CALL TO ORDER:

John Wieczorek called the meeting to order at 6:00 p.m. at the Mahoning Township Building, 2685 Mahoning Drive East, Lehighton, PA 18235

PUBLIC COMMENT:

Brian Mertz, 2539 Mahoning Drive West, Lehighton, PA expressed his concerns regarding a person living in a mobile home which neighbors his property. Has he obtained proper permitting to be living in a mobile home? LeRoy Leibenguth was directed to make contact with individual and contact Chris Storm for disturbance of ground. John Wieczorek will contact Scott Bieber and Carl Faust.

APPROVAL OF MINUTES:

MOTION

Linda Benner made a motion to approve the minutes of the September 26, 2011 Board of Supervisors Meeting. Seconded by Travis Steigerwalt. John Wieczorek, yes; George Stawnyczyj, yes; Linda Benner, yes; Travis Steigerwalt, yes and Franklin Ruch, abstain 4-1 vote. Motion carried.

APPROVAL OF TREASURER’S REPORT: September 2011

MOTION

Franklin Ruch made a motion to approve the Treasurer’s Report for September 2011. Seconded by Travis Steigerwalt. John Wieczorek, yes; George Stawnyczyj, yes; Linda Benner, yes; Travis Steigerwalt, yes and Franklin Ruch, yes 5-0 vote. Motion carried.

Linda Benner made a motion to approve the following transfers:

Sale of Roller

MOTION

Travis Steigerwalt made a motion to advertise the sale of roller on the PSATS Discussion Group at a cost of $1000.00 or best offer, state amended to include that it is inoperable. Seconded by John Wieczorek. John Wieczorek, yes; George Stawnyczyj, yes; Linda Benner, yes; Travis Steigerwalt, yes and Franklin Ruch, yes 5-0 vote. Motion carried.

NEW BUSINESS:

Regional Comprehensive Plan

MOTION

John Wieczorek made a motion to appoint Attorney Schwab as acting secretary for Mahoning Township for the County Comprehensive Committee Meeting to be held on October 27, 2011 at 7:00 PM at the Lehighton Annex. Seconded by Franklin Ruch. John Wieczorek, yes; George Stawnyczyj, yes; Linda Benner, yes; Travis Steigerwalt, yes and Franklin Ruch, yes 5-0 vote. Motion carried.

Summit Ridge Inspections for Paving Operations

MOTION

John Wieczorek made a motion as per the Summit Ridge Development Agreement to authorize Tim Edinger to make inspection of road subgrade just prior to installation of subbase. Inspection of road subbase just prior to installation of the B.C.B.C. Inspection of road base course just prior to installation of the wearing course. Inspection of the installation of all storm water piping prior to cover. Seconded by George Stawnyczyj. John Wieczorek, yes; George Stawnyczyj, yes; Linda Benner, yes; Travis Steigerwalt, yes and Franklin Ruch, yes 5-0 vote. Motion carried.

Refund to Gary Rosenberg in the amount of $225.00 for Zoning Hearing Board Application Request for Variance

MOTION

John Wieczorek made a motion not to refund Gary Rosenberg in the amount of $225.00 for Zoning Hearing Board Application Fee. Seconded by Linda Benner. John Wieczorek, yes; George Stawnyczyj, yes; Linda Benner, yes; Travis Steigerwalt, no and Franklin Ruch, yes 4-1 vote. Motion carried.

LeRoy Leibenguth is going to make contact with Nis Hollow Trailer court advising of ordinance requiring residences to be properly marked and identified.

Copy of email received late in day not on the list regarding renovation of township building, making the determination of the structural integrity of building. Travis Steigerwalt questioned casino grant money.

COMMITTEE REPORTS:

Police Committee: Linda Benner advised that the Police Committee met prior to the Board of Supervisors meeting. We are going to be implanting a new schedule and giving it a 30 day trial. Officer Mertz was accused of not being truthful; brought written proof of the facts. Linda Benner apologized to Officer Mertz for all he went through.

Travis Steigerwalt advised of the quotes for a new police vehicle. John Wieczorek suggested to have office staff do a spreadsheet.

MOTION

George Stawnyczyj to purchase a crown Victoria, 4 year municipal lease financing. Seconded by Travis Steigerwalt. John Wieczorek, no; Travis Steigerwalt, yes; George Stawnyczyj, yes, Linda Benner, no and Franklin Ruch, no 2-3 vote. Motion fails

Road Committee: Travis Steigerwalt would like to see a list of completed projects; to keep up to date with projects completed this season

OFFICIALS:

Þ  Executive session following the meeting for personnel.

Þ  Meeting with township engineer, Franklin Ruch, Ronald Reeser and Natalie Haggerty for discussion of pole barn.

Þ  Made attempt to identify some executive sessions that were not properly announced. The sessions were held on March 9, April 6, April 27, and June 15th, 2011 all for personnel police business.
