AN ORDINANCE APPROPRIATING $75,000FROM COUNCIL DISTRICT 5 LOBLOLLY RECREATION/PARKS ACCOUNTTO Jacksonville Youth Soccer Club, Inc. TO ASSIST IN FUNDING THE CONSTRUCTION OF the project titled “Earl JohnsonPARK – soccer Field” LOCATED AT 5390 St. Augustine Road, JACKSONVILLE, FLORIDA 32207;PROVIDING FOR A REVERTER;APPROVING AND AUTHORIZING THE MAYOR, OR HIS DESIGNEE, AND CORPORATION SECRETARY TO EXECUTE AND DELIVER AN AGREEMENT BETWEEN THE CITY OF JACKSONVILLE AND JACKSONVILLE YOUTH SOCCER CLUB, INC. FOR PROGRAM MANAGEMENT SERVICES FOR THE PURPOSE OF CREATING THE NEW SOCCER FIELDS; INVOKING THE EXCEPTION OF SECTION 126.107(G), ORDINANCE CODE, TO AWARD THE PROFESSIONAL SERVICES TO JACKSONVILLE YOUTH SOCCER CLUB, INC. FOR MANAGEMENT AND OVERSIGHT OF THE CONSTRUCTION; PROVIDING FOR THE OVERSIGHT BY THE PARKS, RECREATION AND COMMUNITY SERVICEs DEPARTMENT; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED by the Council of the City of Jacksonville:
Section 1. Appropriation. For the 2013-2014 fiscal year, within the City’s budget, there are hereby appropriated the indicated sum(s) from the account(s) listed in subsection (a) to the account(s) listed in subsection (b):

Section 2.Purpose. The purpose of the appropriation in Section 1 is to provide matching funds up to $75,000to Jacksonville Youth Soccer Club, Inc. for construction of one additional soccer field atEarl Johnson Park, located at 5390 St. Augustine Road, Jacksonville, FL 32207. The project is more fully described in Exhibit 1 attached hereto and incorporated herein by this reference.
Section 3.Reverter.Any remaining funds after the completion of the soccer field shall be returned to the source of origin.
Section 4.Agreement between the City of Jacksonville and Jacksonville Youth Soccer Club, Inc. for Program Management Services for Completion of the Construction of the Soccer fields at Earl Johnson Park Approved. There is hereby approved, and the Mayor, or his designee, and Corporation Secretary are hereby authorized to execute and deliver, that certain Agreement between the City of Jacksonville and Jacksonville Youth Soccer Club, Inc. for Program Management Services for construction of one additional soccer field at Earl JohnsonPark, in substantially the same form attached hereto as Exhibit 2.
Section 5.Invoking the exception to Sec. 126.107(g), Ordinance Code. The City is hereby authorized to procure the use of professional services of Jacksonville Youth Soccer Club, Inc. to provide the management and oversight services at the Earl Johnson Park at 5390 St. Augustine Road, Jacksonville, FL 32207. Pursuant to Section 126.107(g), Ordinance Code, such procurement is exempted from competitive solicitation. With the exception of the foregoing, all other provisions of Chapter 126, Ordinance Code, shall remain in full force and effect.
Section 6. Oversight.The Mayor is requested to appoint the Parks, Recreation and Community Services Department to oversee the project in Section 2 above and to ensure compliance with all other appropriate laws.
Section 7. Effective Date. This ordinance shall become effective upon signature by the Mayor or upon becoming effective without the Mayor’s signature.
