Agenda Item No. 3- Review of ATR w.r.t Fresh Consent to Establish cases w.e.f. 29.09.2009 considered in the CMC meeting dated 13.11.2009 and reviewed by Scrutinizing Committee meeting dated 31.03.2010/01.04.2010 : during the Scrutinizing meeting, ATR w.r.t. 36 number of cases in which consent has been granted was apprised. The agenda for the CMC(Orange) consist the cases other than those in which consent has been granted.

Decisions taken with respect to this agenda are tabulated and annexed as Annexure – 3. In 08 number of cases, the Scrutinizing Committee decided to expedite the inspection. These cases will be considered in next CMC.

Agenda Item No. 4- Review of ATR w.r.t. Fresh Consent to Operate / Renewal cases w.e.f. 29.09.2009 considered in the CMC meeting dated 21.12.2009 / 22.12.2009 and reviewed by Scrutinizing Committee meeting dated 31.03.2010/01.04.2010 : during the Scrutinizing meeting, ATR w.r.t. 37 number of cases in which consent has been granted was apprised. The agenda for the CMC(Orange) consist the cases other than those in which consent has been granted.

The unit came for personal hearing today. It claims that it had submitted an application to the MOEF for withdrawal of the Environmental Clearance application on the ground that DMRC is the parent company building this integrated station-cum-commercial complex. Their proposal for withdrawal has been accepted by the MOEF without assigning any reason. In the personal hearing today, the unit repeatedly emphasized that the DMRC is above all environmental laws and it has such a mandate from the Govt. of India. It does not stand to reason that DMRC, which is the promoter of the metro rail and moves trains for the welfare of the people, can exercise power under EPA to exempt itself from Environmental Clearance for a commercial project being undertaken within its premises, attracting the basic provisions of the EIA notification. The Committee feels that this is not an appropriate way of exempting the unit which is likely to create air, water and noise emissions substantially on a built-up area of nearly 29000 sqm. Since the State EIA Committee has been notified by the MOEF, this matter be placed as a first item on the agenda in the first meeting of State EIA Committee. The SIT inspection report must be placed before the State EIA Committee and the Committee may be requested to visit the site since the unit claims that no construction has been done on the commercial complex, whereas SIT report says that the entire 29000 sqm which includes the commercial complex ,has been constructed.
The unit has filed Consent to Establish application which will be considered only after the matter of Environmental Clearance, will be decided by the State EIA Committee. Call on 17.09.2008.
