THE BOARD OF PUBLIC WORKS & SAFETY OF THE CIVIL CITY OF NEW ALBANY, INDIANA, WILL HOLD A GREVINCE HEARING IN THE THIRD FLOOR ASSEMBLY ROOM AT THE CITY/COUNTY BUILDING ON TUESDAY, APRIL 19, 2011 AT 10:30 A.M.

PRESENT: MattDenison, Kay Garry, Suellen Wilkinson

ALSO PRESENT: Joe Hamm, Krisjans Streips, Shane Gibson, Dave Rake, David Banister, Bill Dickens,and Mindy Milburn

Mr. Denison called the meeting to order at 10:41 a.m.

Mr. Rake stated that they were both aware of the meeting but he believes one is still incarcerated

Mr. Gibson asked that the record show that neither Cory Smith nor Jordan Rummage were present and asked that the grievance be dismissed.

Mr. Banister stated that they do not condone the actions of the two employees as they were caught red handed and neither one is present to give their side of the story. He explained that they have to go through the formalities and he doesn’t anticipate this going any further and they would not like to spend their valued dollars on frivolous grievances. He stated that he believes that the union has completed their requirement of fair representation

Mr. Gibson introduced a list of exhibits for the record to show that there was a basis for termination. He thanked the members of the union for showing up for the hearing and explained that the exhibits prove that the alleged incidents occurred on city time. The list of exhibits includes the following:

Exhibit 1 – Letter of termination for Jordan Rummage
Exhibit 2 - Letter of termination for Cory Smith
Exhibit 3 – Official Grievance form for Jordan Rummage
Exhibit 4 – Official Grievance form for Cory Smith
Exhibit 5 – Affidavit for probably cause for Jordan Rummage
Exhibit 6 – Affidavit for probably cause for Cory Smith
Exhibit 7 – Police Report for Jordan Rummage
Exhibit 8 – Police Report for Cory Smith

Mr. Banister stated that many think if they have been exonerated in court they should get their jobs back but that is not the case because the city fired them for violation of their contract and this is why their job is no longer available

Mr. Gibson requested that the grievances be denied.

Mrs. Wilkinson moved to deny both grievances, Mrs. Garry second, all voted in favor.
