycannotalways honor that request andcannotguaranteecomplete confidentiality. Ifyouwish tomaintainconfidentialityor requestthat no investigation beconductedor disciplinaryactiontaken, theUniversitymust weighthatrequest against the University’s obligation to provide asafe, non-discriminatoryenvironmentfor all students, employeesandthirdparties,includingyou.Underthose circumstances, the TitleIXCoordinator willdetermine whetheryour requestfor completeconfidentialityand/or no investigationcan behonored underthe factsandcircumstances ofthe particular case, includingwhether theUniversityhas alegalobligation toreport the incident,conduct aninvestigation ortake other appropriate steps.Withoutinformationaboutyour identity, theUniversity’sabilityto meaningfullyinvestigatethe incidentand pursuedisciplinaryactionagainst the perpetrator maybeseverelylimited.
The TitleIX Coordinatorwillinformyouprior tostartinganinvestigationandwill, to theextentpossible, onlyshare informationwithpeople responsible for handlingthe University’sresponse.The TitleIX Coordinatorwillremainmindful ofyour well-being,andwilltake ongoingsteps toprotectyoufromretaliation or harm,and work withyou to createasafetyplan.Retaliationagainstyou,whether bystudents or employees, will not be tolerated.TheUniversityandTitleIXCoordinator willalso:
- Provide interimremediesrequestedbyyou, iftheyare reasonablyavailable,regardlessof whetheryouchoose toreport sexual misconduct, datingor domestic violence, orstalkingto Campus or localpolice;
- Assistyou in accessingother available victim advocacy,academic support,counseling,disability,medical/healthor mentalhealth services, andlegalassistance both on andoffcampus;
- Provide other securityand support,whichcouldinclude issuingano-contact order,helpingarrangeachangeof Campus-based living orworkingarrangements or courseschedules (includingfor the Respondent pendingthe outcome ofthe investigation) oradjustmentsfor assignments,tests, or workduties;and
- Informyou ofyourrightto report acrimeto Universityorlocal police –and provideyouwithassistance ifyouwish to do so.
The Universitywill not requireyou to participatein anyinvestigation ordisciplinaryproceedingifyou do not wish to participate.
The Universitywill not generallynotifyparents orlegalguardians ofyour reportunlessyou areunder theageof18 oryouprovide theUniversitywithwrittenpermission to do so.11
Under California law, and pursuant to Universitypolicy,certain Universityemployees,includingthe TitleIX Coordinator,are mandatorychild abuse andneglectreporters and should explain tovictimsunder 18years ofage that theyarerequired to report the incident tothepolice.12However, theidentityof the personwhoreports and the reportitself are confidentialanddisclosed onlyamong appropriate agencies.13
Because theUniversityis under acontinuinglegalobligation to address theissueofsexualmisconduct,datingand domestic violence,and stalkingcampus-wide,anysuch reports(includingnon-identifyingreports) mayalsoprompt the Universityto consider broader remedialaction – suchas increased monitoring, supervision orsecurityat locations where thereportedincidentoccurred;increasededucation, training and preventionefforts, includingto targetedpopulationgroups; conductingclimateassessments/victimizationsurveys; and/or revisingitspoliciesandpractices.

Firstand foremost, the medical examyoureceive from a hospitalorsexual assaultresponse center treats anyphysical injuryoreffect. The exam mayincludea vaginaland/oranalexamination,testing,andprophylactic treatment forsexuallytransmittedinfectionsand possiblepregnancy.
