Convictions and Cautions and Previous Disclosure Checks

Embrace provides support to vulnerable people both within care homes and in the community. As a result employment is subject to an Enhanced DBS Disclosure/Scotland Check.

Employment to these roles is exempt from the provisions of the Rehabilitation of Offenders Act 1974 (Exemptions Order 1975) and all previous convictions and cautions will need to be disclosed. The amendments to the Exceptions Order 1975 (2013) provide that certain spent convictions and cautions are 'protected' and are not subject to disclosure to employers , and cannot be taken into account.

Guidance and criteria on the filtering of these cautions and convictions can be found on the Disclosure and Barring Service website.

If you are appointed and it is later found that you have convictions or cautions that you did not disclose at the application stage, this will be treated as gross misconduct and may result in dismissal.
