Eczema WAP user licence

By downloading and using the eczema WAPyou agree to be bound to the following terms and conditions:

  1. University of Bristol (“UoB”) hereby grants you (“Recipient”) a royalty free non-exclusive licence to use theeczema WAPfor the purpose ofroutine clinical care, research and teaching (“Purpose”)
  1. Except to the extent necessary for the Purpose and as permitted at clause 5, the Recipient shall not sub-license, distribute, adapt, modify, translate,transfer, sell, exploit or use the eczema WAP in any way or for any other purpose without prior written permission of UoB.
  1. The eczema WAP or any information relating to it are provided WITHOUT ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR PARTICULAR PURPOSE OR ANY OTHER WARRANTY, EXPRESSED OR IMPLIED. Neither party in particular gives nor makes any condition, other term, or provision or representation that any use of eczema WAP will not infringe the rights of any person.
  1. The Recipient shall use the eczema WAPand any data collected from its use at entirely at its own risk and in no event will UoB be liable to the Recipient for any loss or damage of any kind including lost profits or other consequential loss arising from its use of (including for the avoidance of doubt treatment or patient management decision made or not made), or any inability to use the eczema WAPor from errors or deficiencies in it whether caused by negligence or otherwise except as expressly provided in this Agreement.

The Recipient acknowledges that the eczema WAPwas developed as part of a research project during 2016-17, drawing on the best available research and clinical guidelines available at the time. However, it has not been evaluated in a clinical trial and consequently we do not know whether its use supportsself-management of condition and leads to improved patient outcomes. Similarly, future research/revisions to guidelines mean content are likely to require updating in time. UoB is unable to provide any technical advice or support,beyond that contained in academic papers/available on the study website, regarding its use.

  1. The Recipient may not assign, transfer, mortgage, charge nor part with any of its interests, rights, duties or obligations under this Agreement.
  1. The Recipient shall acknowledge use of the eczema WAP in any reports or publications of results obtained using it using the following citation:

  1. Any breach of the terms contained within this Agreement by the Recipient will result in automatic termination of the Agreement.
  1. Clauses 3, 4, 5, 6, and 9shall survive termination of this Agreement
  1. All matters affecting the interpretation, validity and performance of this licence agreement shall be governed by the laws of England. Each of the parties irrevocably submits for all purposes regarding this Agreement to the exclusive jurisdiction of the courts of England.
