Submission of a Notice of Intent (NOI) in respect to Miscellaneous Licences 47/47, 47/67 and 47/103 held by Cape Lambert Iron Associates, Mitsui Iron Ore Development Pty Ltd, North Mining Ltd, Pannawonica Iron Associates and Robe River Mining Co Pty Ltd and situated at various localities in the West Pilbara Mineral Field.
RECOMMENDATION:
That the conditions of grant for Miscellaneous Licences 47/47, 47/67 and 47/103 be varied as detailed in the attached schedules.
COMMENT:
Hamersley Iron Pty Ltd has lodged a Notice of Intent dated 19 January 2006 outlining a proposal for a fibre optic cable on Miscellaneous Licences 47/47, 47/67 and 47/103.
The proposal has been assessed by the Director, Environment Division and approval given to proceed subject to the variation of existing conditions for Miscellaneous Licences 47/47, 47/67 and 47/103 as detailed in the attached schedules.
Bonds in the sums of $20,000, $10,000 and $259,235 are currently filed against Miscellaneous Licences 47/47, 47/67 and 47/103 and the Director, Environment Division considers that these amounts are adequately provides for the work proposed.

VARIATION ON CONDITIONS

BY APPROVAL ON 11/05/2006,CONDITIONS 21 AND 22 WERE DELETED AND SUBSTITUTED AND FURTHER CONDITIONS 23 TO 28 WERE IMPOSED IN RESPECT TO MISCELLANEOUS LICENCE 47/47

21.The construction and operation of the project and measures to protect the environment being carried out generally in accordance with the documents titled:-

  • "NOI 4620 Pilbara Rail Additional Proposal Rail Realignment" dated 15 March 2004 and retained on Department of Industry and Resources File No. E2779/200301; and
  • “Notice of Intent to Establish a Fibre Optic Cable Underground between 7 Mile and Kanjenjie” dated 19 January 2006 (NOI 5224) and retained on Department of Industry and Resources File No. E2779/200301.

Where a difference exists between the above document(s) and the following conditions, then the following conditions shall prevail.

22.The licensee arranging lodgement of an Unconditional Performance Bond executed by a Bank or other approved financial institution in favour of the Minister responsible for the Mining Act 1978 for due compliance with the environmental conditions of the licence in the sum of:

  • $328,500

23.The development and operation of the project being carried out in such a manner so as to create the minimum practicable disturbance to the existing vegetation and natural landform.

24.All topsoil being removed ahead of all mining operations from sites such as pit areas, waste disposal areas, ore stockpile areas, pipeline, haul roads and new access roads and being stockpiled for later respreading or immediately respread as rehabilitation progresses.

25.At the completion of operations, all buildings and structures being removed from site or demolished and buried to the satisfaction of the Environmental Officer, Department of Industry and Resources.

26.All rubbish and scrap is to be progressively disposed of in a suitable manner.

27.At the completion of operations, or progressively where possible, all access roads and other disturbed areas being covered with topsoil, deep ripped and revegetated with local native grasses, shrubs and trees to the satisfaction of the Environmental Officer, Department of Industry and Resources.

28.Any alteration or expansion of operations within the lease boundaries beyond that outlined in the above document(s) not commencing until a plan of operations and a programme to safeguard the environment are submitted to the Environmental Officer, Department of Industry and Resources for his assessment and until his written approval to proceed has been obtained.
