The regular meeting of the Green Township Board of Trustees held on October 26, 2015 was called to order at 5:30 p.m. with the Pledge of Allegiance.

Roll Call: Chairman Rosiello, present; Trustee Callos, present; Trustee Linnenberg, present; Fiscal Officer Straus, present.

Chairman Rosiello moved to approve the minutes for the regular meeting of October 12, 2015. Trustee Linnenberg seconded the motion. All voted Aye.

RESOLUTION #15-1026-A

Chairman Rosiello moved to pass a resolution accepting and approving the financial reports as submitted. Trustee Callos seconded the motion. Trustee Linnenberg: Aye; Trustee Callos: Aye; Chairman Rosiello: Aye.

RESOLUTION #15-1026-B

Chairman Rosiello moved to pass a resolution determining nuisance and ordering demolition of structure at 3964 Race Road. Trustee Callos seconded the motion. Trustee Linnenberg: Aye; Trustee Callos: Aye; Chairman Rosiello: Aye.

Attorney Hyle stated that the demolition of 3964 Race Road is being ordered due to two fires that have occurred to the structure. A letter was received from the Hamilton County Building Department finding that the house is in a substandard condition and unsafe. The matter was assigned to Green Township Fire Marshall, Rick Bell, for further action. Photos of the house have been provided. Fire Marshal Bell was present at the meeting and stated that he has inspected the property and has rendered his professional opinion that the house is unsafe and should be demolished under the revised statute 50586. Thirty days notice is provided to the property owner, Christina Trust, who will then have 30 days to file an appeal to the Green Township Board of Trustees for a hearing. Chairman Rosiello asked if the Hamilton County Board of Health was involved in this matter. Fire Marshal Bell stated that the Board of Health is not involved in this case. Chairman Rosiello asked Attorney Hyle how the demolition will be paid for. Attorney Hyle stated that if the property owner does not act on their own in the next 30 days, then the Township will pay for the demolition, certify the cost of the demolition to the Hamilton County Auditor, and the cost would be included on the owner’s next real estate tax bill. Attorney Hyle stated that funds, or a portion of the funds, would be recovered at the time of sale. Attorney Hyle stated that the house is for sale at the moment for $29,900.00. Trustee Callos stated that this property is an eyesore for the community and it is important to take corrective steps.

RESOLUTION #15-1026-C

Chairman Rosiello moved to pass a resolution determining nuisance and ordering demolition of structure at 7060 Taylor Road. Trustee Callos seconded the motion. Trustee Linnenberg: Aye; Trustee Callos: Aye; Chairman Rosiello: Aye.

Attorney Hyle stated that this situation is very similar to the first one. Green Township has received a letter from the Hamilton County Building Department finding that the structure is in an unsafe and substandard condition. The matter was referred to Green Township Fire Marshal Rick bell. Fire Marshal Bell has inspected the property and determined it to be unsecure, unsafe, and in substandard condition. The property is owned by Phillip Wienkamp. This resolution would dispense with certified mail notice of Mr. Wienkamp as the Police Department is going to personally service the notice to Mr. Wienkamp this week. Trustee Linnenberg stated that this house was not damaged due to fire, but is dilapidated due to a hoarding situation.

Attorney Hyle stated that Green Township is working on three to four other structures that are dilapidated due to hoarding. Fire Marshal, Rick Bell, feels that he can certify those properties as structurally defective. Green Township is proceeding under the Property Maintenance Code to attempt to get into the structures, have the garbage removed, and then certify the clean-up cost on the home owner’s tax bill.

RESOLUTION #15-1026-D

Chairman Rosiello moved to pass a resolution authorizing second amendment to development agreement with Neyer Properties Inc. and 5661 Harrison Avenue LLC. Trustee Callos seconded the motion. Trustee Linnenberg: Aye; Trustee Callos: Aye; Chairman Rosiello: Aye.

Attorney Hyle stated that Green Township has had a Development Agreement with Neyer Properties, Inc. over the last few years. Neyer developed Harrison Greene on Harrison Avenue. There have been some changes in the circumstances with the development that requires the Township to adjust some of the infrastructure support that the Township has agreed to provide. This amendment addresses improvements to Harrison Avenue that will be undertaken by Green Township after the first of the year. Some of the TIF Fund dollars pledged to Neyer Properties, Inc. will now be used towards the improvement of Harrison Avenue. Mr. Hyle noted the agreement requires Neyer Properties to obtain needed easements for the improvement of Harrison Avenue, at their expense. The easements will then be assigned to Green Township for construction. Otherwise, the amendment maintains the balance of the development agreement, with one additional exception. Neyer has agreed to provide the Township access from the CSX line so the planned walking path can eventually connect directly to the development site.

The following properties were declared as nuisances. The Township Attorney was directed to notify the owners of the properties listed below of this resolution:

4. 5534 Leumas Drive (550-0010-0046), Motion made by Chairman Rosiello and seconded by Trustee Callos. All voted Aye.

5. 3576 Neiheisel Avenue (550-0172-0357), Motion made by Chairman Rosiello and seconded by Trustee Callos. All voted Aye.

Fiscal Officer, Tom Straus, reported that so far this year the Township has received approximately $45 million dollars and expended approximately $38 million dollars. He also reported that the Township had a sizeable sum sitting in low interest bearing accounts, so he moved $10 million dollars to various CD’s. Those CD’s will pay approximately 84 basis points, which comes to approximately $69,000 by investing the money.

Township Attorney, Frank Hyle, stated that he had nothing to report.

Township Administrator, Kevin Celarek, stated that he had nothing to report.

Asst. Director of Public Services, Butch Nanney, reported in the absence of Director of Public Services, Joe Lambing. Mr. Nanney reported that the leveling course has been added to the streets that are part of this year’s Street Rehabilitation. Adjustment on the manholes will begin next week and then the final course of asphalt will be added. Mr. Nanney also reported that the Wesselman/Rybolt intersection will be open beginning next week. Mr. Nanney announced that Saturday, November 21, 2015 from 8:00 a.m. to 5:00 p.m. is the Green Township Clean-Up Day at Kuliga Park. There will be no hazardous waste permitted to be put into the dumpsters on that day. There will be a truck available to collect scrap metal. Yard waste collection will also be open at Kuliga Park that day. Trustee Callos asked about road work on Tallahassee. Mr. Nanney stated that the leveling course is down and work will continue on that roadway. Fiscal Officer Straus reported that at the intersection of Wesselman/Rybolt, residents are still moving barricades on weekends. Police Chief West stated that they will keep an eye on it until it opens back up in a week.

Fire/EMS Chief, Doug Witsken, stated that he had nothing to report.

Police Chief, Bart West, reported that there have been a couple of bomb threats at area schools lately in Green Township. However, it is not something that is exclusive to Green Township, it is happening throughout the State and in Northern Kentucky. Police Chief West stated that he is very proud of the school Principals who have done a great job dealing with the kids and teachers. Chief West thanked the neighboring Police Departments for their assistance. Chief West also reported that Halloween will be celebrated in Green Township on Saturday, October 31, 2015 from 6:00 p.m. to 8:00 p.m. Chief West cautioned motorists to please be careful with the kids out Trick-or Treating. He asked parents to please be sure that their children can see out of their masks, costumes aren’t too long, and that children are wearing something reflective or carrying a flashlight. Chief West also cautioned parents to please check the candy when their children get home for any signs of tampering. He wished everyone a safe Halloween.

Trustee Linnenberg reminded everyone that if their kids see a Police Officer on Halloween be sure to get a piece of candy from them.

Trustee Callos stated that he received several calls from parents of students at Oakdale Elementary School after the bomb threat thanking the Police Department for their quick response and the professional job they did, as well as the Hamilton County Sheriff’s Department. Chief West stated that the principal, teachers, and staff did a great job too. This event was hardest on the parents because they are not there and cannot see what is going on. The parents did appreciate the prompt response from the school letting them know what was going on. Chairman Rosiello stated that on that day there were seventeen similar type automated bomb threat calls made to schools. Trustee Callos thanked Police Chief West for the great work the Police Department did during that event. Chairman Callos encouraged residents to sign up for tip411 to submit anonymous tips about crimes to the Police Department.

Director of Development, Adam Goetzman, provided an update on three of the Hamilton County zoning cases that were reviewed at the previous Trustees’ Meeting. He noted that the LaSalle lacrosse practice wall was approved by Hamilton County with additional landscaping requirements. The Colonial Drive garage applicant was instructed by the Hamilton County Board of Zoning Appeals to work with the neighboring property owners in an effort to find a mutually agreeable compromise. He also reported that the Mercy Hospital office building was approved subject to the conditions outlined by the Green Township Board of Trustees.

Administrator Celarek made the following announcements:

1. Halloween hours for Saturday, October 31, 2015 will be from 6:00 p.m. to 8:00 p.m.

2. Green Township Clean-Up Day will take place on Saturday, November 21, 2015 at Kuliga Park from 8:00 a.m. to 5:00 p.m.

Trustee Callos read several thank you letters.

Trustee Callos announced that on November 11, 2015 at 11:00 a.m. there will be a Veterans Day ceremony at Veterans Park on Harrison Avenue. Trustee Callos welcomed everyone to attend that ceremony to support our Veterans.

Trustee Linnenberg reported that on Thursday, October 22, 2015 at the Nathanael Greene Lodge there was a meeting regarding the Werk/Westbourne Enhanced High Rate Treatment Facility. This facility will handle three separate issues. It will address the odor problem, the debris problem, and will disinfect the water that runs through the Schaible Creek that goes into Muddy Creek. This facility is significantly larger than the Township had anticipated, but unfortunately a significant portion of the facility must be above ground. It is a large multi-building structure. Some of the buildings will be 30 ft. high, and will stand out. MSD has agreed to the Township’s request to put a fence around the facility. They will also move the fence in and put landscaping around the outside of the fence. There will be sidewalk on Werk Road. This new treatment facility will solve the problems in that area 80 – 90% of the time. However, when there are downpours of rain there will still be some problems in that area. Construction of the facility will begin mid-2016 and be completed at the end of 2017. This facility is not only necessary, but has been mandated by the Federal Government. The Schabile Creek and Muddy Creek travel through a large portion of Green Township. It is unfortunate that the facility has to be as large as projected, but it is necessary and will solve a majority of the problems in that area.

Trustee Callos thanked Trustee Linnenberg for his many years of work on this project with MSD.
