STATE LEVEL PUBLIC QUESTIONS
STATE CONSTITUTIONAL AMENDMENTS
There are no proposed amendments to the Constitution of the State of Indiana on the 2008 General Election ballot.
JUDICIAL RETENTION QUESTIONS
Under Indiana Code 33-24-2-2, IC 33-25-2-2, and IC 33-26-2-3, if the term of a person currently serving as a Justice of the Supreme Court of Indiana, a Judge of the Court of Appeals of Indiana, or Judge of the Indiana Tax Court will expire December 31, 2008, that person may file a request to have the question of their retention in that office placed on the November 2008 general election ballot.
Under Article 7 of the Constitution of the State of Indiana, a Justice or Judge serves a term of 10 years following the approval by the voters of their retention as a Justice or Judge.
The question of retention of a Supreme Court Justice is voted on by all of the voters of Indiana.
The question of retaining certain Court of Appeals Judges is only placed on the ballot in the specific counties within that Judge’s district. However, in 2008, the only Judge of the Court of Appeals on the ballot for retention serves in the Fourth District, which consistsof the entire State of Indiana.
Likewise, the retention of the Judge of the Indiana Tax Court is voted on by all of the voters of Indiana.
