Tender Information for a Farm Business Tenancy

Luxulyan Paddocks

License - Overview

Cornwall Council is looking for a tenant to make stock proof and graze preferably with ponies,four paddockssituated in theLuxulyanValley. The paddocks form part of an open space with public access within a steep sided wooded valley of the River Par. The valley contains a major concentration of early 19th century industrial remains, and is designated as part of a World Heritage Site.

The Grazing License includes:

  • four paddocks within LuxulyanValley total area, 6.7Acres (2.7HA) outlined in appendix 1.

Field 3) 2.17 AC 0.87 HA

Field 4) 1.47 AC 0.59 HA

Current Infrastructure

The tenant will be responsible for maintaining all fencing, gates and furniture and where required bringing them up to a suitable standard for the intended stock type.See appendix for fencing standards. The widths of all ingress and egress points to the four paddocks may not be altered without written permission from Cornwall Council.

There is currently onlyone water trough in paddock3. All other water for stock and suitable troughs would need to be supplied by the tenant.

Maintenance of grassland:

Paddocks to be managed under an ecologically sensitive grazing and cutting regime to enhance their species diversity and potential for wildlife.

  • Grass cutting not before 15th July and not after 31st March.
  • No supplementary feeding.
  • Control of undesirable species such as Creeping Thistle / spear thistle/ Curled leaved dock / bracken / broadleaved dock / ragwort and nettle.

Hedgerows: Internal only paddock 4

  • Internal hedgerows to be maintained at a minimum height of 2m from top of bank, and a minimum width of 0.45meters measured from the centre of the hedge. Hedge row to be cut no earlier than 1st Januaryon a 3 year cycle.

Grass Cutting Timing and Vegetation Management

If grass cutting is required it should be not be cut before the 15th July and not after 31st March. This will leave ample opportunity to cut rank grass following any winter growth. Please consider leaving vegetation long over winter as a winter seed source for bird life and cover for invertebrates.

Woody vegetation should not be cut during the bird nesting season(February 1st until July 31st).. Please also consider cutting woody vegetation between January and February in order to leave berry food sources in place longer for winter bird food.

Access

PRoW

There are no rights of way across the land in the agreement, however paddocks 2 and 3 have full open access to the public all year and the tenant will be responsible for keeping the pathway clear. The tenant must insure stock is suitable for paddocks with pubic access.

Tenant Access

Vehicular access to paddocks is limited. The red arrows indicate the access points.

Paddock 1 can be accessed from the road over a small bridge and through a field gate. The tenant will need to obtain permission from council should heavy vehicles need to access the site.

Paddock 2 can be accessed via a rough track up the hill from Black Hill Car Park. Permission to use this track will be sort by the tenant from Cornwall Heritage Trust.

Paddock 3 can be accessed a long a public access path, permission will be sort from Cornwall Council / CORMAC before using this track.

Paddock 4 is accessed from the road. Creating an access point between the upper and lower parts of the paddock will be considered by Cornwall Council. Permission for any ground works must be sought from Cornwall Council.

Public Liability Insurance.

Cornwall Council require formal evidence of an up-to-date insurance policy with at least £5 million pounds public liability insurance provided by a company that is regulated by the UK Financial Services Authority.

Cornwall Councils insurance will not cover the tenant against claims against damage to livestock caused by members of the public or their pets.

Term of Licence

3 years, subject to review after year 1.

Legal Fees

The tenant will be required to cover £250 legal fees to cover costs incurred in drawing up the agreement.

Submitting the tender

Applicants are required to submit their priced tender to Phil Jones, sealed in the stamp addressed envelope which is labelled ‘Tender – LuxulyanValley Grazing License and having no other means of identification. This should be returned by 3 pm on Wednesday26thFebruary to:

Location of Paddocks

Appendix 2

Fencing Types

All fencing types

All posts including strainer posts to be secured using compacted earth from the site or rammed in. No concrete or post mix to be used to secure posts. All fencing should be a minimum of 1.05 meters high. All fences should be erected in accordance with BS 1722.

Post and Rail

Use treated softwood or untreated hard wood (Oak, Sweet Chestnut for example). Posts to be 125mmx375mm x 2.1mand at a spacing of 1.8 meters. Rails to be 100mm x 40mm minimum.

Post and Wire

Strainers to be minimum 150mm x 2.1m minimum size. Wire to be 3.15mm high tensile wire or 4mm plain wire. Spacings between wire should be suitable for the intended stock type. Post spacing should not exceed 3.5 meters. Intermediates should be minimum 75mm diameter x 1.7 meters.

Post and Stock Netting

Strainers, intermediates and spacing as above. Use galvanised high tensile or low tensile stock netting. If you are considering grazing with equines please check suitability of stock netting due to the risk of leg injuries and entanglement.
