About 1890 qntls of unsold processed KL lots of 2012 Crop along with fresh and resale lots If any stored in different godowns of OFDC Ltd will be sold in public auction at IDCOL AUDITORIUM (NEAR I.G. PARK) Bhubaneswar on 06/03/13 till completion between 9.00 A.M to 1.00 P.M & 3.00 P.M to 7.00 P.M in the following sequence as far as possible.

9. Deogarh.10. Sambalpur.
Processed KL lots of 2012 Crop would be sold as per terms and conditions communicated vide Head Office Memo No.9383 to 9387 dated 22/06/12 . Resale lots of 2011 Crop will be sold as per terms and conditions communicated earlier vide Head Office Memo No. 13009 to 13013 all dated. 24/08/11.
Seized &Quality IV Inferior lots will be sold soon after completion of sale of processed normal lots of all the Divisions as per terms & conditions enclosed hear with. [Memo No 3985 Dt..25.2.13]

THE SALE OF QUALITY IV [INFERIOR] PROCESSED KL 2012 CROP AND SEIZED LOTS WILL BE SUBJECT TO THE FOLLOWING TERMS & CONDITIONS
1. Bid / Offer will be per quintal of Processed Kenduleaves in whole rupee (exclusive of all taxes, duties, levies, fees etc.) and on ex-godown basis.
2. The intending bidder /Tenderer may inspect the stock before participating in the sale. The participation of the bidder in the sale will be deemed as complete proof that the bidder is satisfied about quality of the stock. No complaint whatsoever regarding quality, weight or other defects will be entertained in respect of any Kenduleaf lot[s] after the finalization of the sale in favour of the highest bidder /Tenderer. Participation of the bidder in the sale will also mean full and unreserved acceptance of all conditions of sale.
3. The officer conducting the sale shall have the right to reject any bid / offer including the highest bid[s] or to postpone or to cancel or to withdraw or to change the sequence of sale of any/all lot(s) without assigning any reason thereof. He may not allow a purchaser[s] to participate in the sale for his discourteous behaviour, causing obstructions in the sale process or acts in a manner detrimental to the sale/auction process. He may at his discretion reject the highest bid of any purchaser whose performance with regard to lifting of materials purchased by him in any of the sales conducted during last two years has been irregular and unsatisfactory. Ordinarily the lot(s) notified in the sale notice will not be subject to any addition or withdrawal.
4. Sale once finalized in favour of a purchaser will not be transferred wholly or partly to any other purchaser /firm.
5. The highest bidder /Tenderer whose offer is accepted, shall pay the full sale value together with VAT, Central Sales tax, levies, fees & duties etc.as applicable on fall of hammer in case of auction sale and on issue of ratification order in case of tender sale. However, the payments in respect of the lot(s) sold in the afternoon session shall be accepted till the next day during office hours. A purchaser who becomes the highest bidder for more than 2 (two) lots will be required to pay @25% of the sale value of 3(third) and subsequent lots and pay balance of the full sale value together with sales tax and other charges etc. within 7 (seven) days from the date of sale / issue of ratification order.
No unadjusted advance amount lying with OFDC Ltd. will be adjusted towards sale value of inferior / seized lot(s) . Failure to pay the sale value as above, will result in cancellation of sale as well as registration along with forfeiture of any sum already paid and registration fee and the lot(s) will be resold at the risk of the purchaser. The highest bidder will lift the lot(s) within 22 (twenty two) days from the last date of sale / issue of ratification order.
6. The payment of sale value etc. shall be made in shape of Account payee Bank Drafts drawn in favour of Odisha Forest Development Corporation Ltd. (A/C number 1963 of Indian Overseas Bank) on any Nationalized / Scheduled Bank and payable at Bhubaneswar only. If the due date of payment falls on a holiday, the next working day will be treated as the due date of payment.
7. In the event of failure of the highest bidder to lift the materials within 22 (twenty two) days as mentioned under Clause 5 above, the sale will automatically be treated as cancelled by the concerned Divisional Manager CKL Division. Extension of time for lifting of the stock up to 1(one) more week may be granted at the discretion of the Director( C) / Managing Director by
imposing penalty of `500/-(five hundred) per lot of 100 bags or below 100 bags as the case may be. If the bags are not lifted within the extended period, the sale will be treated as cancelled by the concerned Divisional Manager CKL Division and lots forfeited to Corporation as its property.
8. The purchaser shall be bound by all Forest Department Rules and Regulations in vogue in connection with the purchase and transit of the Kenduleaves.
9. VAT/ Central Sales tax, other taxes levies, fees & duties etc. as applicable will be charged extra over and above the sale price as per law and will be realized from the Purchaser. Income Tax will be deducted at source as per provisions of sec 206 C of the Income Tax Act from purchasers except those who produce the required exemption certificate from Assessing Officer of the Income Tax Department.
NB- Forest Development Tax shall not be collected on sale of kenduleaves by OFDC Ltd. to it’s registered purchaser.
10. The Purchaser or duly authorized representative participating in the auction/ tender will execute an agreement with the Corporation with the foregoing terms and conditions
11. Any letter or communication sent to purchaser by Registered post or Speed post will be deemed to have been received by him even if returned undelivered.
12. Only in exceptional circumstances and in case of genuine difficulties presented in writing, the Director ( C) / Managing Director may at his discretion relax the conditions stipulated, revive the contract or extend the lifting time after imposing penalty on case to case basis to cover the expenditure incurred or any inconvenience faced by the Corporation for any default by the purchaser.
13. Only the Courts at Bhubaneswar will have jurisdiction over any litigations that may arise out of the aforesaid sale and no litigation shall be instituted in any Court at any other place.
