Marriage License Requirements

State of Texas

1) Do you need a Texan marriage license if you are planning to get married in Texas?

Yes, all couples must apply for and receive a marriage license from the County Clerk’s office of some county in Texas in order to get legally married in the state. Once issued, the license is good throughout Texas, regardless of where you filed your license application. For example, if you and your fiancé received your marriage license from Tarrant County, you can still get married in Houston if you choose.

2) What do you need to bring to the County Clerk’s office to get the marriage license in Texas?

You and your fiancé will need to appear together at the applicable County Clerk’s office to fill out and sign you application and pay the required license fee. Texas also requires that both applicants present either photo ID or a certified birth certificate in order to prove their age and identity when they file their application. In limited circumstances, Texas does allow marriage licenses to be issued even when one of the applicants cannot be physically present when the license application is filed. If this is your situation, your local County Clerk’s office will have more information about when this is allowed and what the proper procedures are for absentee applications.

3) When is the marriage license valid in Texas?

Texas has a mandatory 72 hour waiting period for after you file your application. This means that you must apply for the license more than three days before your wedding in order for your marriage to be legally valid. Couples who complete a state offered premarital education class can have the waiting period waived. Some other couples may also qualify to the have the waiting period waived, such as applicants who are active duty military. Your local County Clerk will have more information on the exceptions to the waiting period. After the 72 hour waiting period is up, the marriage license remains valid for 30 days. After those 30 days, the license expires and can no longer be used to legalize your marriage.

4) How much do marriage licenses cost in Texas?

Because marriage licenses are issued at the county level, the marriage license fee depends on which county in Texas you apply in. Currently, most counties charge around $70 for a marriage license. If you and your fiancé are residents of Texas, you can get a discount on your license fee by completing a premarital class that is provided by the state for free. The class is usually around eight hours long and is offered in locations around the state. Couples who complete the class are given a discount of $60 on their marriage license fee and the 72 hour waiting period is waived for them. Please visit to locate classes in your area.

5) Blood test in Texas:

No. Blood tests or medical examinations are not required in Texas.

6) Proxy Marriages:

Yes, but marriage by proxy in Texas is limited for individuals serving the military and stationed outside of the country.

7) Previous Marriages:

If either applicant has been recently divorced, the state requires a 30-day waiting period from the date of the filed divorce decree, unless waived by the court. Female applicants are required to submit a certified copy of final decree showing their restored maiden name if different from current identification.

11) Name Change:

Getting a marriage license with your new name on it does not mean your name has automatically changed. If you need to change your last name, you can use an online marriage name change kit.

12) Under 18:

If an applicant is under the age of 18, must be accompanied by one parent, to sign legal consent. A minor must have a certified copy of birth certificate, photo I.D. and Social Security card or proof of social security number. If parents are divorced, the parent granted custody must submit a certified copy of their divorce decree in order to sign consent. 13) Absent Application:

All applicants must be present for the ceremony unless: (a) the absent applicant is a member of the armed forces of the United States stationed in another country in support of combat or another military operation and unable to attend the ceremony. All other applications will have to be present for the ceremony. Absent Applicant Affidavit Application required.

14) ID Requirement:

Persons authorized to perform weddings in Texas include licensed or ordained Christian ministers, priests, Jewish rabbis, officers authorized by religious organizations, justices of the supreme court, judges of the court of criminal appeals, justices of the courts of appeals, judges of the district, county, and probate courts, judges of the county courts at law, judges of the courts of domestic relations, judges of the juvenile courts, retired justices or judges, justices of the peace, retired justices of the peace, and judges or magistrates of a federal court of Texas.

19) There are two different types of marriage licenses in Texas, and basic requirements are the same for both types of marriage:

  • A “Formal marriage license” can be obtained from any county in Texas and the marriage can be performed anywhere. If the marriage takes place outside of Texas, contact the appropriate state office, consulate or embassy to learn the marriage requirements for that state or country.
  • A “Declaration and Registration Of An Informal Marriage (Common Law)”

An informal marriage license can be obtained and recorded by a couple who agree to be married, and after the agreement, they lived together in this state as a couple and represented to others that they were married.

Wedding Calendar Checklist

The following checklist is designed with the (ideal) timetable of twelve months. If you’re planning your wedding on a shorter schedule, just start at the beginning of the list and try to catch up as quickly as possible. 9 to 12 months prior to wedding day:

1 week prior:

☐Enclose any fees due on the wedding day in envelopes for easy distribution.
☐Give the caterer a final head count.
☐Appoint a trustworthy person to bring important items (cake knife, toasting glasses, etc.) to the reception. / ☐Appoint someone to act as an “organizer” to handle any last-minute problems.
☐Review final details for those in the wedding party.
