Proposed Dog Control Orders Consultation

Notice is hereby given that Westminster City Council proposes to make Dog Control Orders pursuant to its powers under Section 55 of the Clean Neighbourhoods and Environment Act 2005.

Representations are hereby invited on the proposals to make the following Dog Control Orders:

PROPOSED ORDERS:

1. Dogs on Leads

This Order will require a person in charge of a dog to keep it on a lead at all times, in the following areas:

·  that part of Queens Park Ward shown shaded blue on Map 1 with the exception of the areas shown shaded red on Map1 and the designated dog run area in Queen’s Park Gardens shown shaded yellow *

·  that part of Churchill Gardens Estate shown shaded blue on Map 2 with the exception of the areas shown shaded red*

It will be an offence if, the person in charge of a dog does not keep the dog on a lead when on land to which this Order applies.

2. Dogs on Lead by Direction

This Order will require a person in charge of a dog to put and keep a dog on a lead when asked by an authorised officer of the Authority, in the following areas:

·  those parts of Queen’s Park Ward shown shaded blue, red or yellow on Map 1*

·  those parts of Churchill Gardens Estate shown shaded blue or red on Map 2*

It will be an offence if, when asked by an authorised officer, the person in charge of a dog does not put and keep the dog on a lead when on land to which this Order applies.

3. Exclusion of Dogs

This order will exclude dogs from the areas in Queen’s Park Ward shown shaded red on Map 1* and Churchill Gardens Estate shown shaded red on Map 2 * :

The areas in Queen’s Park Ward shown shaded red on Map 1* are:

  1. Children’s playgrounds in Avenue Gardens and Selby Square
  2. Children’s playground and wildlife garden in Queen’s Park Gardens
  3. Rose Garden in Queen’s Park Gardens
  4. Multi use sports area in Queen’s Park Gardens
  5. Multi use sports area at Jubilee Sports Centre
  6. Lawn/grassed area in centre of Queens Park Court
  7. Harrow Road Open Spaces

8.  Lawn/grassed area behind Lawes House

The areas in Churchill Gardens Estate shown shaded red on Map 2 * are:

1.  Children’s playgrounds behind Elgar House and Anson House

2.  Sports areas/football pitches in front of Chippendale House, Bramwell House and Coleridge House

3.  Sports area/Agora football pitch and playground behind Churchill Gardens Youth Club

4.  Garden areas behind Blackstone House and Ripley House

5.  Lawn/grass areas behind Langdale House and Nash House

6.  Old tennis court and surrounding area behind Pimlico District Heating Unit

It will be an offence for any person in charge of a dog on land to which the proposed Dog Exclusion Order will apply, to take a dog onto, or permit the dog to enter or remain on, such land.

The order will not apply to a person who is registered as a blind person in a register compiled under section 29 of the National Assistance Act 1948, or is deaf, in respect of a dog trained by Hearing Dogs for Deaf People ( registered charity number 293358) ,or a person who has a disability which affects their mobility, manual dexterity, physical co-ordination or ability to lift , carry or otherwise move everyday objects, in respect of a dog trained by Dogs for the Disabled ( registered charity number 700454), Support Dogs ( registered charity number 1088281) or Canine Partners for Independence ( registered charity number 803680) and upon which they rely for assistance.

Penalty

Anyone who commits an offence under any of the provisions of the above mentioned Dog Control Orders may be liable on conviction in the Magistrates Court to a fine not exceeding level 3 on the standard scale (currently £1000).

Westminster City Council intends to issue £80.00 fixed penalty notices for Dog Control offences. Failure to pay a fixed penalty notice may result in prosecution.

Any representations on the proposed Dog Control Orders should be made to Westminster City Council before the end of the consultation period on 2nd May 2008.
