ON STREET TRADING IN THE HIGH STREET

1.Matter for Consideration

To allow street trading in the High Street.

2.Recommendations

It is recommended that the High Street (Falkland Square to Old Orchard) be re-designated as a consent street under the Local Government (Miscellaneous Provisions) Act 1982 in order to permit trading in this area.

3.Background

3.1A report was presented to 16 October TAG considering a request from the Town Centre Manager to allow street trading in the High Street.

3.2The primary purpose of this is to allow a weekly general market in the pedestrianised section of the High Street between North Street/Lagland Street and Old Orchard/New Orchard. However, other forms of trading may be permitted, with requests being considered by the Town Centre Manager against a predefined criteria to ensure suitability in terms of quality of presentation and goods/services being offered.

3.3A notice of this proposal (Appendix A) has been erected on site for 28 days and advertised in the Echo on 3 November 2003. No objections or representations have been made in respect of this notice.

3.4If the re-designation of this street is approved by the Transportation Portfolio Holder, notices of intent will be advertised on 5 and 12 January 2004 and the Order will come into operation on 2 February 2004.

STREET TRADING – PROPOSED VARIATION OF DESIGNATION OF HIGH STREET FROM PROHIBITED TO CONSENT STREET

IN ACCORDANCE WITH PARAGRAPH 2 OF SCHEDULE 4 OF THE LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1982

  1. On 17 October 1991 the High Street was designated as a prohibited street (i.e. where trading is not allowed) under the Local Government (Miscellaneous Provisions) Act 1982. It is now proposed that the length from Falkland Square to Old Orchard be re-designated as a consent street (i.e. where trading is prohibited without the consent of the Council). A plan showing this area is available for inspection at the locations shown below.
  1. In order to ensure that only appropriate trading is allowed, it is proposed that the granting of all consent applications will be carried out by Head of Transportation Services in consultation with the Town Centre Manager.
  1. The primary purpose of this re-designation is to allow a weekly Town market. Other trading may be considered.
  1. The resolution that is to be put before the Transportation Advisory Group shall be” Members are asked to resolve that an area of the High Street from Falkland Square to Old Orchard shall be re-designated as a consent street. Such re-designation shall come into force on 2 February 2004 ”
  1. If you wish to object or make representation regarding the intention to re-designate the aforementioned section of the High Street, you should put your objections or representations in writing addressed to the Head of Transportation Services, St Johns House, Serpentine Road, Poole BH15 2DX. Any representations must be received by 1 December 2003.
