GIBBON CITY COUNCIL
February 21, 2017
The Gibbon City Council, Buffalo County, Nebraska met in an open public session at 7:00 p.m. at City Hall on Tuesday, February 21, 2017. The Mayor, Council Members and the public were advised of the notice by publishing and posting. No additional items were added to the meeting during the twenty-four hours preceding the meeting.
Mayor Deb VanMatre called the meeting to order at 7:00 p.m. The Pledge of Allegiance was recited. Mayor VanMatre advised every one of the Open Meeting Notice posted on the north wall of the Council Chambers. The City of Gibbon abides by the Open Meetings Act in conducting business.
Roll call was taken. Council Members present were: Derrick Clevenger, Kevin Hynes, Albert Krueger, Leon Stall.
Absent: No one
A motion was made by Derrick Clevenger to approve the order of the agenda, seconded by Kevin Hynes.

Presentations and Proclamations:
Buffalo County Sheriff Department—Contract Law Enforcement Report: Sergeant Valenzuela reviewed the report with the Mayor and Council Members. We have reached our goal for contract time. The amount of activity calls is up because of the nice weather. Council Member Stall voiced concern with the Kearney Police car chase through the City of Gibbon, which was very dangerous. Chris and Mayor VanMatre will contact the Kearney Administration Office concerning this matter. The BCSD had hired 2 certified officers, Scott Earhart and Zach Schwarz.
Our visibility has been up around the school with the extra patrol.
WWTP Report and Water Report—Matt Smallcomb: No permit violations in January. During January we ran in triple basin mode. On 2/13 we shut down SBR #3 to repair a sludge line. We are still working on pumping it down. Currently we are running both anaerobic lagoons. Once the west lagoon starts producing gas we will shut down the east lagoon. We replaced the transducer in the wet well.
Water: Repaired 2 water main breaks. Installed 2” water service in apartments downtown. We had to shut down the water valves at the Gibbon Pack meter vault so they could work on it. Four fire hydrants were flushed. We completed 6 locates, and installed 2 new meters.
Mayor Report—Deb VanMatre: The League Mid-Winter Conference will be February 27th & 28th in Lincoln. Three Council Members, Mayor and 2 staff members will be attending. I am working on plans for March planning session. I will be gone the third Monday of March and Barry will also be gone so we would like to change the meeting to the 2nd Monday of March. The meeting would be held on March 13, 2017 at 7:00 p.m. Barry will be discussing the Miller & Associates claim in his report.
City Administrator Report—Chris Rector: Cargill has submitted a building permit for bins and a building instead of a ground pile. They will be attending the March Council Meeting to discuss their plans, and answer any questions the Council may have. They have information on how to help eliminate some of the noise and will communicate with us about the building permit.
The We Care Tree Care Company will be removing some trees around town and at the cemetery. Blessing Construction is in town doing warranty work on previous projects. They fixed the drain on 3rd Street and seeded the area by hand. They are hauling concrete out of the landfill. We get to keep 20% of the concrete for our use. We have been cold patching around town and street sweeping. Vehicles are ready for the predicted snow storm. We will be planting some new trees at the cemetery.
City Attorney Report—Barry Hemmerling: Cargill is requesting to buy .248 acre on the north side of Rosen Park to round out their ground. We would have to pass a Resolution. The Title Co. would require one. When the property is valued at less than $5000 the City can sell the property after a Resolution is passed. They would like an easement south of the well.
I will be sending letters to the residents affected by the special assessments explaining the terms, interest rate, when payments are due, and the amount of the lien against the property.
The People Service claim was answered and included a counterclaim against them. Miller & Associates attorney contacted me concerning the amount they would settle on. They would accept $127,000 in complete settlement. This is a reduction of $7,788.20 for the warranty work, an additional $31,074.25 for the two statements we received for the additional time for the “construction issue” and $684.63 to make the offer a round number.
City Treasurers Report—Tonniges & Associates: Ashley reviewed the Treasurers Report with the Mayor and Council Members. General Fund the prior month had municipal equalization of $17,000 and current month had $21,000 of property tax collections from the Buffalo County, as
well as a $12,000 transfer correction to the cemetery fund.
Brooke Miller—McDermott & Miller—Audit Report for Year 2015-2016: As of May 1, 2017 the McDermott & Miller office located in Kearney will become an independent firm. There will be no staff changes. If you have any concerns please call me. We audited the financial statements of the City of Gibbon for the year ended September 30, 2016. At the end of the current fiscal year, the City of Gibbon had a total long term debt of $6.1 million. This entire amount of debt is backed by the full faith and credit of the City of Gibbon. The audit revealed several items for the City to review and consider such as two outstanding bond payments, invoices, payments and receipts between street and bond & interest funds, reconciliation errors within the system, entries within Power Manager System, etc. We would be willing to visit with management concerning these items.

Miller & Associates—Claim: The claim amount for Miller & Associates for outstanding pool invoices would be $127,000.00. A motion was made by Albert Krueger to approve the payment of $127,000.00 to Miller & Associates for outstanding pool invoices, seconded by Derrick Clevenger.

Change March Regular Meeting Date: A motion was made by Leon Stall to approve changing the March Regular Council Meeting to March 13, 2017 at 7:00. Seconded by Derrick Clevenger.

Other Items: The next Regular Council Meeting will be held on Monday, March 13, 2017 at 7:00 p.m. since the Mayor and City Attorney will be unable to attend on the 3rd Monday of March.
