November 7, 1960

Orem City Council met in regular session, Monday November 7, 1960, at 7:00 P.M. in the Council Chambers. Present were Mayor M. D. Wallace, Chairman; Councilman Winston Crawford, Earl Wengreen, Alvin Rowley, Laird Billings, and Harley. Also present were City Manager O. V. Farnsworth, Engineer L. V. Beckman, Treasurer Victor H. Christensen, and Recorder Anne Cooper.

Meeting opened with prayer by Laird Billings.

The judge report for October was read by Winston Crawford. Fifty-five arrests had been made for illegally passing a school bus, and 176 tickets were given for speeding due to the drive on traffic violations in the school zone on 300 South State.

City Manager O. V. Farnsworth stated that Judge Johnson had not charged the City the $2.50 fee due him for each violation, as he felt that would make his salary too great for the time the special drive is on. The City Manager asked that a decision be made as to the method of paying the Judge, salary or fee. The Judge feels that a flat salary would be equitable.

Councilman Gillman stated that he feels that violators should be warned if they aren't going over ten miles per hour over the speed limit of 20 miles per hour in the school zone.

City Manager Farnsworth said that preference cannot be shown to anyone. The Judge can suspend a fine if he feels a suspension is justified, but a police officer does not have that right.

Winston Crawford stated he believes the Officers are following the unwritten law of allowing a certain speed over the speed limit.

Earl Wengreen expressed his belief that a 20 mile sign should be installed in the 300 South State School zone.

Winston Crawford reported that signs were coming from the State Highway Commission and would be here soon.

Laird Billings suggested that larger portable flashing red lights be purchased for use by Police cars for use on accidents.

Laird Billings read a letter of resignation from the Planning Commission by Clifton M. Pyne. Mr. Pyne gave his reason for resigning as having too many other activities. Motion was made by Laird Billings that the resignation is accepted, and a letter of appreciation be sent to Mr. Pyne. The motion was seconded by Harley Gillman, and passed.

Motion was made by Laird Billings to authorize the City Manager to contact Wayne Mills, Contractor, to ask him to serve on the Planning Commission. The motion was seconded by Harley Gillman, and passed.

Mayor Wallace reported that Glen Stewart, who had been appointed to the Planning Commission, is moving out of Orem. The Council asked that Mr. Stewart be contacted personally, to determine hog long he will be in town.

Alvin Rowley reported on the Freedom Forum held at B Y U, Wednesday, November 3, 1960. Pictures were shown of the results of Communist rule in European Countries, also of how easily Young people are fooled by the devious methods used by Communist agitators here in the United States.

Winston Crawford stated that the Geneva Steel Plant is going to purchase some of the films, which will be shown to the Council and Chamber of Commerce.

Milton Johnson stated he was sure the Chamber would participate with the City in purchasing the film if the Council makes that decision.

LeGrand Jarman specified that agencies already set up should have the responsibility of carrying out the program of acquainting the people with the acute necessity of their waking to the eminent danger of the Communist program as it applies to the United States.

Scera Board members Rex Blake, LeGrand Jarman, Shazp Gillispie, and S. Grant Stevenson met with the Council. Mayor Wallace reported the Board had been invited to come in in order to study problems existing between the Scera and Orem City, and expressed appreciation for the work the Scera Board had done on the Recreation program.

Laird Billings, acting as moderator, stated that, as a City, Orem is proud of the work being done by the Scera to prevent delinquency, Communism, etc. A job is being done that is ordinarily done by a City. The program is to help wherever possible.

Dover Hunt passed over past problems, stating that future obligations need attention now. The immediate problem is that lines in the new sprinkling system need flushing out before they are covered.

Engineer L. V. Beckman stated that electricians have work to do on the high line before the well is ready to go. Provo Electric estimated a cost of $5,000. Utility Engineers, S. L. C., will do the work. Utah Power and Light Company will connect their line next Saturday morning.

Grant Stevenson stated that the previous Thursday had been set to energize the transformers to get the well going.

City Engineer Beckman promised to get the Fairbanks Morse man down here the following Saturday.

Mr. Beckman will run the water from the well into City lines as the sprinkling system is not ready.

Dover Hunt suggested running lines for drinking fountains to the North area stating that Glen Case has asked to tap into the main water line, installing one line to the East next to the pump house, and one to the West.

Mr. Hunt stated that he appreciates the good help given him by the City Manager O. V. Farnsworth, Water Superintendent of Construction, Glen Case; and City Engineer L. V. Beckman.

Dover Hunt reported that next spring the old swimming pool will have to be repaired at a cost of $5,000 or $6,000. Or a new pool built. He hopes they are able to build a new pool. Mr. Hunt asked to what extent the Council can help. The trench needs back filling now.

Earl Wengreen stated that finances are the problem.

Mayor Wallace said that the purchasing of the land may have been tied in with the City Parks at one time, leaving the Scera to serve in another area.

Legality of the City's participating in the Scera Program was discussed.

Dover Hunt said that the Scera is set up as a non-profit organization, but that a certain amount of commercial business has to be done to help them meet their obligations. Mr. Hunt suggested the commercial end could be taken care of by the Scera. Winston Crawford suggested that an Attorney check the legality of such a project, and to study funds available.

Dover Hunt reported there is a small tract of land between Scera and the School ground which should be purchased to help coordinate the school and Scera programs. The approximate cost would be $5,510.

LeGrand Jarman reported that Scera is now in debt $50,000 in real estate, and $35,000 in 2% bonds Lave to be redeemed in 9 years. The interest rate may have to be raised to 3%. If the Scera defaults in payment it may fall back on to the City.

Dover Hunt felt that the 75 cent donations would be a redeeming feature if enough people would sign up for it.

LeGrand Jarman suggested that a member of the Council should be on the Scera Development Committee.

Laird Billings reported that wiring in the Poulson Building (new library) is in poor condition and the insulation is crumbling. Visible conduit would be recoverable later when the building is torn down. Councilman Billings proposed that the Scera, City, and Mr. Poulson participate one-third each in the cost for rewiring. Dover Hunt said to go ahead and rewire as it has to be done anyway, and he would let the Council know if the Scera will participate after the meeting of the Board the following Monday.

Refilling the trench was discussed. City Manager Farnsworth stated that since it had rained Patrol had been used on the roads. Dover Hunt said that if the City can't do the work other arrangements would have to be made to do the work.

Motion was made by Earl Wengreen to authorize the City Manager to call a Public Hearing on Nov. 28, 1960, to propose rezoning the triangular piece of land East of Main Street and North of 400 South Street from R-s to W-1 and from R-A to W-1 as recommended by the Planning and Zoning Commission. The motion was seconded by Alvin Rowley, and passed.

City Manager Farnsworth reported that according to the State Statutes the Library Board should consist of six members, each to serve a six year term. The Mayor has to be a member of the Board, or appoint a member of the Council to the Board.

Winston Crawford suggested that someone be set up to assume the responsibility of safety for the City Employees. He should set up a safety practice procedure and build safety consciousness into the Program.

Laird Billings suggested that eventually someone will have to relieve the City Manager of some of the responsibility on the safety program.

Mayor Wallace reported that he had met with V. Emil Hansen, Chairman of the Metropolitan Water Board of Orem, and Leonard Walker, President of Provo Bench Canal Company. Orem City water is still coming through the aqueduct, and as long as water is coming through the ditches, use for the water can be established. Also, Mayor Wallace reported that the new Skiing Corporation at Stewart's Flat has filed on water at Stewart's Flat in the North Fork area, contending that it is free water.

Winston Crawford reported that Leonard A. Higgins, State Director of Civil Defense, is going to meet with him, Mayor Wallace and City Manager Farnsworth, to discuss use of Federal matching funds for Civil Defense expenditures.

City Manager O. V. Farnsworth reported that in 1950 Dean Park had installed a water line from the inch City water line to his "Timp Bowl". A meter was installed, also. Victor Christensen sated that a sprinkling system was installed and used for two or three years.

Harley Gillman asked the City Manager to check the time spent at the Cemetery by the men driving Sanitation trucks. Also their wages should be reviewed.

Councilman Gillman asked permission to check the overtime charged to the Street Department. Also, suggested that streets worked on be designated on time cards.

The Council asked that employees be cautioned not to use City Vehicles for private use.

It was suggested that the above be included in a Special Improvement District. City Manager Farnsworth stated that Bonded Indebtedness of the City would have to be checked before more Special Improvements can be allowed.

Harley Gillman asked what the City's policy is regarding moving ditches back when streets are widened. The people on 1600 North Street West of Highway 91 want the City to remove the trees so they can move the ditch back. City Manager Farnsworth said that the old policy was that if the property owners deeded a 50 foot street to the City, then the trees would be removed. Mr. Farnsworth stated that these trees are on City property.

Earl Wengreen stated that the Shade Tree Commission should be allowed to make suggestions when trees or shrubbery is to be removed from City property.

The City Engineer was asked to check the problem.

Ordinance to levy tax on District E:

Ordinance No. 10:An Ordinance creating Special Improvement District Number E to construct cement curb and gutter with cement driveway openings and appurtenant drainage facilities; sidewalks; walkways; road surfacing; and to do all other things necessary to complete the projects in a proper and workmanlike manner according to plans, profiles, and specifications; finding the notice of the Council's intentions to create such a District has been duly published as required by law.That bids for the construction of said improvements have been received and tabulated and that Clegg & Harmon, Geneva Asphalt Co., Superior Asphalt Co., and T. Val Christiansen are the lowest responsible bidder for the construction of such improvements; authorizing and directing the Orem City Mayor to contract with said bidders for the construction of said improvements; authorizing and directing the issuance and sale of Special Improvement Bonds of said District to finance such improvements, providing for the fixing of the amount of and for the execution and form of said bonds providing for the levy of a special tax to defray the cost of such improvements and the principal and interest of said bonds.

Val Christensen, Dean Cox, Geneva Concrete Pipe Co., and Pacific Cast Iron Pipe Co., are the lowest responsible bidders for the construction of such improvements; authorizing and directing the Orem City Mayor to contract with said bidders for the construction of said improvements; authorizing and directing the issuance and sale of special improvement bonds of said District to finance such improvements, providing for the fixing of the amount of and for the execution and form of said bonds; providing for the levy of a special tax to defray the cost of such improvements and the principal and interest of said bonds.

Ordinance to levy tax on District G:

Ordinance No. 12 Ordinance creating special improvement District Number G to construct armor coat surfacing thirty (30') wide on Center Street from U.S. Highway No. 91 to 800 West Street, Orem, Utah and to do all other things necessary to complete the project in a proper and workmanlike manner according to plans, profiles, and specifications; finding the notice of the Council's intentions to create such a District has been duly published as required by law. That bids for the construction of said improvements have been received and tabulated and that Superior Asphalt Co. is the lowest responsible bidder for the construction of such improvements; authorizing and directing the Orem City Mayor to contract with said bidders for the construction of said improvements; authorizing and directing the issuance and sale of Special Improvement Bonds of said District to finance such improvements; providing. for the fixing of the amount of and for the execution and form of said bonds; providing for the levy of a special tax to defray the cost of such improvements and the principal and interest on said bonds.

Milton Johnson reported the Chamber of Commerce is working out a new "approach" sign to be installed on Highway 189 and asked if the City would participate in the cost. The Council asked to see a drawing of the sign and for a bid price before accepting.
