WAIVER OF RELEASE OF LIABILITY /
ASSUMPTION OF RISK AND INDEMNITY
Inconsiderationofparticipating in Penobscot Ice Arena / Penobsco Hockey, Inc,activities, I represent that I understand the nature of Ice Hockey and figureskatingactivities(“activity”)and that I am qualified, in goodhealth and in proper physical conditionto participate insuch “activity”.I acknowledge thatifI believeevent conditions are unsafe, I will immediatelydiscontinue participationinthe “activity”.
I fullyunderstand thatthis “activity”involves risks ofserious bodilyinjury, including permanent disability, paralysis and death, which may be caused by my own actions, or inactions, thoseofothers participating inthe “activity”, the conditions in whichthe “activity”takes place, or the negligence of the “releasees” named below; and that there may beother riskseither notknownto me or not readilyforeseeable atthis time;and I fully accept andassume all such risks and all responsibility forlosses, costs, and damages I incuras a result of my participationinthe“activity”.
I hereby release, discharge, and covenant not to sue thePenobscot Ice Arena / Penobsco Hockey, Inc., it’s directors, officers, administrators, sponsors, volunteers,agents, employees, staff, instructors,trainers,other participants and if applicable, owners and lessors of premises onwhich the “activity” takes place (each considered one of the “Releasees” herein) from all liability, claims, demands, losses,or damages on my account caused oralleged to be caused inwhole or in part by thenegligence of the “releasees” or otherwise,including negligentrescue operations;andI further agree thatif, despite this release,waiver of liability, and assumptionof risk, I,or anyone onmy behalf, makesaclaim against any ofthe Releasees,I will
indemnify, save,and hold harmlesseachofthe releasees from any loss,liability,damage,or cost which anymay incur astheresultofsuch claim.
The Penobscot Ice Arena / PenobscoHockey, Inc. has the right, but not the obligation, to provide rules, regulations and/or ice monitors for sessions.We hereby acknowledge that the Penobscot Ice Arena / Penobsco Hockey, Inc shall not be responsible for the supervision of the participants while in the facility.
I have read this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, ANDINDEMNITYAGREEMENT, understand that Ihave givenup substantial rights bysigning it and have signed it freely and without any inducement or assurance of any nature and intend itto bea complete and unconditionalrelease of all liability to the greatest extent allowed by lawand agree that if any portionofthis agreementis held to be invalid,the balance,notwithstanding, shall continuein full forceand effect.
