A. RECITALS

respect each other as parents our significance in the lives of our children.

  1. We have drawn up this Parenting Agreement to assist us in providing a loving, stable and nurturing environment for our children, consistent with their development levels and our social and economic circumstances.
  2. We recognise our children’s rights to:
  1. Emotional and physical safety, stability and security;
  2. Feel loved by both of us and significant family members;
  3. Know and be cared for by both of us and significant family members;
  4. Develop independent and meaningful relationships with each of us.
  1. As parents we accept responsibility for:
  1. Our children’s physical care;
  2. Our children’s emotional stability;
  3. Our children’s changing needs as they grow and mature;
  4. Protection of our children so they are not exposed to harmful parental conflict;
  5. Cooperation with each other to make decisions in our children’s best interest.

B. TERMS OF THIS PLAN

  1. The Parenting Plan is made in accordance with the provisions of Section 63C of the Family Law Act 1975 (Cth) in relation to ………………..(name of child) born …………………and………………(name of child) born……………….. (hereinafter referred to as “the children”).
  2. The parties acknowledge that they have entered into this Parenting Plan free from any threat, duress or coercion.

C. OPERATIVE PART

Parental Responsibility and Obligations

______

  1. That except as otherwise stated, the father and mother are to have equal shared parental responsibility for the major long term issues of the children.
  1. That the parents are to consult with each other about decisions to be made in the exercise of their shared parental responsibility as follows:
  1. They shall inform the other parent about the decision to be made;
  2. They shall consult with each other on terms that they agree;
  3. They shall make a genuine effort to come to a joint decision.
  1. That the mother and father shall:
  1. Keep the other parent informed at all times of their residential address and landline contact telephone number and will advise of any change within ………………….(insert time frame);
  1. Keep the other parent informed of the names and addresses of any treating medical or other health practitioners who treat the children and authorise those practitioners to provide to the other parent with information that they are lawfully able to provide about the child; and
  1. Inform the other parent as soon as reasonably practicable of any medical condition, significant health issue or illness suffered by the child.
  1. Inform the other parent at least within 48 hours-notice if the parents are unable to facilitate the arrangements outlined in this Plan and if this occurs the parties will agree on make-up time.
  1. Refrain from discussing any disagreements or sensitive issues in the presence of the children and will not involve the children in any dispute.
  1. Communicate day to day matters about the children by telephone and/or email and the parties agree to return messages and missed telephone calls as soon as practicable and at any reasonable time.
  1. That during the time the children are with either parent, that parent shall:
  1. Respect the privacy of the other parent and not question the child about the personal life of the other parent;
  1. Speak of the other respectfully;
  1. Not denigrate or insult the other parent and/or their respective partners in the presence or hearing of the child and use their best endeavours to ensure that others do not denigrate or insult the other parent in the hearing or presence of the child.
  2. Refrain from consuming alcohol beyond the legal driving limit at any time that the child are in their care and for eight (8) hours before any period that the child are to be in their care.
  1. Refrain from using any illicit substances and/or non-prescribed drugs and for eight (8) hours before any period that the child are

Living Arrangements

  1. That the children live with ………………………(Nominate Mother/Father as case may be)

Time with the other Parent

  1. That the children spend time with and/or communicate with ………………………(Nominate Mother/Father as case may be)at all times as can be agreed to between the parties and failing agreement, as follows:

Time during school terms

Example of weekend time:-

(i)Each alternate weekend from after school Friday to 5.00 pm Sunday;

OR:

(ii)Each alternate weekend from after school Friday to the commencement of school Monday;

Example of Mid week time:

(iii)Each…………….(weekday) from after school to 7.00pm OR to the commencement of school on …………………..(weekday)

Holiday time

(a)During the school holiday periods, the time that the children shall spend with the ………………………(Nominate Mother/Father as case may be)pursuant to Order 6 insert para numbers herein shall be suspended and such time shall be as follows:-

(i)One-half of the Christmas Queensland school gazetted holiday period being the first half inYear, the second half inYear, and each alternate year thereafter. For the purposes of facilitating the ………………………(Nominate Mother/Father as case may be) time with the children during such holiday periods in years when ………………………(Nominate Mother/Father as case may be)has the first half, the ………………………(Nominate Mother/Father as case may be)time is to commence from after school on the last day of the school term and conclude at 5.00pm on the third Saturday of the holiday periods, and in years when the ………………………(Nominate Mother/Father as case may be) has the second half, the ………………………(Nominate Mother/Father as case may be) time is to commence from 5.00pm on the third Saturday of the school holiday periods and conclude at the commencement of school on the first day of the next school term.

(ii)One-half of the Easter Queensland school gazetted holiday period being the second half in Year, the first half in Year and each alternate year thereafter. For the purposes of facilitating the ………………………(Nominate Mother/Father as case may be) time with the children during such holiday periods in years when the ………………………(Nominate Mother/Father as case may be) has the first half, the ………………………(Nominate Mother/Father as case may be) time is to commence from after school on the last day of the school term and conclude at 5.00pm on the day that the middle of the holiday period falls on, and in years when the ………………………(Nominate Mother/Father as case may be) has the second half, the ………………………(Nominate Mother/Father as case may be)time is to commence from 5.00pm on the day that the middle of the holiday period falls and conclude at the commencement of school on the first day of the next school term.

(iii)One-half of the June/July and September/October Queensland school gazetted holiday periods being the first half in Year, the second half in Year and alternating each year thereafter. For the purposes of facilitating the ………………………(Nominate Mother/Father as case may be) time with the child during such holiday periods in years when the ………………………(Nominate Mother/Father as case may be)has the first half, the father’s time is to commence from after school on the last day of the school term until 5.00pm on the second Saturday of the holiday periods, and in years when the ………………………(Nominate Mother/Father as case may be)has the second half, the ………………………(Nominate Mother/Father as case may be) time is to commence from 5.00pm on the second Saturday of the school holiday periods and conclude at the commencement of school on the first day of the next school term.

Special occasions:-

  1. That irrespective of the time outlined in paragraphs 6 above, the children shall spend time with the Mother and Father on special occasions as follows:
  1. The children will always spend Father’s Day weekendwith the Father commencing from after school on the Friday before Father’s Day concluding up to and including 5pm on Father’s Day;
  1. The children will always spendMother’s Day weekend with the Mother commencing from after school on the Friday before Mother’s Day concluding up to and including 5pm on Mother’s Day;
  1. On the child’s birthday and parent’s birthday the parent who does not have the child in their care is at liberty to spend time with the child at the following times on these occasions:
  1. If a school day, from 4.00p.m. until 6.00pm; and
  2. If a non-school day, from 1.00pm until 6.00pm.

Changeover

  1. That except as otherwise provided for in these Orders, changeovers shall take place at………………………………………………….. (nominate location)

Communication

  1. That the parents and child be at liberty to communicate with each other by telephone at all reasonable timesAND/OR each …………….nights between the hours of …………and……………… and in relation to such communication each parent shall:
  1. Ensure that the child is available to receive the telephone;
  2. Arrange for the child to telephone the other parent on the following night, if for any unforeseen circumstances, the child misses the telephone call from that parent;
  1. Ensure that the child have privacy during the conversation.
  1. Speak to each other respectfully and reasonable at all times.
  1. This Plan authorises any treating medical practitioner to release the child’s medical information to the other parent
  1. That this Plan authorises the daycare/schools attended by the child to give each parent information about the child’s educational progress and other school related activities and supply them with copies of school reports, photographs, certificates and awards obtained by the child (at the parent’s cost).

Resolution of disputes

  1. That in the event the parties are unable to, the process to be used for resolving disputes about the terms or operation of these Orders shall be as follows:
  1. The parents shall consult with a Family Dispute Resolution practitioner OR Family Relationship Centre to assist with resolving any dispute or reaching agreement about changes to be made;
  1. They shall pay the costs of the Family Dispute Resolution practitioner equally;
  1. In the event that they are unable for any reason to have an appointment with the Family Dispute Resolution Practitioner, and cannot agree on an alternate Family Dispute Resolution Practitioner, the mother shall nominate three practitioners and advise in writing details of their fees, experience and availability;
  1. The father shall choose one of the listed practitioners within seven (7) days of receipt of the list; and
  1. If the father fails to choose, then the mother may choose.
  1. That unless there are some emergent circumstances, before an application is made to a Court for a variation of these Orders to take into account the changing needs of the child, each party is to take the steps referred to in the preceding Order.

Financial provision

  1. The parent acknowledge the present arrangements for child support through the Child Support Agency are to continue.
  1. In addition to the arrangements through the Child Support Agency, the parties agree that they will equally share the costs of all school fees for both children and that they will further equally share all out of pocket medical and dental expenses for both children.
