REGULATION ON IZMIR HARBOR

Part I: Borders of İzmir Harbor

Article 1 – İzmir Harbor is the marine zone left on the east of the line connecting the zone between Güzelyalı and Sazburnu, as shown in the drawing no 1 enclosed herein.

Article 2 - İzmir Harbor is divided into three parts: Roadstead, Middle and Inland Harbor.

A – Roadstead is the marine zone left between the line connecting Sazburnu and Güzelyalı and the line connecting Karşıyaka and Salhane.

B – Middle Harbor is the marine zone left between the line connecting Karşıyaka and Salhane and the line drawn through the north side of the mole and Naldöken at Karşıyaka beach.

C – Inland Harbor is the marine zone at the eastern side of the line drawn through the north side of the mole and Naldöken at Karşıyaka beach.

The mole is considered within the inland harbor.

Part II: Anchoring places

Article 3 – Göztepe bay at the roadstead is the free anchoring place. The vessels may anchor here without taking any permission; however, they shall be liable to inform the Harbormaster of the place they anchor. In case that no free space is left in the middle and inland harbor the vessels shall anchor at the roadstead and wait for their turn.

Article 4 – Except for the free anchoring place at the roadstead, no vessel may anchor and lash in any place in the harbor without taking permission and instruction from the Harbor Master. The vehicles owned by İzmir Harbor Affairs Administration that will anchor in front of the shipyard for repairing purposes shall not have to take permission from the Harbormaster for each time.

Article 5 – It shall be forbidden to anchor over the phone cables installed between Alsancak Fire Station and Alabey in Karşıyaka. A white reverse anchor sign shall be put on black table over the places where the phone cable gets into the sea in İzmir and gets out of the sea in Karşıyaka.

Article 6 – Except for the free anchoring place, masters or agencies of the vessels that approach and lash to the berths or anchor in any place in the harbor without getting permission from the Harbor Master shall be subject to the criminal provisions of the Harbors Law and that do not obey with the notification given for leaving such places shall be removed by the pilot and towboats assigned by the Harbor Master and the costs arising from such actions shall be covered by those vessels.

Article 7 – The vessels loaded with flammable or explosive substances may not anchor or lash in the places other than the places specially designated for them.

Article 8 – The vessels may not prevent sea hunting by anchoring in sweeping locations. Provisions of article 6 shall be applicable for the vessels acting in contrary to this provision.

Part III: Transportation of Dangerous Substances

Article 9 - (Amended Article: 25/03/1970 - 7/396)

Transportation, loading and unloading of explosive, flammable and similar substances as well as other dangerous substances shall be made via special boats and pots in accordance with the provisions of (Regulation on the Transportation of Dangerous Materials by means of Commercial Vessels), (Regulation on the Inspection of Gunpowder and explosive substances, guns and accessories as well as hunting equipment) and (Regulation on the measures to be taken in the workplaces dealing with flammable, explosive, dangerous and hazardous substances) and provided that necessary security measures are taken.

The vessels loaded with explosive, flammable and similar dangerous substances shall fly B color flag during the day and shall show a red light at night which may be seen over the horizon.

Article 11 - (Amended Article: 25/03/1970 - 7/396)

The owner, vessel master or agencies shall notify, at least 24 hours before the arrival of the vessel in the Harbor, the Harbor Master, Harbor Directorate, İzmir Municipality and Security Directorate in writing of the type and amount as well as the flammable degree in centigrade of the load in the vessels carrying explosive, flammable and similar dangerous substances.

Article 12 - (Amended Article: 25/03/1970 - 7/396)

The vessels loaded with explosive substances may not enter into middle and inland harbor. Such vessels may anchor in Göztepe bay at the roadstead at least 370 meter-distant from the beach (2 cables).

Article 13 - (Amended Article: 25/03/1970 - 7/396)

The vessels loaded with flammable and explosive substances lower than 60 centigrade may anchor at least 370 meter-distant (2 cables) from the beach in the inland harbor within the marine zone left at the north of the line connecting the point cut by the line drawn through the western side with a longitude of 27° 10’ 12" and meridian of38° 27’ 13" north and cut by the east meridian of 27° 08’ 00" and the port of Karşıyaka.

Fuel oil tankers shall lash in the special ports and buoys within this zone.

Article 14 - (Amended Article: 25/03/1970 - 7/396)

The vessels loaded with explosive substances as well as the vessels loaded with flammable substances lower than 60 centigrade shall unload to transshipment vehicles with at most 25 tons parties in the anchoring places stated in article 12 and 13, respectively. Such loads in transshipment vehicles shall be moved to the berths or ports to be identified and appointed together by the Governor, Municipality, Harbor Master and Harbor Directorate provided that the security measures are taken and then shall be shipped to their destination by means of land vehicles.

Such substances to be exported from the harbor shall be loaded to the vessels under the same conditions.

Not more than one transshipment vehicle loaded with such substances may stay in the vessel board, berth or ports.

Article 15 - (Amended Article: 25/03/1970 - 7/396)

The vessels loaded with flammable substances lower than 60 centigrade belonged to other harbors may be taken to the lashing places in Alsancak provided that necessary security measures are taken.

These vessels shall be monitored by a fire brigade to be provided by the Harbor Directorate. In order to allow the vessel to move away from the berth immediately, a wire rope shall be hung down the sea from the head and aft of the vessel. The vessel master shall take the necessary security measures against fire.

Article 16 - (Amended Article: 25/03/1970 - 7/396)

The vessels loaded with flammable substances more than 60 centigrade shall be monitored by a fire brigade during loading and unloading to be provided by the Harbor Directorate. Necessary security measures shall be taken by the vessel master and harbor directorate in the vessel, berth or port. The unloaded substances shall immediately be dispatched to their destination by means of the land vehicles without staying on the berth or port.

Such substances to be exported from the harbor shall be loaded to the vessels under the same conditions.

The war ships may enter into middle and inland harbors in order to secure their ammunition.

Article 18 - (Amended Article: 25/03/1970 - 7/396)

Loading and unloading of explosive, flammable and similar substances shall be made during daytime between the rising and setting of the sun.

However, the vessels, which will load or unload poured fuel oil, may continue to work during the night.

Article 19 - (Amended Article: 25/03/1970 - 7/396)

The tankers with small tonnage that will supply fuel oil for the vessels may work in the inland and middle harbors provided that they do not transfer oil.

Article 20 - (Amended Article: 25/03/1970 - 7/396)

The vessels burning coal may not approach, exchange pilots and substitute for the vessels carrying flammable, explosive and similar dangerous substances.

Part IV: Navigation within the Harbor

Article 21 – Navigation within the harbor shall be subject to the rules of the prevention of collisions.

Article 22 – The vessels entering into the harbor shall remove their national and company flags as well as the special sign of the vessel as soon as they pass through the east of the line connecting Güzelyalı and Sazburnu. Each vessel entering into the harbor shall keep one of its anchors for dropping.

Article 23 – The steam ships and motored vessels navigating within the mole shall navigate at a speed as no to damage the marine vehicles lashed to the berth.

Article 24 – In accordance with the provisions of the regulation on the prevention of collisions at sea, all marine vehicles shall maintain the equipment necessary to give the signs during foggy weather conditions. Vessels shall not be allowed to whistle excluding the maneuvers within the harbor.

Article 25 – The marine vehicles shall not be allowed to stay too distant from the harbor coast or in a way that may give damage to the navigation.

Article 26 - Vessels may not hoist sails within the mole.

Article 27 – The vessels and marine vehicles that may not maneuver such as active diving vehicles shall hoist baskets during daytime and a white light at night. The vehicles fishing with net and basket shall hoist, in addition to the light stated in the first paragraph, a second white light at least one and a half meter horizontal and two meters perpendicular to the direction of the net or basket thrown.

Article 28 – During the rehearsals of the rowboats navigating in the harbor at night, there shall be a white light on a flagstaff with an altitude of eighty centimeters, which could be seen at each direction of the horizon.

Article 29 – Landing barge, pontoon boat, barge and similar sea vehicles without motor that are towed within the harbor shall be administered by a person capable of managing these vehicles, and this person shall be on the rudder or shall be in a position to be able to manage the vehicle. Following the publication of this regulation, such vehicles to be registered in İzmir Harbor shall be equipped with rudder.

Article 30 – It shall be forbidden to tow within the mole more than one vehicle either consecutively or side by side by towboats.

Under any circumstance, the towboat shall not surpass 60-meter length and 16-meter width.

Article 31 – All vessels and sea vehicles tilting or navigating in the harbor shall hoist the lights and signs that are compulsory as prescribed by the provisions of the regulation on the prevention of collisions at sea.

Part V: Order and discipline within the Harbor

Article 32 –The precautions to be taken in the harbor in respect of order and discipline and navigation as well as the instructions to be given by the Harbor Master with regard to the loading and unloading of commercial goods on the berth shall be immediately fulfilled by the authorities concerned.

Article 33 – Agencies of the vessels to enter the harbor shall inform the place and time of anchoring or lashing in the harbor upon applying to the Harbor Master at least 12 hours before their arrival in the harbor. The Harbor Master shall identify the place of anchoring and lashing of the vessel upon the application concerned.

Article 34 – Except for the vessels tilting at the roadstead, no vessel staying in the inland and middle harbors may change its position unless necessary permission is taken from the Harbor Master. The vessels changing their places due to force majeure shall immediately notify the harbormaster of such changes together with the circumstances of force majeure.

Article 35 – The vessels shall be tightly lashed to the berth and the ties shall have such a mechanism as to unfasten easily. It is forbidden to fasten the ropes and wires of vessels to places other than the bollard and rings on the berth.

Article 36 – It is forbidden without the permission of the Harbor Master to extend ropes on navigation water other than the ropes used for lashing maneuvers.

Article 37 – The vessels lashed in the berth shall inform the harbormaster and duly communicate with the vessels and vehicles around them before activating their screws for a long time in order to get prepared for movement. The vessels activating their screws with their main machines shall be careful as not to give any damage to the berths and mix the harbor bottom. The vessels approaching to or leaving the berth shall not maneuver with their machines if not due to force majeure while their hawsers are connected to the coast. Excluding the circumstances described above, it is forbidden to rotate screws alongside the berth.

Article 38 – Necessary precautions shall be taken as not to give damage to the vehicles sailing around the board while releasing vapor or pressing water to the sea regardless of the method used.

Article 39 – Except for the mole, the vessels entering into the inland or middle harbor may stay for one month at most; and the vessels that are to stay for a longer period of time may continue with the permission of the harbormaster until they finish their job. The vessels wishing to stay at İzmir Harbor though they don’t have any job to do shall anchor in a place within the inland harbor to be identified by the harbormaster as not to give any damage to the navigation.

Article 40 – The vessels overloaded according to freeboard mark and landed on bilge as to cause damage during navigation, the vessels taken passenger beyond the regular amount, the vessels that are not found capable for navigation in accordance with the regulation on examination procedures as well as the vessels that fail to fulfill the provisions of the regulation on the health safety of passengers shall not be allowed to move away from the harbor.
