MINUTES

l. CALL TO ORDER

The April 9, 2009 meeting of the State of Delaware’s Architectural Accessibility Board was called to order by the chairman, Ada Stokes. In addition to Ms. Stokes, the record will show that the following members were also in attendance: Nash Childs, Chang Yoon and Chad Toms. Armando Liberti participated by telephone. Chief Administrator Dan Muterspaw was also present.

. II. APPROVAL OF PREVIOUS MINUTES

A motion to approve the minutes of the Board’s previous meeting, held on March 12, 2009, was made and seconded. By a unanimous vote, the minutes were approved as recorded.

III. DISCUSSION OF AGENDA

The Chief Administrator added four (4) cases to the agenda as follows:

1. 08048 Heritage School Railings

2. 09024-RE DHCI- Canteen Renovations

3. 09032 Milford High School Controls Repl.

4. 09034 The Academy- Toilet Room

IV. CHIEF ADMINISTRATOR’S UPDATE

The Chief Administrator reported to the Board on his activities for the month. The activities were routine in nature and consisted of normal field inspections, complaint issues, and accessibility inquiries.

V. SUBMISSIONS REVIEW COMMITTEE REPORT

At their March 26, 2009 meeting, the Submissions Review Committee reviewed nine (9) cases. These cases were forwarded to the full Board for their review. The Board’s comments and actions on these cases, and for the additional four (4) cases submitted by the Chief Administrator, are attached as a part of these minutes.

VII NEW BUSINESS

There was no new business to discuss.

VIII SCHEDULE OF NEXT MEETING

The next meeting of the Architectural Accessibility Board was scheduled for Thursday, May 14, 2009 at 1:30 p.m. The location will be the Colonial Paralyzed Veterans facility.

COMMENT / The plans for the renovations to this existing
school were not approved during the AAB’s
March, 2009 meeting. The reason was because of
non-compliant maneuvering space in two of the
toilet rooms in one of the modular classrooms.
The architect was correct in pointing out that the
ADA ‘path of travel’ requirement does not pertain
to these two areas because no work is being
performed in the adjacent classroom that would
cause this provision to be applicable. The only
work proposed for this area (ceiling replacement,
blackboard replacement, etc.) does not affect the
usability of the classroom.

COMMENT / The plan was not approved due to numerous
accessibility violations. The violations pertained
to two separate ramps, the proposed elevator and
one of the toilet rooms. The appropriate
correction was made to the toilet room problem,
and the required information for the Board
regarding the elevator was submitted. As for the
ramp problems, the architect argued that proposed
repairs to both of these existing ramps meet ADA
requirements because they are neither within the
‘path of travel’ requirements or repairs ‘to the
maximum extent feasible’ were proposed. This is
a legitimate argument and was deemed to be
acceptable.

drawings were found to include the appropriate

COMMENT / The renovations to this facility were not approved
because the door to the altered toilet room swung
into the clear floor space at the lavatory and
because there was insufficient information on the
kitchen sink and work table to be able to
determine if these elements were accessible. The
architect made the required change to the door
swing and also provided the appropriate
information (cut sheets) on the kitchen
fixtures/equipment. Compliance has been
achieved.

COMMENT / Two additions are being proposed in this project
(for a performing arts area for
athletic/multipurpose space). The renovations will
be performed in the existing weight room and in
some of the existing offices in the athletic
department area. Additional upgrades will be
made to the electric service and the school’s
sprinkler system. There were some items on the
drawings that will need to be corrected for
accessibility compliance. They include, but may
not be limited to, the following:
1.  Doors in a series must be at least 48 inches apart.
2.  There is insufficient clearance on the pull side of the door to the accessible toilet stall in the gang toilet room nearest to the Principal’s Office.
3.  In this same toilet room, the door to the accessible stall cannot be located in front of the toilet.
4.  Per drawing #A-40-1, the detail doesn’t match the design.

benches, shelter areas and a playground area. The
proposed parking will include accessible spaces.
It appears that all portions of this design are
compliant.

constructed to add 5 more classrooms. The
architectural design for this addition is compliant
with the codes and standards. The accessible route
to this addition is also compliant. However, there
are existing barriers to the toilet rooms serving this
primary area function, and the barrier removal
work necessary to remedy any problems is
required to be included within the overall scope of
work. The additional work doesn’t appear to be
included nor is there any mention of
‘disproportionality’ being the reason for not
including this work.
