On motion of Ms. Lee-Sheng, seconded by Mr. Roberts, the following ordinance was offered:

SUMMARY NO. 23676 ORDINANCE NO.

An ordinance approving the Preliminary and Final Plat of the resubdivision of Lots 8, 9, and 10, Sq. 4, William David Parkway Subdivision, Jefferson Parish, Louisiana, into Lots 9-A and 9-B, Sq. 4, William David Parkway Subdivision, in accordance with the plan by Dading, Marques & Associates, LLC, dated 11-19-12, which Lot 8 is owned by Miguel Molina and Patricia Cruz Molina; Lot 9 is owned by Jennifer Henry Heath and Jude J. Heath; and Lot 10 is owned by Heather Pelofsky Rittenberg and Leon H. Rittenberg III, and approving and accepting the Final Plat of said subdivision. (Council District 5)

WHEREAS, Miguel Molina and Patricia Cruz Molina are the owners of Lot 8, Sq. 4, William David Parkway Subdivision, Jefferson Parish, Louisiana which they acquired by Act before Diane M. Gravois, Notary Public, dated 8-11-97, and registered in COB 2967, Folio 282, Parish of Jefferson; Jude J. Heath and Jennifer Henry Heath are the owners of Lot 9, Sq. 4, William David Parkway Subdivision, Jefferson Parish, Louisiana, which they acquired by Act before Michael E. Winters, dated 12-14-93, and registered in COB 2885, Folio 604, Parish of Jefferson; and Leon H. Rittenberg III, and Heather Pelofsky Rittenberg are the owners of Lot 10, Sq. 4, William David Parkway Subdivision, Jefferson Parish, Louisiana, which they acquired by Act before Leon H. Rittenberg Jr., dated 5-14-01, and registered in COB 3052 Folio 323, Parish of Jefferson; and

WHEREAS, said owners desire to resubdivide said Lots 8, 9, and 10, into two lots to be designated as Lots 9-A and 9-B, Sq. 4, William David Parkway Subdivision, in accordance with plan by Dading, Marques & Associates, LLC, dated 11-19-12; and

WHEREAS, no public improvements are required, therefore the Preliminary Plat and Final Plat may be approved and accepted in combination in accordance with Section 33-2.26(d); and

WHEREAS, the Planning Director of this Parish has caused to be duly advertised as prescribed by law, a public hearing in connection with the resubdivision of said lots; and

WHEREAS, a public hearing was held by the Planning Advisory Board, in accordance with the law: NOW THEREFORE,

THE JEFFERSON PARISH COUNCIL HEREBY ORDAINS:

SECTION I. That the Preliminary Plat of Dading, Marques & Associates, LLC, dated 11-19-12, showing the resubdivision of Lots 8, 9 and 10, Sq. 4, William David Parkway Subdivision, Jefferson Parish, Louisiana into Lots 9-A and 9-B, in said square in accordance with said plan, is hereby approved.

SECTION II. That there is a 90-day maximum time frame in which a demolition permit must be obtained and demolition completed for the house at 317 W. William David Parkway after the approval of resubdivision.

SECTION III. That the Final Plat of Dading, Marques & Associates, LLC., dated 11-19-12, showing the resubdivision of Lots 8, 9, and 10, Sq. 4, William David Parkway Subdivision, Jefferson Parish, Louisiana into Lots 9-A and 9-B in said square in accordance with said plan, is hereby approved and accepted.

SECTION IV. That in accordance with Section 33-2.31 of the Unified Development Code (UDC), Subdivision Waivers, the insufficient lot depth of 91.45 feet for Lots 9-A and 9-B, instead of the required lot depth of 100 feet in Single-Family Residential District, R-1A, are hereby waived, accepted and approved.

SECTION V. That the Parish of Jefferson has not examined or reviewed the title of any portion of land shown, or any restrictive covenants or restrictions placed on said property, and that the action of the Parish in this matter does not imply (1) that the applicant’s or owner’s title or ownership is valid, (2) that there are or are not any restrictive covenants or other restrictions on said property, or (3) that any restrictive covenants or restrictions that may be on said property are enforceable or are not enforceable.

SECTION VI. That the Chairman of the Parish Council of Jefferson Parish, or in his absence the Vice Chairman, is hereby authorized, empowered, and directed to sign all documents and acts necessary and proper in the premises to give full force and effect to this ordinance.

This ordinance having been submitted to a vote, the vote thereon was as follows:

This ordinance was declared to be adopted on the 4th day of February, 2013, and shall become effective as follows, if signed forthwith by the Parish President, ten (10) days after adoption; thereafter, upon the signature by the Parish President, or, if not signed by the Parish President, upon expiration of the time for ordinances to be considered finally adopted without the signature of the Parish President, as provided in Section 2.07 of the Charter. If vetoed by the Parish President and subsequently approved by the Council, this ordinance shall become effective on the day of such approval.
