Reservation and Usage Agreement

(Homeowners Agreement)

I understand and agree to all the following conditions in reserving and using the [ASSOCIATION]

Clubhouse:

on ______(date), from ______(a.m./p.m.) to ______(a.m./p.m.),

(Function) with approximately______people attending.

NOTE: By order of the Fire Marshall, a maximum of (63) persons may be allowed in the clubhouse.

Please initial each blank after reading each section below:

______1. I am a homeowner in good standing with [ASSOCIATION]. (All Assessments are current and

there are no outstanding liens or covenant violations.)

______2. I agree to pay according to the following deposit and cleaning fee schedule:

(All rental fees are given to the HOA Treasurer)

ALL CHECKS SHOULD BE MADE OUT TO: HUNT CLUB HOA

______3) The name and signature on the check should match the name of the member of the

[ASSOCIATION] renting the clubhouse. No Commercial or Third Party checks accepted.

______4) I agree to remove all trash and place in trash containers outside of the clubhouse, remove all

items from the refrigerator and wipe up any spills from the floors or furniture prior to vacating

the premises. I agree to return the premises to the pre-usage condition including putting the

furniture back to its original location.

______5) I understand that Commercial use of the clubhouse is not allowed.

______6) Smoking, animals and wet bathing suit in the are strictly prohibited in the clubhouse.

______7) All furniture must be returned to original place or deposit will be lost.

______8) Clubhouse doors must be securely closed and locked and lights and fans are to be turned

off prior to vacating the premises.

______9) Animals are prohibited at all times in the Clubhouse and/or pool area.

______10) If the fireplace is used, flues must be opened before lighting

______11) Usage of the Clubhouse does not include pool.

_____ 12) I am a member of the Association, at least twenty-one (21) years of age, have no unpaid fees due to the Association, and will be in attendance at the Function at all times during the Function. I hereby agree and represent that the clubhouse will be used for lawful purposes only and that if any conduct at the Function I am sponsoring violates federal, state or local laws or ordinances, my rights to use the clubhouse under this Agreement shall terminate and the Association shall have the right to take possession of the clubhouse and instruct my guests to leave the property.

______13)I assume all responsibility, risks, liabilities, and hazards incidental to the activities applied for including, but not limited to the serving of alcoholic beverages), and hereby release and forever discharge the Association, its officers, directors, employees, agents, and members, present, past, and future, from any and all claims, costs, causes of action, and liability for personal injury or death and damage to or destruction of property arising from my use of the clubhouse and its appurtenances. I hereby agree that, if alcoholic beverages are served at the Function, then alcoholic beverages shall: (1) not be served or allowed to be provided to minors at the Function, and (2) shall only be provided to or served to adults in a responsible manner.

______14) I assume all responsibility for the actions and behavior of all persons present at, attending, or in any other way related to the Function and agree to be personally responsible for causing all such persons to comply with the Association's Declaration, By-Laws, and Rules and Regulations. I acknowledge that violation of any provision of the Association's Rules and Regulations, Declaration or Bylaws by any person present at, attending, or in any other way related to the Function, may, in the sole discretion of the Association's Board of Directors, result in forfeiture of my deposit.

______15) I further agree that the Cleaning Deposit and Security Deposit will be used to pay for cleaning costs and any and all damages resulting to the Clubhouse, its contents, or any other portion of the Association property from my actions or any actions of persons present at, attending, or in any other way related to the Function. Specifically, I agree to accept any and all responsibility for any costs to correct and/or repair any damage done to the furnishings or property on the clubhouse premises in relation to the usage of the clubhouse. This includes, but is not limited to, prohibiting use of thumbtacks, nails, staples, glue, etc. to attach anything to the walls, doors, furniture, trim, etc. No decorations which require permanent altering of clubhouse will be allowed. Furnishings are not to be taken outside.

______16) An authorized Association representative shall inspect the premises within forty-eight (48) hours after the keys are returned to him or her. I understand that any charges made against my deposit will be explained. If costs of repairs exceed the amount of my deposit, I agree to pay the Association the full cost of all repairs with a written explanation of the damages and a bill from the Association for such repairs. I agree that all deposits, fees, cleaning and repair charges and any and all other expenses incurred by the Association as a result of the use of the clubhouse under this Agreement shall be considered an assessment and constitute a lien against my property and shall be fully collectible as provided for in the Association's Declaration and By-Laws.

______17) I agree to return the clubhouse keys to _Kathy Frost- 4021 Southbrook Ct (MAILBOX) on or before thenext business day after the Function.

______18) In the event of cancellation of my reservation, the deposit and the rental fee will be refunded in full.

______19) I agree to indemnify and hold harmless the Association, its officers, directors, employees, agents, and members, present, past, and future, from any and all charges, claims, costs, causes of action, damages and liabilities (including but not limited to attorneys fees) for any and all injuries, to either person or property, suffered by me, my family members, employees, agents, servants, guests, invitees, any member of the Association or any other person which arise from or are in any way related to the above function, activity, rental, or use of the clubhouse.

______20) I understand that the Association reserves the right to enter the Clubhouse and terminate my use thereof should I violate any term hereof or should the conduct of any person using the facility endanger the health, safety or well-being of any person or constitute a threat to any property.

______21) I understand and agree to all of the above conditions in reserving and using the [ASSOCIATION]Clubhouse.

NOTE: Many of the above rules are based on insurance coverage requirements. Exceptions to any of these rules must be approved by the Clubhouse Committee.

CLEANING CHECK LIST

Kitchen

  1. Mop kitchen floor
  2. Clean oven and stove it=f used
  3. Wipe down counter tops
  4. Wipe down cabinet doors
  5. Clean out refrigerator
  6. Clean microwave if used
  7. Clean sink
  8. Empty trash, must take to curbside trashcan
  9. Replace hand soap
  10. Refill paper towels
  11. Place new trash bag

Bathroom

  1. Mop bathroom floor
  2. Clean mirror
  3. Clean toilet
  4. Clean sink
  5. Wipe down countertop and cabinets
  6. Empty trashcan
  7. Shake out mats
  8. Refill toilet paper and paper towels
  9. Replace hand soap

Main Room

  1. Decorations removed
  2. Clean French door windowpanes
  3. Clean our fireplace, remove un-used logs and ashes, close flue
  4. Wipe down all table tops
  5. Clean out all cushions
  6. Unplug tree lights
  7. Place furniture in proper areas
  8. Replace any card tables or chairs in office
  9. Vacuum all areas
