PUBLIC HOUSING DWELLING – LEASE ADDENDUM
FOR A SMOKE-FREE PROPERTY

The Crossroadswill become smoke-free on January 1, 2014. The Resident and all members of the Resident’s family or household are parties to a written Lease with Lloyd Management, Inc. This addendum states the following additional terms, conditions, and rules which are hereby incorporated into the Lease.

PURPOSE OF A SMOKE-FREE BUILDING: The parties desire to alleviate the following:

  1. Irritation and known health effects of secondhand smoke;
  2. Increased maintenance, cleaning and redecorating costs from smoking; and
  3. Increased risk of fire damage and death from smoking.
  4. Health risk to children and a major source of litter due to cigarette butts.
  1. DEFINITION OF SMOKING: The term “smoking” means inhaling, exhaling, breathing, or carrying any lit cigarette, cigar, e-cigarettes, hookah or any other tobacco product or similar lighted product in any manner or in any form.
  1. SMOKE-FREE BUILDING: Resident agrees and acknowledges that the premises to be occupied by Resident and members of Resident’s household have been designated as a smoke-free living environment in accordance with the following guideline. Effective January 1, 2014,all residents, employees,and guests of The Crossroadswill be prohibited from smoking anywhere in the buildings including all townhomes including, gazebos, garages, courtyards, playgrounds or any structure and within 25 feet of entrances, exits and air intakes to the buildings. Resident shall not permit any guests or visitors under the control of Resident to smoke in above-mentioned areas.
  1. RESIDENT TO PROMOTE NO-SMOKING POLICY AND TO ALERT OWNER OF VIOLATIONS: Resident shall inform their guests of the no-smoking policy. Further, Resident shall notify Owner by written statement of any incident where tobacco smoke is migrating into the Resident’s unit from sources outside the Resident apartment unit, or if the Resident witnesses smoking activity any place within building or on the grounds.
  1. OWNER TO PROMOTE NO-SMOKING POLICY: Owner shall post no-smoking signs at entrances and exits, in common areas, and in conspicuous places.

  1. EFFECT OF BREACH AND RIGHT TO TERMINATE LEASE: A breach of this Lease Addendum shall give each party all the rights contained herein, as well as the rights in the Lease. A material breach of this Addendum shall be a material breach of the Lease and grounds for termination of the Lease by the Owner. Any deviation from the no-smoking policy by any Resident, a member of their household or their guest will be considered a lease violation. Three (3) violations will be considered “serious or repeated violations” in conjunction with the Lease and may result in eviction.
  1. DAMAGE TO PREMISES: If in violation of the no-smoking policy and/or Lease Addendum, the Resident will be responsible for damages caused by smoking in the apartment or anywhere else within the building (either done by the Resident or their guests) after the effective date. Costs associated with smoking may include, but are not limited to: Replacement of carpet and pad, replacement of vinyl flooring, damages done to countertops, painting and extra cleaning and/or any other damages.
  1. DISCLAIMER BY OWNER: Resident acknowledges the Owner’s adoption of a no-smoking policy, and the efforts to designate the rental building and grounds as smoke-free, do not make the Owner or any of its managing agents the guarantor of Resident’s health or of the smoke-free condition of the Resident’s unit and the common areas. However, Owner shall take reasonable steps to enforce the smoke-free terms of its leases and to make the property smoke-free. Owner is not required to take steps in response to smoking unless Owner knows of said smoking or has been given written notice of said smoking.
  1. ACKNOWLEDGMENT & AGREEMENT OF RESIDENTS: All new and current Residents will be given two (2) copies of the smoke-free lease addendum. After review, the Resident(s) will sign both copies and return one to the Mankatooffice by November 30, 2013. The copy will be attached to the Resident’s lease and kept in the Resident’s file.

RESIDENT CERTIFICATION.

I have read and understand the above no-smoking policy and I agree to comply fully with the provisions of the policy. I understand the failure to comply may constitute reason for termination of my Lease.
