RESOLUTION OF THE BOARD OF SUPERVISORS OF

COUNTY OF ORANGE

April 11, 2017

WHEREAS, the U.S. Department of Transportation (U.S. DOT) is soliciting Project Applications for California Federal Lands Access Program (FLAP) funds and anticipates programming between $60 -70 million from 2021-2022; and,

WHEREAS, the California Federal Lands Access Program requires a minimum non-Federal Aid Highway (Title 23) match of 11.47%, a certification of maintenance on the project facility for the life of the facility; and a commitment letter from the governing body to provide all required matching funds; and

WHEREAS, projects selected for inclusion on the list of projects for funding consideration must enter into a Reimbursable Agreement (RA) in the amount of $10,000 within 45 days of the notification of selection:

NOW, THEREFORE, BE IT RESOLVED that this Board acting on behalf of the County of Orange does hereby:

1.  Request the U.S. DOT to allocate FLAP funds to the County of Orange in the amount specified in the Modjeska Grade Road Improvement Project application;

2.  Authorize the Director of OC Public Works, or designee, to apply for and submit the Modjeska Grade Road Improvement Project application to the U.S. DOT FLAP for monies to be used on the Modjeska Grade Road Improvement Project;

3.  Authorize the Director of OC Public Works, or designee, to sign a commitment letter to provide all required matching funds for the Modjeska Grade Road Improvement Project;

4.  Authorize the Director of OC Public Works, or designee, to enter into a Reimbursable Agreement (RA) in the amount of $10,000, within 45 days of notification of selection, for the Central Federal Lands Highway Division (CFLHD) to complete project scoping efforts and develop an accurate scope, schedule, and budget;

5.  Authorize the Director of OC Public Works, or designee, upon notification of funding award, to accept funding monies;

6.  Authorize the Director of OC Public Works, or designee, upon notification of funding award, to execute cooperative/funding/program-supplement agreements with the U.S. DOT and to invoice and submit required reports to the U.S. DOT for payment of allocated funds as appropriate;

7.  Authorize the Director of OC Public Works, or designee, to provide certification that sufficient maintenance will be provided on the project facility for the life of the facility.
