After discussion and review, Ms. Christine Capella-Peters made a motion to approve the request with a negative SEQR declaration, and with the condition that the applicant works with staff to achieve greater architectural detailing on the University Avenue facade. Ms. Rebecca Livengood seconded the motion. The motion passed unanimously.

Ms. Heather Lamendola, Zoning Administrator for the City of Syracuse, reviewed the proposal with the Commission.

Mr. Steve Kulick made a motion to approve the request with a negative SEQR declaration. The motion failed as there was no second.

Following a period of discussion, Ms. Rebecca Livengood made a motion to approve the request with a negative SEQR declaration. Ms. Christine Cappella-Peters seconded the motion with a condition that parking privileges be limited to no more than three parking spaces. The maker of the motion, Ms. Rebecca Livengood, accepted the condition. The motion passed with a vote of 3-1, with Ms. Linda Henley voting against.

A period of discussion followed the vote regarding the enforceability of the condition and necessary legal advice as no attorney from the City was present, after which Ms. Christine Capella-Peters agreed and made a motion to rescind the decision. Ms. Rebecca Livengood seconded the motion. The motion passed unanimously.

The Commission then agreed to defer acting on the request until staff could consult with Corporation Counsel, as no counsel was present at this meeting.
