Obligations of Learning Providers

The Ministry of Defence (MoD) would like to make you aware that approved provider status is not indefinite and is subject to review. The circumstances under which approved provider status may be revoked include but are not limited to:

A) Failure to comply with any of the policy requirements as contained in the current versions of:

1)  Joint Service Publication (JSP) 898 Part 4 Cht 3

2)  Claim procedure flow chart Annex 1 to the JSP

3)  www.enhancedlearningcredits.com

B) Lack of demand from eligible claimants for the courses provided by an Approved Learning Provider. As a guide the MoD will select to remove Approved Learning Provider Status if there is no ELC claiming activity for that provider for over 12 months.

C) Failure to comply with any of the minimum requirements detailed below.

The MoD expects as a minimum Learning Providers will:

§  Proactively keep up to date and comply with policy and procedure changes

§  Regularly refer to www.enhancedlearningcredits.com

§  Proactively keep ELCAS updated on Learning Provider contact details. Changes can be made by logging on to the Learning Provider Management Tool located from the provider page of the ELCAS website.

§  Proactively maintain their course list on the ELCAS website noting that:

§  Only those level 3 or above courses officially approved by MOD should be listed.

§  For packaged courses at least 75% of the course study must be at Level 3 or above on the Qualifications Framework (QCF) (or recognised national equivalent).

§  Co- operate fully with the MoD, and ELCAS when a complaint is received and/or any investigation is conducted

§  At any time be required, by means of a formal request from ELCAS, to produce evidence of their past and/or current compliance

§  Notify ELCAS if any re-organisation, senior management, staffing changes, significant changes to system or procedures or other such event raises significant questions in relation to the ELCAS scheme

§  Notify ELCAS when there is a change in legal entity (company name, registered address, merger or acquisition. This will then result in suspension of the Approved Provider status with the new legal entity having to apply for status in their own right against the current criteria

§  Not undertake any activity or omit to undertake activity, which would cause the ELCAS scheme to be brought into disrepute.

§  Not display the ELCAS logo

§  Only offer courses approved by ELCAS as part of the original provider application or subsequent request for amendment

§  Only offer courses listed on the website

§  Comply with all laws domestic to the Learning Provider

§  Achieve at least 80% satisfaction score on every evaluation received from a claimant and be prepared to respond to negative feedback and complaints in a reasonable and timely fashion

§  Have sufficient equipment/materials to facilitate learning

§  Provide a high quality of learning provision

§  Ensure that ELC claimants should receive the same high level of service as none ELC claimants

§  Encourage claimants to complete ELCAS evaluations forms which should be returned directly to ELCAS not via the Learning Provider

§  Adhere to the administrative, invoicing and payment term requirements of the ELC scheme

§  Make themselves available for a pre-arranged ELCAS evaluation visit which may or may not be required during the period of Approved Provider Status. (Please check www.enhancedlearningcredits.com for further details about evaluation visits.)

§  Be prepared to provide evidence of course and qualification level

§  Agree to provide an up to date credit report if requested

§  Agree to provide an up to date insurance certificate which shows the required level, if requested.

Where holders fail to comply with their obligations the matter will be referred to the MoD for full investigation. Following investigation the MoD may suspend or withdraw your participation with the scheme. If withdrawn from the scheme the Learning Provider will be required to remove all reference to your ELC involvement from all your marketing materials immediately.
