Mayor Wheeler reopened the Public Hearing to receive public input on the subject of placing merchandise on the sidewalks in the Historic Cazenovia Business District. There were no comments from the Village Board or the public.

Upon a motion by Mayor Wheeler, seconded by Trustee Mann, the Board voted to close the Public Hearing at 7:04 pm by a vote of 5-0.

Upon a motion by Trustee Mann, seconded by Trustee Porter the Board approved the minutes from the September 6, 2016Public Hearing to receive public input on the subject of placing merchandise on the sidewalks in the HCBD, the Public Hearing to consider a proposed local law entitled, “A local law to amend Section 180 of the Village Code” and the September 6, 2016 Village Board Meeting by a vote of 5-0.

Mayor Wheeler gave an update on Creekside Park.

Update on Creekside Park

Cazenovia, NY – In the spring of 2015, a committee of local leaders and interested community members began meeting to discuss the possibility of developing a park along Chittenango Creek by Riverside Drive. Extensive community input was gathered with the help of students from the SUNY ESF Landscape Architecture department. The final design of the park includes ideas gathered through this process.

With the plan in place, funding was obtained through Project CAFÉ’s raffle of a vintage car donated by Common Grounds (the raffle winner generously donated the car back which was subsequently auctioned for additional project funding). This helped to leverage a significant grant from the Central New York Community Foundation, submitted with assistance from the Cazenovia Area Community Development Association (CACDA).

The project organizers are pleased to report that while the project site still looks the same, much has been accomplished. A professional assessment of the site identified drainage and site work that needed to be planned for and addressed. Grading of the site will take place this fall along with improvements to both the lower parking lot near the proposed park and the upper lot near the library.

The final design for the park is nearly complete and additional input is being gathered from local organizations (for example the library and the Art Park) on the details of the play features. Site work will continue through this fall and installation of the playground is planned for late spring of 2017. When work is complete, the site will have been transformed to include not only the addition of the park but enhanced parking, a more environmentally sensitive area near the creek and improved options for pedestrian and vehicle traffic.

Bob Lucas asked about the changes to Riverside Drive’s route and the traffic through the parking lot. Mayor Wheeler stated the road would go through the parking lot and then exit to the west of the Red Apple. Village Engineer, John Dunkle will draw a map for our request to modify the easement United Refining gave us. Mayor Wheeler assured Mr. Lucas we will check with him before we do the buffering.

There was a short discussion regarding the kayak/canoe storage and removing them from the park for the season. It was determined the storage spaces would be available for leasing starting in January as the parks are.

Lake Association- met on September 12th

  • CLA discussing fundraising plans for renovate treatment next year.
  • CLA also looking at long term sustainability of the current funding models for that treatment

Lake Watershed Council- met on September 27th

  • Planning the next lake summit
  • Working on Nov 19 or Dec 3
  • Invites extended to outside speakers- the final date will depend on their availability
  • A lot of concern about the weeds this year
  • The weather was perfect for growing a lot of them
  • The harvester pulled 2500 tons out of the lake- 12X last year
  • Plans are proceeding for a renovate treatment next year
  • A sustainable long term strategy is still needed

Police:

  • Shift schedule will be adjusted in November to address past concerns and optimize coverage of shifts.

Insurance:

  • Discussed cost saving options with another broker
  • Requested our broker show us some similar options- he presented us with a new plan and options that could save the village and its employees a significant amount of money- requested detailed proposal before we discuss with the employees.

Trustee Amy Mann gave her monthly report:

TREES

Since last meeting we have planted 20 trees. Six were planted within the village and 14 were planted this past Saturday in Lakeside Park as part of our annual community planting day. Huge thanks to the volunteer Tree Commission, we had a great turnout. Special thanks also go to Mark Stinson, who had all the sites prepped and ready to go for us, and to Jim Maloney, who designed our planting plan for Lakeside. We will be wrapping up our 2016 plantings in the next week or so with three more in the village, and then we will turn our planning to our 2017 list. Including our Arbor Day planting, we are going to wrap up with 24 plantings this year.

In other business we will also be undertaking a fertilization project this fall. We have not done this in my time on the board and with the number of young trees we have installed in that time, we feel this is an important effort that will protect our investment of time and money. Street trees live a much more stressful life than trees planted in open spaces. We want to give the ones we plant every extra chance of standing up to our conditions. This work has been booked and will start in the next month or so.

Finally, we will be beginning the re-certification process for Tree City USA this fall. This will be our 6th year in the program.

KAYAK LAUNCH PROJECT

Ted Bartlett and I had a conference call with Saratoga Associates on September 9 to review the concept drawings and see if there were any adjustments prior to their beginning work on the construction documents. Everything is in order, they hope to get a preliminary plan to SHPO asap to satisfy the pre-approval condition that was placed on all Master Plan projects.

In related business, Ted suggested that we make a plan for the park electric service at the same time, so that conduit can be laid at the same time that we build the launch. I met with him and Jocelyn Gavitt last week and we came up with a plan that I will be reviewing with Bill Carr and working into the Saratoga plan.

Upon a motion by Trustee Mann, seconded by Mayor Wheeler, the Board declared the F550 plow truck to be surplus and to be sold on Auctions Internationalby a vote of 5-0.

Trustee Mann stated Ted Bartlett had gone up on a ladder to look at the condition of the sign on Albany St. in front of the Lincklaen House and Mr. Bartlett stated it is in pretty rough shape. Mr. Bartlett will put together a report on the costs of the repair. Mayor Wheeler reported he had met with Carlos Gavilondo of the CPF and Dan Kuper of the Lincklaen House and it was decided repairing the sign would be a collaborate effort. Although the Lincklaen House owns the sign itself, it is located in a public right of way and its historic value makes it an item of community interest.

Trustee Dave Porter gave his monthly report:

Sewer/Water:

  • Water pumped last month was 8.0 Mgal > 267 kgal/day – historic ave is 9.1 Mgal for month of September. Water usage was about 8% less than average of previous five years.
  • Two test wells installed at water treatment plant site. Water encountered at 40 ft and 50 ft. Report to follow.
  • Carpenters Pond storm drainage evaluation. Meeting 7 AM this Friday with John Dunkle to review. CPF has an interest in a project that could improve the drainage connected to Carpenters Pond and the willow patch.

Fire Dept:

  • New Fire Dept. member applications: none this month
  • Fire contracts sent to municipalities
  • Met with Chief Arnold to discuss future long-term equipment purchases. The Fire Department is currently evaluating options for purchasing firefighting equipment that might combine two vehicles into a single hybrid vehicle.

Lake Watershed Council:

  • Last meeting Oct 27, 2016. See Fritz K. report.

Misc:

  • Solarize NY project: Received notice from Chris Carrick of CNYRP&DB that the Solarize NY project has been put out to bid. This is a collective bidding process and we hope to see installation cost savings as a result of this bid process. The entire RFP package may be accessed online on the CNY RPDB website: Notification of the RFP was sent directly to ~50 companies that responded to the Request for Information; it was also posted on the New York State Contract Reporter and Legal Notice will be published in The Caz Republican this week. RFP responses are due by December 5, 2016 at 5:00 pm EST.
  • National Grid has recently announced a program for replacing existing street light fixtures with LED fixtures (letter dated May 24 forwarded to board members). Amanda Mazzoni from the CNYRPDB has offered to prepare a cost benefit analysis for the Village under this program. Bill Carr will complete the necessary background info for CNYRPDB.
  • John Lincklaen Statue Project: Attended July 27th Mtng. Visioning process has resulted in a concept that will be developed with a sculptor/caster in Penn Yan, NY. Sketches of concept to presented in the near future.

The Village Board and Village Attorney Jim Stokes reviewed Part 2 of the EAF pertaining to the amendment to the Village Code regarding an update to the HPC Law and the clarification on the status of flag lots in the Village. This also included comments by Madison County Planning Department which were received today.

Upon a motion by Mayor Wheeler and seconded by Trustee Mann, the Board approved the following resolution by a vote of 5-0:

RESOLUTION NO. 14

OF THE BOARD OF TRUSTEES

OF THE VILLAGE OF CAZENOVIA

A RESOLUTION MAKING A DETERMINATION OF

ENVIRONMENTAL NON-SIGNIFICANCE UNDER THE NEW YORK STATE ENVIRONMENTAL QUALITY REVIEW ACT AND ENACTING

LOCAL LAW 2016-6, AS AMENDED, TO AMEND THE ZONING CODE OF THE VILLAGE OF CAZENOVIA

WHEREAS, this Board of Trustees hashad under consideration proposed Local Law 2016-6 to enact revisions to the Village Zoning Code to comply with requests by the New York State Office of Parks Recreation and Historic Preservation to achieve certified local government status and correct an error placing a lot dimensional restriction regarding flag lots in a section of the code governing use restrictions; and

WHEREAS, pursuant to a referral duly made pursuant to the provisions of Section 239-m of the General Municipal Law, the Madison County Planning Agency has reviewed proposed Local Law 2016-6, and has recommended that the question of the adoption of this local law be returned to this Board of Trustees for local determination, and

WHEREAS, upon notice duly published and posted, a public hearing on the adoption of proposed Local Law 2016-6 was duly held by this Village Board; and

WHEREAS, the public hearing has been, or hereby is closed, and

WHEREAS, in response to the comments received from the Madison County Planning Agency, the proposed local law has been slightly revised to address comments made by the Madison County Planning Agency, which revisions this Board hereby finds to be non-substantial changes to the local law; and

WHEREAS, this Board has reviewed the full environmental assessment form and has considered the likelihood of any potential adverse environmental impacts that might result from the adoption of Local Law 2016-6.

NOW, THEREFORE, BE IT HEREBY RESOLVED AS FOLLOWS:

  1. That the enactment of Local Law 2016-6, as amended, is a Type 1 action for purposes of the New York State Environmental Quality Review Act. There are no involved federal agencies, and there are no other involved agencies. The enactment of Local Law 2016-6 does not affect any lands located within New York State agricultural districts and does not involve the exercise of eminent domain or other public acquisition of land or the advance of public funds for any construction.
  1. That the enactment of Local Law 2016-6, as amended, will not have any significant adverse effects upon the environment. This resolution shall constitute a negative declaration pursuant to the New York State Environmental Quality Review Act in accordance with SEQRA’S implementing regulations. The reasons supporting this determination are as follows:

the action consists solely of a legislative enactment designed and intended to make technical changes to the language of certain sections of the zoning code so as to comply with requests by the New York State Office of Parks Recreation and Historic Preservation to achieve certified local government status, and to also correct an error placing a lot dimensional restriction regarding flag lots in a section of the code governing use restrictions, thereby improving the overall clarity and effectiveness of the code. The Board finds that the achievement of certified local government status will have a potentially beneficial effect for the Village in regard to future planning and development activities, and that the improvement in clarity in the language of the code will have a beneficial effect on the future administrationof the code. There will be no physical changes to the land or environment as a result of this action.
