New Mexico state law provides that the Public School Capital Outlay Council (PSCOC) may approve applications for the purpose of making lease payments for classroom facilities, including facilities leased by charter schools. The amount of a grant to a school district shall not exceed:
(a) the actual annual lease payments owed for leasing classroom space for schools, including charter schools, in the district; or
(b) seven hundred dollars ($700) multiplied by the full time equivalent enrollment (MEM).

INSTRUCTIONS
(1)Please include a cover letter with your application(s) addressing the following:
- The need for the additional space, if anticipated.
- If space is available in an existing school district building, why the space does not meet the programmatic needs of the school.
- If a charter school, indicate whether or not thecharter school is included in the school district’s current facilities master plan. If not, provide the anticipated date of inclusion.
- If a charter school, briefly describe the long range plan for transitioning topublic space by 2010. If public space is not projected to be available in the district to meet the school’s programmatic needs, describe your future leasing needs beyond 2020.
(2) Complete a separate application for each facility for which a lease exists and lease payment assistance is being requested. Include in the facility description the current grade levels served, number of permanent and portable classrooms, acreage of school site and a copy of the floor plan.
(3) If you received an award in 2006-2007 and no changes to a leasehave been made, indicate in a cover letter that the current leaseon file at PSFA is current and correct. Otherwise,attach a complete and signed copy of the current or proposed new lease(s) for the 2007-2008 school year (07/01/07 – 06/30/08) with the application.
(4) First year charter schools enter the estimatedfull time equivalent enrollment (MEM). For all others, enter the average of the 80th & 120th day full time equivalent enrollment membership count (MEM) of the prior year as reported to the Public Education Department (PED).
(5) Applications for lease assistance for charter schools shall be made on behalf of charter schools by the school district, signed by the school district superintendent. In the event the school district fails to submit or sign an application on behalf of a charter school, the charter may submit its application directly to the PSFA.
(6) A grant received for the lease payments of a charter school may be used by that charter school as a state match necessary to obtain federal grants pursuant to the federal No Child Left Behind Act of 2001, provided that;
(a) federal funds shall be used to supplement lease payments provided by the state; under no circumstances may federal funds be used to supplant payments provided by the state;
(b) federal match will be contingent upon an amount received through state funds;
