On [date] I bought the above [item] at a cost of [£……] from you. When I visited your shop on [date] the [item] was described to me as follows [describe]. It was on the basis of your description that I preceded with the purchase. I have subsequently discovered that the [item] does not match that description and is [describe including actual value, if appropriate].

As your description was a key factor in my decision to buy the [item], the sale was one ‘by description’, and as the [item] does not correspond with that description, you are in breach of contract.

IF PURCHASE MADE BEFORE 1ST OCTOBER 2015:

I am therefore exercising my rights under the Sale of Goods Act 1979 (as amended) to reject the [item] and expect you to reimburse me with a refund of the full purchase price of [£……] within 14 days.

IF PURCHASE MADE AFTER 1ST OCTOBER 2015 AND YOU ARE WRITING THIS LETTER WITHIN 30 DAYS OF PURCHASE:

I am therefore exercising my rights under the Consumer Rights Act 2015to reject the [item] and expect you to reimburse me with a refund of the full purchase price of [£……] within 14 days.

I look forward to hearing from you with a cheque in my favour for the full purchase price within 14 days.

If I do not hear from you with a satisfactory response to this letter within 14 days then I will proceed to start legal action against you to recover my loss.

In accordance with the Sale of Goods Act 1979, you have a right to reject goods that are unsatisfactory quality, unfit for purpose or not as described and get a full refund. However, this right is limited to a 'reasonable' time and is usually up to 4 weeks from the date you purchased the product. A reputable retailer may give you a refund as a goodwill gesture if you have exceeded this period of time.
In accordance with the Consumer Rights Act 2015, you have an early right to reject goods that are unsatisfactory quality, unfit for purpose or not as described and get a full refund. However, this right is limited to 30 days from the date you purchased the product. Please note that this right does not apply to digital content. Again, a reputable retailer may give you a refund as a goodwill gesture if you have exceeded this period of time.
