AN Ordinance amending chapter v of the municipal revenue code of 2001 of the Municipality of Magsaysay, Province of Davao del sur.
BE IT ORDAINED by the Sangguniang Bayan of Magsaysay, Davao del Sur, that:
SECTION 1. Section 5A.03, Article A, Chapter V of the Municipal Revenue Code of 2001 of the Municipality of Magsaysay, Davao del Sur is hereby amended to read as follows:
Section 5A.03. Imposition of Fees. There shall be collected the following market fees:
A. Monthly rentals on market stall/booths, tiendas: FROM TO
1. Fish section, per stall P75.00 P150.00
2. Meat Section, per stall P75.00 P150.00
3. Dry Goods section, per sq. m. P20.00 P35.00
4. Grocery & sari sari store section, per sq. m. P20.00 P35.00
5. Vegetables and fruit section, per sq. m. P20.00 P35.00
6. Carenderia, eateries & cooked food section, per sq. m. P20.00 P35.00
7. Poultry products, per sq. m. or fraction P20.00 P35.00
8. Others not enumerated P 3.00 P30.00
B. On the basis of space occupied:
1. Market premises in the public market
compound and its surroundings
2. Market premises along the highway, municipal
streets, roads, public plazas and open grounds.
3. For fiesta season (Parochial Fiesta, Town
Anniversary, Kialegnon Festival)
4. The shelter shall be provided by the RENTEE.
SECTION 2. Section 5B.01, Article V, Chapter 5 of the Municipal Revenue Code of 2001 of the Municipality of Magsaysay, Davao del Sur is hereby amended to read as follows:
Section 5B.01. Imposition of Fees.
a. Permit Fee to Slaughter – Before any animal is slaughtered for public consumption, a permit therefore shall be secured from the Office of the Municipal Mayor or his duly authorized representative upon the recommending approval of the Municipal Meat Inspector who will determine whether the animal or fowl is fit for human consumption, thru the Municipal Treasurer upon payment of the corresponding fee, as follows:

SECTION 3. Section 5C.01, Article C, Chapter 5 of the Municipal Revenue Code of 2001 of the Municipality of Magsaysay, Davao del Sur is hereby amended to read as follows:
Section 5C.01. Imposition of Fees. There shall be collected the following rental fees for a lease of five years:

SECTION 4. Section 5D.02, Article D, Chapter 5 of the Municipal Revenue Code of 2001 of the Municipality of Magsaysay, Davao del Sur is hereby amended to read as follows:
Section 5D.02. Imposition of Fees. The following rental fees are hereby imposed for the use of the Municipal Gymnasium, to wit:
1. During daytime - P500.00/day
2. During night time
For civic/religious organizations
where the proceeds of the benefit are - P300.00/day/night
intended for community projects
3. For private persons/organizations, where said
persons or persons or organization shall - P1,000.00/day/night
gain profit for himself out of the activity
SECTION 5. Section 5E.01, Article E, Chapter 5 of the Municipal Revenue Code of 2001 of the Municipality of Magsaysay, Davao del Sur is hereby amended to read as follows:
Section 5E.01. Imposition of Fees. There shall be collected as rental fee for use of or services rendered by the heavy (road building) equipment of the municipality of Magsaysay, Davao del Sur, to wit:
5.1 For use by Local Government Units and other government agencies and government-owned corporation and cooperatives:

2. Grader P3,632/8 hours P8,000/8 hours
3. Backhoe P8,000/8 hours

5.2 For use by private individuals, organizations and contractors:
1. Dump Truck P4,000/8 hours P7,200/8 hours
2. Grader P4,632/8 hours P9,200/8 hours
3. Backhoe P9,200/8 hours
4. Loader P4,632/8 hours P9,200/8 hours
5. Compactor P7,200/8 hours
5.3 The above prescribed rates are exclusive of the cost of fuel, which shall be the responsibility of the RENTEE.
SECTION 6. There shall be collected the following fees for the delivery of the following materials to private individuals within the territorial jurisdiction of Magsaysay, Davao del Sur, amending provisions of the Municipal Revenue Code of 2001, to wit:

SECTION 7. There shall be collected the following fees for services by the tractor owned by the municipal government, to wit:
Disc Plow P4,500/hectare
Arastillo P3,000/hectare
Tudling P3,000/hectare
7.1 There shall be P1,500.00 to be deducted from the Disc Plow payment for fuel while P880.00 from Arastillo and Tudling payment. The tractor driver shall get 13 percent share while the helper shall get 8 percent share.
SECTION 8. There shall be collected the following fees for payment of the concrete products from the municipal government of Magsaysay, to wit:
8.1 Concrete Hollow Blocks
§ P8.5/piece within Poblacion area
§ P9.00/piece outside Poblacion area
The material shall be delivered free of charge.
8.2 Culvert
§ #18 P1,800.00
§ #24 P2,000.00
§ #36 P3,000.00
§ The materials shall be delivered free of charge but the fuel shall be shouldered by the buyer.
SECTION 9. There shall be collected a .01% Educational Support Program Fund (ESPF) Fee and .01% Drainage Maintenance Fee (DMF) and .01% Sanitary Maintenance Fee (SMF) from the total amount of any transaction with the local government unit of Magsaysay, Davao del Sur.
SECTION 10. Repealing Clause - All ordinances, or part thereof, in conflict or inconsistent with any provision of this Ordinance are hereby repealed, amended or modified accordingly.
Section 11. Effectivity – This Ordinance shall take effect fifteen (15) days after its approval.
