Mountain Shadows Home Construction Checklist

This checklist is designed to help a prospective builder make sure that all the information required for the Architectural Control Committee review is provided and should facilitate the review process. If any questions arise, please refer to the Covenants, Conditions and Restrictions or contact the ACC chairperson through the Mountain Shadows Website:

You will be notified within 7 days if what you have submitted is complete. The Architectural Control Committee has 30 days to respond in writing regarding approval and will meet to discuss all submissions.

Checklist:

1. Provide a site plan drawn to scale that clearly shows:

a)Orientation with a North arrow

b)Property Boundary Lines and dimensions in feet. It will be very helpful if the property boundaries are staked to permit rapid review or you are able to walk to and find the corner markers.

c)If other buildings or structures are currently on the lot, the location of each must be shown on the site plan along with location on the lot and distance to other structures and the building proposed by the application

d)Outline of proposed structure(s) with exterior dimensions

  1. Square footage on ground floor ______(minimum 1300)
  2. Square footage on upper floors ______(must add to 1800)

e)Location of proposed driveway or other access points

f)Building setbacks that meet these minimums

  1. 53 feet from the center of road that forms any property boundary
  2. 20 feet from the rear of the lot if not a road
  3. 10 feet from the side of the lot if not a road

g)Proposed site for propane tank, heat pump, air conditioning or similar equipment if applicable

  1. Attach a note to drawing that describes how the propane or other strorage tank will be shielded from view

h)Proposed site for septic tank and drain field

i)Position of water meter on property

2. Provide a set of plans drawn to a recognizable scale for the residence and any outbuildings such as garages and other structures.

NOTE: When selecting colors, the CCRs indicate:

2.2i: Color: Residence color schemes should be from the earth tone palette and be consistent with the surrounding, natural environment.

2.2l: All residences on a lot shall be constructed of the same materials in order to have the same appearance. All Residences shall have wood siding, log construction, or composite material siding with the appearance of wood or log. Residences may be constructed of materials other than wood siding or log construction if approved on a case by case basis by the ACC. Stone, brick or stucco accents are permissible. If the primary Residence is of log construction, the outbuildings may have a different exterior appearance if approved by the ACC.

The ACC firmly supports the CCRs. When using composite material, such as hardiboard, the ACC criteria will be the “appearance of wood or log” and the consistency with the “surrounding, local, natural environment.” (ie: the use of brown, reddish, or cedar tones).

Mountain Shadows Acknowledgement of Owner Responsibilityand Liability Associated with Construction

I hereby recognize that I have submitted a request for Architectural Control Committee(ACC) Review for proposed construction on Lot ____ of Mountain Shadows Phase _____. If those plans are approved, I accept the following conditions:

  1. I must construct the residence and other structures in accordance with the ACC approved plans, Boise County Building Permit and other governmental permits as required.
  2. Any emergent or other conditions which might alter the finished structure(s) shall be called to the attention of the ACC for in progress review and approval.
  3. The residence must be finished to an enclosed state which appears externally complete within one calendar year.
  4. All slash and construction debris must be cleared within 30 days of completion.
  5. No Building materials can be staged on the lot for extended periods
  6. Any damage to roads or other common areas shall be repaired at my expense.
  7. All construction debris shall be cleared from the site throughout the construction process.
  8. Sanitary facilities are required to be onsite during construction.
  9. All utility hook ups as well as routing and distribution within the lot are my responsibility.
  10. All water systems shall have backflow preventers installed.
  11. Propane or other tanks shall be located to be shielded from view.
  12. I understand that I am responsible for all actions and activities of my contractor, builder, or independent tradesmen.
  13. I understand the Mountain Shadows Home Owners Association can enforce these requirements and cause the work to be done or corrective measures to be taken and bill me or place liens on the property until they are reimbursed for the expenses.

PLEASE PROVIDE THE FOLLOWING INFORMATION TO YOUR CONTRACTORS AND SUBCONTRACTORS:

MOUNTAIN SHADOWSRULES OF CONDUCT FOR CONTRACTORS/SUBCONTRACTORS

The following regulations must be adhered to when you are working in the Mountain Shadows subdivision:

  • Keep all building sites clean and orderly. All building materials must be kept within property boundaries at all times and must not be left or stored on the road or in the burrow ditch adjacent to the road.
  • Do not stage material or operate equipment from the common areas (such as roads) without approval of the HOA.
  • Do not stage supplies on or operate equipment on adjacent lots without the property owner’s approval.
  • On and off loading of heavy equipment should be directly onto your property without use of the common roads to avoid damage to the road surface.
  • No connection can be made to the Mountain Shadows water system without prior notification of the HOA and Water Master.
  • You are responsible for keeping all building material trash on the building site. Building materials are NOT to be disposed of by burning.
  • Do not block roadway access with any vehicles. Remember to be considerate of residents driving into and out of the subdivision. Double parking is not allowed. Vehicles must be parked within property boundaries.
  • No fires are allowed on property at any time. If lot owner allows fires on property, a burn permit must be obtained and appropriate safety procedures followed such as fire extinguisher, water hose and other tools. No fires are to be allowed during bans issued by the Forest Service during high fire risk.
  • Contractor will provide PortaPotty for subcontractors. No human waste is to be deposited on lot.
  • Adhere strictly to speed limits within subdivision. Speed limit is 15 mph.
  • Construction should be done during reasonable hours to prevent excess noise interruption for full time residents. Reasonable hours are assumed after 7 am MT and before 8 pm MT.
  • Dogs must be controlled and on a leash, restrained or contained within a fenced structure during construction.
  • No loud music during construction.
  • Cement trucks MUST not dump excess cement anywhere in the subdivision but on the lot where residence is under approved construction.
  • Street must be kept clean – no mud, rocks, etc. SWEEP AS NEEDED.
  • Any deviation from the approved building site and plans must be approved by the Architectural Committee.
  • Provide silt fence or other retention methods to avoid washout on common areas or adjacent lots.

Penalties

Verbal and written notification will be provided to Lot Owner promptly by a Mountain Shadows Board Member on any violation of Rules of Conduct. Compliance is expected within 7 days of notification or as otherwise requested by Board Member if the need is deemed more urgent. If compliance or compensatory action is not completed within stated time frame, Board Members reserve the right to take appropriate action and Lot Owner will be billed accordingly for any and all work that is required to keep lot and residence in compliance. If costs are not paid within thirty days, a lien will be placed on property for the amount and associated legal expenses will also be billed.

Declaration of Responsibility

Lot owner has read and received a copy of Rules of Conduct and has agreed to provide a copy of Rules of Conduct to contractor and subcontractors. Lot Owner understands that he/she is responsible for subsequent noncompliance by all persons including contractor and subcontractors of Rules of Conduct during the building of the residence on below listed lot and hereby accepts responsibility for penalties as outlined.

Lot owner will note that he/she assumes any risk resulting from fire, accidents and is responsible for any subsequent damage to common subdivision areas and private lots.
