COMAR ALCOHOL LAWS FOR THE STATE OF MARYLAND

CR-10-113 – Alcohol, Misrepresent Age / An individual may not knowingly and willfully make a misrepresentation or false statement as to the age of that individual or another to any person licensed to sell alcoholic beverages or engaged in the sale of alcoholic beverages, for the purpose of unlawfully obtaining, procuring, or having unlawfully furnished an alcoholic beverage to an individual.
CR-10-114 (1) – Alcohol, Possess by <21
CR 10-114 (2) – Consumption of Alcohol by person <21 / An individual under the age of 21 years may not:
possess or have under the individual’s charge or control and alcohol beverage unless the individual is bona fide employee of the license holder or under the charge or control of the individual in the course of the individual’s employement and during regular working hours
An individual under the age of 21 years may not:
Consume an alcoholic beverage.
The prohibitions set forth do not apply if:
·  an adult furnishes the alcoholic beverage to the individual or allows the individual to possess or consume the alcoholic beverage
·  the individual possessing or consuming the alcoholic beverage and the adult who furnished the alcoholi beverage to the individual or allowed the individual to possess or consume the alcoholic beverage are the members of the same immediate family
·  the alcoholic beverage is furnished and consumed in a private residence of the adult or within the cartilage of the residence
·  the individual consumes the alcoholic beverage as a participant in a religious ceremony.
CR-10-115 – Alcohol Poss False ID / An individual under the age of 21 years may not possess a card or document that falsely identifies the age of the individual under circumstances that reasonably indicate an intention to violate the provisions of this part.
CR-10-116 – Alcohol, Obtain for <21 / An individual may not obtain, or attempt to obtain by purchase or otherwise, an alcoholic beverage from any person licensed to sell alcoholic beverages for consumption by another who the individual obtaining or attempting to obtain the beverage knows is under the age of 21 years.
CR-10-117 (a) – Alcohol, Furnish to <21
CR-10-117 (b) – Alcohol, Adult Responsibility / A person may not furnish an alcoholic beverage to an individual if:
The person furnishing the alcoholic beverage knows that the individual is under the age of 21 years
The alcoholic beverage is furnished for the purpose of consumption by the individual under the age of 21 years
An adult may not knowingly and willfully allow an individual under the age of 21 years actually to possess or consume an alcoholic beverage at a residence, or within the cartilage of a residence that the adult owns or leases and in which the adult resides.
The prohibitions set forth do not apply if:
·  an adult furnishes the alcoholic beverage to the individual or allows the individual to possess or consume the alcoholic beverage
·  the individual possessing or consuming the alcoholic beverage and the adult who furnished the alcoholi beverage to the individual or allowed the individual to possess or consume the alcoholic beverage are the members of the same immediate family
·  the alcoholic beverage is furnished and consumed in a private residence of the adult or within the cartilage of the residence
The individual consumes the alcoholic beverage as a participant in a religious ceremony.
CR-10-118 (a) (1) – Alcohol Poss Keg w/o Registration
CR-10-118 (a) (2) – Alcohol Poss Keg Altered Form
CR-10-118 (b) – Alcohol Allow <21 to drink from Keg / A person may not possess a keg that has not been registered/does not have a registration form attached/registration form has been altered or obliterated.
An individual <21 years may not be permitted to consume any contents of the Keg
CR-10-120 – Alcohol, Fail to Produce ID / Upon request, a person must produce a valid ID proof of age
CR 10-125 (a) – Alcohol Open Container in Motor Vehicle / A person may not possess an open container of an alcoholic beverage in a motor vehicle.
CR 10-125 (b) (2) – Consumption in Passenger Area / An individual may not consume any alcoholic beverage in the passenger are of motor vehicle.
Ed. Art 26-103 (a) (2) – Alcohol Poss on School Property / A person may not drink or possess alcoholic beverages on school property
2B 1-201 – Alcohol, Sales w/o License / Sale of alcoholic beverages without a license is prohibited.
2B 19-202 (a) (1) – Alcohol drinking on Public Property
2B 19-202 (a) (2) – Alcohol drinking in shop center park/lot
2B 19-202 (a) (3) – Alcohol drinking in Retail park lot
2B 19-202 (a) (4) – Alcohol drinking in parked vehicle in any of the above / A person may not drink alcoholic beverages on any public property or shopping center, mall, or other retail establishment or in parked vehicles in such establishments.
2B 19-301 (b) (1) – Alcohol, poss open container – shop center park lot
2B 19-301 (b) (2) – Alcohol, poss open container – retail park lot
2B 19-301 (b) (3) – Alochol, poss open container – parked vehicle in any of the above / A person may not possess an open container of any kind of alcoholic beverage in any of the public places, highways, shopping centers parking lot, retail parking lots, or parked vehicles in such establishments.
2B 12-108 – Alcohol to minors / Alcohol sales to minor and intoxicated persons is prohibited.
