In connection with the increased number of detained ships, flying the Bulgarian flag, resulting from conducted Port State Control inspections and in pursuance of the programme for enhancement of the safety of the Bulgarian ships aiming at removing Republic of Bulgaria from the “black list” of the Paris MoU on PSC and on the grounds of Art. 362 of the Merchant Shipping Code:

I HEREBY ORDER:

I. Conducting inspections in Bulgarian ports:

  1. All ships, flying the Bulgarian flag and operating in international waters, on calling Bulgarian ports shall undergo a flag State control inspection.
  2. The inspections shall be conducted by the inspectors from Divisions “Port State Control” and “Ship’s Survey, Certification and Registration” of Executive Agency “Maritime Administration” (EAMA).
  3. While conducting an inspection at first place shall be checked the ship’s certificates, which must be available on board, their validity, the correctness of the filled in data, the rectification of the established deficiencies during a previous inspection and secondly shall be checked the ship herself.
  4. The purpose of the inspection shall be to verify whether the actual ship’s condition conforms with the data, contained in the ship’s conventional certificates and a checklist, which is normally used for conducting of a ship’s surveyfor renewal of the validity of respective certificate, shall be used for the purpose of this inspection.
  5. The inspection results shall be reflected in a protocol, which further shall contain the established deficiencies and the respective fixed time for their rectification and the assumed cause for these deficiencies.
  6. Whenever upon such inspection detainable deficiencies under the PSC regime are established, the respective certificate shall be withdrawn and the ship shall be allowed to proceed only after rectification of the established deficiencies.
  7. The inspection protocol shall be drafted in two copies and shall be submitted to the ship master for signature. One copy shall be kept on board a ship and the other – in the Directorate “Maritime Administration”, which has conducted the inspection. Further copies shall be sent to Inspection Directorate of EAMA and the shipowner.

II. Conducting inspections in foreign ports.

A. Whenever conducting a ship survey for endorsement of conventional certificates of a ship, which is not yet under the harmonized system:

  1. The inspectors from Division “Ship’s Survey, Certification and Registration”, which conduct a survey for endorsement of a certain certificate/certificates, shall conduct the inspections under items 3 and 4 of Section I above as well.
  2. The results of the inspection shall be reflected in a protocolwhich further shall contain the established deficiencies and the respective fixed time for their rectification and the assumed cause for these deficiencies.
  3. Whenever upon such inspection detainable deficiencies under the PSC regime are established, adetention of the ship until the established deficiencies are rectified shall be entered under item 2in the protocol thereof.
  4. Whenever the inspectors survey a ship for issuance/endorsement of conventional certificates, another ship, flying the Bulgarian flag, calls the same port at the same time, the latter shall be inspected under the flag State control regime.
  5. The inspection protocol shall be shall be drafted in two copies and shall be submitted to the ship master for signature. One copy shall be kept on board a ship and the other – in the Directorate “Maritime Administration”, which has conducted the inspection. Further copies shall be sent to Inspection Directorate of IAMA and the shipowner.

B. Whenever surveying in a port a ship, which is already under the harmonized system, another ship, flying the Bulgarian flag, enters the same port, the latter shall be inspected as laid down in Section II, “A”, except for item 4.

C. Conducting on purpose inspection of ships, flying the Bulgarian flag under the flag State control regime.

  1. A senior inspector from a Division “Ship’s Survey, Certification and Registration” of EAMA in coordination with the shipowners, shall submit a proposal to the executive director of EAMA for conducting an inspection of a ship, calling a foreign port.
  2. Such inspections shall be conducted by the experts from Divisions “Port State Control” and “Ship’s Survey, Certification and Registration” of Executive Agency “Maritime Administration” (EAMA).
  3. While conducting an inspection at first place shall be checked the ship’s certificates, which must be available on board, their validity, the correctness of the filled in data, the rectification of the established deficiencies during a previous inspection and secondly shall be checked the ship herself.
  4.   6. Whenever upon such inspection detainable deficiencies under the PSC regime are established, a detention of the ship until the established deficiencies are rectified shall be entered under item 5in the protocol thereof.
  7. The inspection protocol shall be drafted in two copies and shall be submitted to the ship master for signature. One copy shall be kept on board a ship and the other – in the Directorate “Maritime Administration”, which has conducted the inspection. Further copies shall be sent to Inspection Directorate of EAMA and the shipowner.

ІІІ. Statistics and control

Directorates “Maritime Administration” – Varna and Bourgas shall draft and sent to Inspection Directorate on monthly basis summary information on the conducted inspections, including systematisation of the established deficiencies.

The director of the Inspection Directorate shall exercise control over the implementation of this Order.
