I – RECOGNITION

1.1  Recognition – The Board of Education of School District No. 502, Bureau County, Spring Valley, Illinois, hereinafter referred to as the “Board,” recognizes the Hall Education Association, an affiliate of the IEA-NEA, hereinafter referred to as the “Association,” as the sole and exclusive negotiating agent for all regularly employed, certified teaching personnel, hereinafter referred to as “employees,” except for the superintendent, principal, assistant principal(s), dean of students, and athletic director.

ARTICLE II – EMPLOYEE AND ASSOCIATION RIGHTS

2.1  Right of Representation – When an employee is required to appear before the Board regarding any matter which could adversely affect the employee’s continued employment as a teacher in the school district, the employee shall be entitled to be represented at said meeting by a representative. Written notice shall be given a minimum of two working days before the meeting with the Board of Education. Said notice shall include the name of the individual who will be accompanying the employee to the Board meeting.

2.2  Right to Organize - Employees shall have the right to organize, join and assist the Association and to participate in professional negotiations with the Board. The Board shall not discriminate against any employee with respect to hour, wages, terms and conditions of employment for reason of membership in the Association, participation in negotiations with the Board or institution of any grievance, complaint or proceeding under this Agreement. Employees shall also have the right to refrain from any or all such activities.

2.3  Professional Dues Deductions – The Board agrees to assist the Association in the collection of professional dues in the following manner:

A.  The Association will secure annually from its members written authorization for District 502 to deduct, in twenty-six (26) installments, dues to the Hall Education Association, IEA, and NEA, commencing with the first paycheck of the school year.

B.  Any employee employed after the start of the school term may authorize dues deduction by presenting an authorization card to the Board by September 30. The Hall Education Association shall collect whatever dues are payable prior to presentation of the authorization card.

C.  Such authorization shall not be revocable for a period which is the lesser of one (1) school year or the remainder of the current school year except the termination of employment in the district shall constitute revocation of authorization for dues deduction effective the last day of employment.

D.  The District will make one check payable to the Hall Education Association each month, October through July. The Hall Education Association will make payment to the IEA and the NEA.

E.  In the event an employee wishes to make the entire payment at one time or by any arrangement other than provided herein, the Hall Education Association will have the employee make payment directly to the Hall Education Association and not involve District 502.

F.  The Hall Education Association agrees to assume the entire responsibility for securing the authorization of its members mentioned in the paragraphs above and present the signed authorization cards to the Board of Education no later than September 30.

G.  The Association shall indemnify and hold harmless the Board from any and all claims, demands, suits, and costs incurred in connection with any such claim, demand, or suit resulting from any action taken or omitted by the employer for the purpose of complying with the provisions of this paragraph.

H.  The authorization card shall reflect the total amount of dues to be deducted for each employee during the school year.

2.4  Notice of Board Meetings – The President of the Association shall be provided a copy of written notice of all regular and special meetings of the Board when such notices are distributed to Board members.

2.5  Board Minutes – Association Copies - Two (2) copies of all Board minutes and bills shall be placed in the school mailbox of the Association President after they have been approved by the Board of Education.

2.6  Association Recommendations – The Board will consider any recommendations made to the Board by the Association regarding fiscal or budgetary matters or revisions of educational policy. The Board will respond to Association recommendations before action is taken. However, nothing herein shall restrict the Board from taking action on such matters or policy at any time.

2.7  Newly Hired Teachers – Names and addresses of newly hired teachers shall be made available to the Association President within fourteen (14) days after their employment.

2.8  Association Days – Should the Hall Education Association send a representative to the IEA Representative Assembly, the representative shall be excused for a period of time not exceeding two (2) days without loss of pay provided the Association shall reimburse the district the cost of the substitute teacher.

2.9  Contract – Distribution – Within thirty (30) days of ratification of the Agreement by the last party ratifying same, the Board shall have sufficient copies of the Agreement prepared and delivered to the Association. The costs of such preparation shall be shared equally by the parties. Upon employment, each newly hired teacher shall receive a copy of the teacher contract.

2.10  Bulletin Boards – The Association shall have the right to post notices of activities on a bulletin board in the teacher’s lounge. The Association may use employee mailboxes for communication to teachers provided such usage does not interfere with normal school usage.

2.11  Use of School Property – The Association shall be permitted to utilize school facilities prior to 7:45 am and after 3:15 pm for meetings of the Hall Education Association provided advance notification of the intended use is given to the superintendent and further provided the Association shall pay for any necessary custodial expenses occasioned by use of the school facilities.

2.12  Fair Share Deduction

A.  Teachers covered by this Agreement who are not members of the Association shall be required to pay their fair share of the costs of the collective bargaining process, contract administration and pursuing matters affecting wages, hours, and conditions of employment, commensurate with the dues uniformly required of members. The Fair Share fee shall not include any fees for contributions related to the election or support of any candidate for political office or other political contributions. The Association shall annually certify to the Board the amount constituting each non-member employee’s fair share. Such certification shall be made in writing by the Association President and submitted to the business office by September 1, of each year.

B.  In the event that the non-member does not pay his/her fair share fee directly to the Association on or before thirty (30) days from the date of commencement of duties or the effective date of this Agreement, whichever is later, the Board shall deduct such fair share fee from the earnings of the non-member teacher and pay such amount to the Association no later than ten (10) days following such deduction. Such amount shall be deducted at a proportionate rate per pay period.

C.  If a non-member teacher declares the right of non-association based upon bona fide religious tenets or teaching of a church or religious body of which such teacher is a member, such teacher shall be required to pay an amount equal to his/her fair share to a non-religious charitable organization mutually agreed upon by the teacher and the Association. If the teacher and the Association are unable to reach agreement on the matter, the teacher may select a charitable organization from a list established and approved by the Illinois Educational Labor Relations Board, or, in the event no such list is established, such list shall be established by the Board of Education and the Association.

D.  The Association shall indemnify and save harmless the Board and all of its agents and employees from any and all claims, demands, or suits, and costs incurred in connection with such claims, demands, or suits resulting from any reasonable action, or failure to act, by the Board or any of its agents or employees for the purpose of complying with the provisions of this article. The Board retains the right to select its own attorneys and the Association agrees to reimburse the Board for reasonable attorneys’ fees incurred in connection with this provision.

ARTICLE III – SCHOOL CALENDAR

3.1  School Calendar – The Board shall establish a school calendar which does not exceed 186 school days. The calendar shall contain no more than 176 regular work days, four institute days, plus a fifth institute day that shall be scheduled at the start of the fall semester for professional development, and five emergency work days.

If the five emergency work days are not determined by the Board to be used for emergency purposes, they shall not become employee work days, and a mutually agreeable time for the closing of school shall be determined by March 15. A maximum of three representatives from the Association will meet with the Superintendent to provide input on the school calendar for the next school year.

The Board will respond to Association recommendations before action is taken.

ARTICLE IV – EMPLOYMENT CONDITIONS

4.1  Employee Work Day – The employee work day shall be from 7:45 a.m. until 3:15 p.m. and employees will be at their assigned classroom no later than 7:50am. If a Block 8 program is instituted, the beginning and ending time of the school day may be altered so long as the total hours of the work day do not increase. During each work day, the employee shall be entitled to a duty-free lunch period equal to that of the students but in no case less than thirty (30) minutes. The Board reserves the right to require attendance at three (3) non-consecutive school events outside of regular school hours during the school year which may include the graduation ceremony, convocation assembly, open house etc. Employees will be given a minimum of thirty (30) days notice for such attendance. In an emergency situation, or as a result of a non-reoccurring event, the superintendent, in his sole discretion , may allow an employee to miss an event with prior written approval of the superintendent.

4.2  Teaching Load –

A.  The normal teaching load shall not exceed six (6) teaching and supervising periods of fifty-two (52) minutes in length. Any teaching or supervision time beyond this number shall be on a voluntary basis and paid at a rate of one-sixth (1/6th) of the teacher’s salary per year in addition to regular salary. In addition to the above, each teacher may be assigned a homeroom or a lunchroom duty of no more than 40 minutes without further stipend, and teachers may be assigned as a tutoring homeroom teacher without further stipend, where it is necessary to assign an employee to a tutoring homeroom the administration shall attempt to spread such assignments as equitably as possible consistent with the maintenance of the school program. Block 8: If a Block 8 type of schedule is

initiated, the normal teaching load will not exceed three (3) teaching periods and one preparatory period, each of one hundred fifteen (115) minutes in length. Assignment to a supervised study period shall be considered a teaching period for purposes of the Article. No teacher shall be assigned more than three (3) supervisory periods without the teacher’s consent unless the position is initiated solely as a supervision position. Unless the position is initiated solely as a supervision position, any teaching or supervision time beyond three (3) periods shall be on a voluntary basis and paid at the rate of one fourth (1/4th) of the teacher’s salary per year in addition to regular salary.
