NURSERY PRODUCTION
CONTRACT PERIOD:
01 JULY 2009 TO 30 JUNE 2010 WITH AN OPTION, BY THE MUNICIPALITY, TO EXTEND, ANNUALLY, FOR A FURTHER PERIOD OF TWO YEARS NOT EXCEEDING 30 JUNE 2012
- SCOPE
1.1.This contract pertains to the preparation of plant containers by filling various sizes of plastic plant bags, plant trays and pots with pre-mixed growing media and neatly packing the filled containers in the designated area at the ……………. as indicated by the……………………….. Directorate.
1.2.The transplanting of plants into various size containers as specified in the attached schedule and neatly packing the plants in the designated area as indicated by the ………………. Directorate.
1.3. The transplanting of plants from ex-open ground stock.
1.4.The quantities are estimates and may be increase or decrease as determined by the demand.
1.5.Moving of plants in containers to various locations in the nursery.
1.6.Pricking out of seedlings and the transplanting into other containers.
- SPECIFICATION
2.1.All the containers and growing media will be supplied by the Nursery and delivered to the site where the work is to be carried out.
2.2.The growing media must not be compacted in the containers.
2.3. The transplanting of ex-open ground plants not greater than 1.5 m shall be split, trimmed and treated prior to replanting in propagation beds or containers. Plant transplanted into bigger containers may need to be trimmed
2.4.Care must be taken not to cause damage to the roots and stems of plants when being transplanted. Plants that are wilted or damaged will not be considered for payment.
2.5.All the plants which have been transplanted shall be watered immediately to prevent any loss
2.6.The contractor shall collect and remove all rubble such as old containers, old growing
media etc, from the site, daily and dump on the site designated by the ………………………. Directorate.
2.7.A minimum of 4 000 containers must be planted / filled up per day
2.8.An …………………… Directorate official shall inspect all work carried out on a daily basis and keep record of quantities.
2.9. The contractor shall be required to provide labour to load trailers with plants in containers and off load them in the designated areas
3.STAFF / EQUIPMENT
3.1The Contractor shall ensure that all employees are registered with the
Workmen’s Compensation Commissioner in a manner which is acceptable to the Department of Labour and which satisfies the requirement of the compensation
3.2The contractor shall have available at all times sufficient workmen and resources to execute the work to the satisfaction of theExecutive Director :………… Directorate.
3.3The contractor shall ensure exemplary behaviour and that all his personnel are neatly dressed so as not to bring the good name of the …………..Municipality as a whole into disrepute.
3.4No contract labour shall be permitted to wear clothing displaying municipal logos.
3.5In the event of plant being required from outside the nursery transport will be provided.
4PRICE STRUCTURE & APPROVAL OF ACCOUNTS FOR PAYMENT
4.1Tendering will be done as per the attached schedule.
4.2A contractor will be appointed per function as indicated on the schedule. The function will not be sub-divided into container sizes, however more than one contractor may be appointed per function as indicated in the attached schedule.
4.3All tender prices must exclude V.A.T.
4.4Plants that are wilted or damaged, 5 days after completion of the work, will not be considered for payment
4.5Prior to payment, an official of the ……………………. Directorate
shall inspect all the work carried out and certify invoices for payment.
4.6……………………….Municipality reserves the right to accept all or part of the tender, as per the attached schedule.
4.7All tender prices shall be quoted per container, as requested in the tender form.
4.8Work shall commence within 14 days of this tender being awarded to the successful tenderer.
4.9The contract may be cancelled if at any stage it is found that the specifications described in item 2 above are not adhered to in terms of ………….Municipality policy.
4.10Work shall be carried out only on the instruction of an official order.
4.11Payment shall not be made less than 21 days from the date of invoice.
4.12All work which is not completed during the specified month, the following penalty, according to the specified formula, shall be apply:
Total No. Containers not filled / planted X cost per container X 20%
4.13Work, which does not conform to contract specification, will not receive payment. Contractors shall advise the relevant departmental representative weekly in writing on the prescribed form of the plants which have been planted, to enable the representative to inspect the areas timeously.
4.14Contractor will be required to provide a bank account number for payment on a monthly basis for the duration of the contract.
5SAFETY
5.1For the purpose of the Occupational Health and Safety Act No. 85 of 1993, the site as indicated on the plan is transferred for the duration of the contract, to the control of the contractor as if it is his property. As employer, he is in every respect responsible for compliance with the provisions of the Act and any other legislation pertaining to this activity.
6INSURANCE OF THE WORKS AND DAMAGES
6.1The proposed activity shall be entirely at the risk of the applicant and ……………………..Municipality shall be indemnified accordingly. For this purpose a suitable public liability insurance policy, issued in the joint names of the applicant and the ………………………… Municipality is required.
6.2In respect of 5.1 above, the applicant is to negotiate a public liability insurance policy in conjunction with the Chief Financial Officer.
6.3. Prior to commencement of work, a copy of the above mentioned policy must be handed to the

6.3The successful contractor may participate in the …………………. Municipality’s PCI Insurance plan and payments will be arranged.
