Job Purpose/Summary

Purpose of role: To liaise with Executors of estates where gifts are left in Wills to Marie Curie, with family members, with other professionals and with co-beneficiary organisations in order to:

•Optimise the value of legacies to Marie Curie, balancing the need to maximise income and enhance the organisation's reputation.

•Represent the organisation in a positive light to the families, professional and non-professional Executors and others connected with legacies to Marie Curie to help support future gifts.

•To take steps where appropriate to ensure that the Trustees of Marie Curie are both properly represented and protected from liability.

Accountabilities (Duties & Responsibilities)

•To manage the administration of all legacies to Marie Curie.

•To provide leadership and line manage staff undertaking legacy administration ensuring that all team members are developed and receive suitable training for their posts.

•To undertake regular training to enhance his/her own skills as a manager, a legacy administrator and as part of the fundraising function of the organisation.

•To liaise with the Director of Finance or such other Directors as may be required regarding issues such as Deeds and indemnities.

•To provide recommendations for action on any legacy case where such action needs to be sanctioned by senior management or Trustees, such as where litigation is underway, there may be a risk to the charity's reputation or expenditure which may be greater than sanctioned for this post.

•To undertake personally the administration of more complex cases such as all residuary and Will Trust legacies and specifically those cases of any type which may involve contentious issues, issues regarding land, PR risks or other issues which require a high level of experience.

•To liaise regularly with the Legacy Manager regarding the progress of high-value and high-risk cases and in general regarding the management of the legacy administration function.

•To ensure that all legacies are recorded in the Legacy Database

•To provide reports as required on legacy numbers and values and assist in the calculation of the year end accrual.

•To liaise with the legacy fundraising and communications functions of Marie Curie Cancer Care in relation to any information or stories relating to legacies which could enhance the organisation's future income.

•To liaise with families, Executors (or their instructed agents), other professionals (such as surveyors) and co-beneficiaries in the carrying out of the above tasks, representing the charity in a favourable light.

•To instruct solicitors to investigate and represent the charity regarding claims and other contentious and non-contentious probate matters, with the agreement of the Legacy Manager.

•To ensure that all procedures and policies relating to legacy administration are updated regularly.

•To instruct solicitors to carry out estate administration on behalf of the charity’s Trustees where Marie Curie Cancer Care is named as Executor

•To be responsible for keeping records for the Trustees' inspection of indemnities given and ex-gratia payments sanctioned.

•To be responsible for the keeping of records of income tax to be reclaimed from HMRC through Statements of Estate Income.

•To be the “go to” person for all legacy administration matters and to actively promote the work of the department allowing for more detailed understanding and transparency.

Qualifications,
