MEMORANDUM OF UNDERSTANDING

AGREEMENT BETWEEN THE POQUOSON MUSEUM

and the

COLONIAL BEEKEEPERS ASSOCIATION

TO PLACE A LEARNING BEE YARD ON MUSEUM PROPERTY

This Memorandum of Understanding outlines an arrangement between the Poquoson Museum and the Colonial Beekeepers Association (hereafter referred to as the “CBA”). The CBA is a local organization recognized by the Virginia State Beekeeper’s Association (VSBA). The purpose of this agreement is to provide the general guidelines for both parties for the purpose of establishing and maintaining a Learning Bee Yard on the Poquoson Museum property by the CBA membership. The proposal that was submitted by the CBA to the Museum has been approved by the Museum’s Board of Directors.

The following list of assurances has been made by the CBA to the Poquoson Museum:

1. The CBA will comply with all plans and procedures for establishment and operation of the CBA Bee Yard as contained in the proposal approved to the Museum Board of Directors

2. All materials, labor and maintenance costs associated with the upkeep and construction of the CBA Learning Bee Yard will be the responsibility of the CBA.

3. All CBA membership who attend and participate in any CBA learning or maintenance activities will have a signed Museum Liability Waiver on file with the Museum.

4. In the event that either party dissolves this agreement, the CBA will remove any and all structures, fencing and hive material from the property of the Poquoson Museum within 30 days.

5. The CBA will be responsible for the annual preventive maintenance costs for all aspects of the CBA Learning Bee Yard.

The following list of assurances has been made to the CBA by the Poquoson Museum:

1. The Museum will provide the CBA membership with daytime, seven days a week access to the Learning Bee Yard.

2. The Museum will provide the CBA membership access to and use of water and power sources if/when needed.

3. The Museum will grant access to bathroom facilities to CBA members when the museum is open.

4. The Museum may make additional space for other related projects by the CBA beyond the current proposal if passed by the Museum Board.

GENERAL INFORMATION:

The Poquoson Museum is a private, tax-exempt nonprofit organization and is not affiliated with the City of Poquoson. The City of Poquoson does provide funding to the Poquoson Museum. The funding may be approved each year by the Poquoson City Council.

If either party determines that this agreements would no longer benefit their organization it may be dissolved by thirty (30) days written notification at any time. This agreement is not a lease and is not bound by any time limit.
