Exhibitor Agreement

All applications must be received by October 15, 2018 and are subject to approval. Payment is to be submitted with your signed contract. In the event that the exhibitor's cheque is returned by a bank, a $50.00 administration fee will be charged to the exhibitor.

The Orillia Holiday Craft Show will be a one-day Indoorevent on November 3, 2018 from 9AM-3PM.

Vendor set-up will be November 9, 2018 from 7AM-9AM. All vendor displays must remain intact until 3PM the day of the show. All items must be removed by the vendor or their representative by 5PM the day of the show. All vendors must be checked-in by 8:30AM or reservation will be considered voided.Tables and chairs are provided.

All types of items sold must be listed in the contract. No items outside those listed in the contract may be sold without approval. The Orillia Holiday Craft Show committee reserves the right to limit the number of participating vendors within the same genre and to refuse any vendor application.

All space assignments are final and the choice of the Orillia Holiday Craft Show committee. Special requests are filled only at the discretion of the committee. Assignments will be made on a first come/paid in full basis.

No generators, flame/explosive generating items, animals (except service animals), sexually explicit or profane items, illegal sale items, artificial tobacco item, weapons, alcohol, or drugs/drug paraphernalia are allowed. This list may be expanded at the discretion of the Orillia Holiday Craft Show committee upon review of such items. No vehicles will be used in any display.

It is the vendor’s responsibility to carry liability insurance for their product and or business (not required, but it is your responsibility to decide whether to obtain or not).

ODAS Park is a smoke-free building. Any vendor found possessing/selling such items or behaving in an inappropriate manner will be asked to vacate the premise immediately and will not be entitled to any refund.

Photography will be permitted during the event. Any photographs retrieved by the Orillia Holiday Craft Show or its representatives will become the property of the Orillia Holiday Craft Show for future use in advertising publications (both print and digital).

Vendors are expected to act courteously and professionally to all guests and other vendors. No harassment or roaming sales will be tolerated. Any vendor not respecting the rules mentioned above will be asked to leave the event immediately and will be allowed to return only after event closing to collect their display.

Indemnity

Orillia Holiday Craft Show shall not be liable for damage or loss to any vendor’s property through theft, fire, accident or any other cause, whether the result of negligence or otherwise.

The vendor shall indemnify Orillia Holiday Craft Show against and hold it harmless from any complaints, suits or liabilities resulting from negligence of the vendor in connection with the vendor’s use of display space.

Orillia Holiday Craft Show assumes no liability for any injury that may occur to visitors of the show, vendor’s agents and employees, or others. Vendors agree not to make claims against the Orillia Holiday Craft Show, its employees, volunteers or agents, except for breach of Orillia Holiday Craft Show of this contract.

Exhibitor/Vendor is responsible for himself/herself and his/her employees, his/her subcontractors, materials, equipment and all insurance to protect himself/herself and/or others.

Cancellation/Termination

Withdrawal or cancellation by Applicant prior to October 15, 2018 will be subject to a 50% service charge; the remainder to be refunded. After October 15, 2018, withdrawal will result in forfeiture of the entire amount paid to Orillia Holiday Craft Show.

Failure to comply with all terms of this contract will result in the cancellation of this contract without notice and all rights of the exhibitor hereunder shall cease and terminate. Any payment made by the exhibitor on account hereof will be retained by Sale Management as liquidated damages for breach of this contract and Sale Management may there upon re-rent said space.

Cancellation or Re-Scheduling of Show

In the event that the facility in which the show is being held, or scheduled to be held, is destroyed or becomes unavailable for occupancy, for reasons beyond the control of Sale Management and its sponsors, or if for any reason Sale Management is unable to permit the exhibitor to occupy the facility or the space, or if the show is cancelled or curtailed, Sale Management will reschedule for another date and tables/fees will be held for that date. The reasons listed include, but are not limited to, such reasons as: casualty, explosion, fire, lightning, flood, weather, epidemic, earthquake, or other Acts of God, acts of public enemies, riots, civil disturbances, strikes, lockouts or boycott.
