PURPOSE

CII may from time to time in its sole discretion, engage the sub-contractor to perform certain construction and related services.

THIS AGREEMENT SHALL SERVE AS A MASTER AGREEMENT AND GOVERN THE PARTIES’ PERFORMANCE RELATED TO ALL CONSTRUCTION PROJECTS HEREAFTER ENGAGED BETWEEN THE PARTIES’ WITHOUT THE NECESSITY OF REAFFIRMATION OF THIS AGREEMENT IN THE FUTURE OR THE DOCUMENTATION RELATED TO FUTURE SPECIFIC PROJECTS.

As a hired sub-contractor for CII you agree to provide us with your current Certificate of Liability and Workers Compensation Insurance. We require an updated insurance form at the beginning of every month. If we are not provided with an updated certificate; we will deduct, per the Builders Mutual Insurance Audit28 % from any amounts due for non-insurance penalties as well as an additional 3 % for administrative fees until we are provided with adequate documentation. All subcontractor invoices are payable two weeks from the invoice turn in date, unless otherwise approved by management. The sub-contractor hereby guarantees and warrants that any and all laborthat you and/or your crews perform shall be of good quality. The sub-contractor further guarantees that for a period of two (2) years after the acceptance of the work, the work shall continue to be free from, but not limited to defects such as, leaks, fallen roofing material, quality, etc. and agrees to repair and correct, at his expense, any defect in workmanship.

Subcontractor shall perform appropriate clean-up services to keep the work area and the premises and surrounding area free from the accumulation of waste and trash materials caused by Work Site operations, and shall leave the premises in a reasonably clean, condition. If Subcontractor fails to adequately comply with said clean-up obligations, CII may perform the required clean-up by whatever method we may deem expedient, and may charge the Subcontractor for the reasonable costs of such clean-up. However, Subcontractor is not required to perform clean-up of, nor shall Subcontractor be held responsible for, unclean conditions caused by other persons or entities performing on the Work Site.

By execution of this Agreement, the Subcontractor agrees to strictly observe all state and U.S. Occupational Safety and Health Administration (OSHA) safety requirements. However, to the extent that any safety rules or guidelines of the Contractor exceed OSHA, state, or local safety regulations and requirements, the Contractor’s requirements shall be complied with by Subcontractor. CII’s safety requirements are in addition to and not in preemption of any federal, state or local statutes or regulations. Subcontractor shall retain sole responsibility, to the fullest extent permitted by law, for the safety of its employees in performance of Subcontractor’s Work and for performing such Work in accordance with all laws, rules and regulations, including, but not limited to any CII’s established safety requirements. By establishment of CII’s safety requirements and the mandatory application of the OSHA safety requirements under the terms of this Subcontract Agreement, Contractor does not create any joint responsibility with Subcontractor for the safety of Subcontractor’s employees.

  • Wear hard hats where there is a potential for objects falling from above, bumps to the head from fixedobjects or of accidental head contact with electrical hazards.
  • Harness must be worn whenever you are working 6 feet or more above a lower level.
  • When portable ladders are used for access to an upper landing surface, the side rails must extend at least 3 feet (.9 m) above the upper landing surface.
  • Use ladders only on stable and level surfaces unless secured to prevent accidental movement.
  • Face the ladder when moving up or down.
  • Use at least one hand to grasp the ladder when climbing.
  • Ladders must not be tied or fastened together to create longer sections unless they are specifically designed for such use.
  • Two or more separate ladders used to reach an elevated work area must be offset with a platform or landing between the ladders, except when portable ladders are used to gain access to fixed ladders.
  • Appropriate footwear is required.
  • Shirts must be worn at all times.
  • Professionalism must be maintained.
