FISHING FOR FUN Release of Liability, Boarding Pass and Photo Approval

By signing below, I hereby affirm and acknowledge there are hazards and risks associated with boating and fishing (the “Activities”) which include boarding and disembarking from a boat, being on a dock and engaging in activities involving hooks, lines and other sharp objects while in a moving boat. I understand that some of the hazards of boating and fishing are: drowning, slips and falls, loss of balance, tripping, falling into the water, injuries from hooks, tools and fishing line, injuries from fish, bacteria and aquatic vegetation, and injuries from other passengers and fishing and boating equipment. I understand the description of these risks is not comprehensive and that unknown or unanticipated risks may result in injury, illness, or death

RELEASE OF LIABILITY, WIAVER OF CLAIMS, COVENANT NOT TO SUE AND INDEMNITY

In consideration for being permitted to participate in the Activities:

I hereby release Fishing For Fun, a Minnesota non-profit corporation and its officers, directors, employees, representatives, agents, and volunteers, and vessels (“Released Parties”) from all liability and responsibility whatsoever and for any claims or causes of action that I, my estate, heirs, survivors, executors, or assigns may have for: (1) personal injury, property damage, or wrongful death arising from the Activities whether caused by active or passive negligence of the Released Parties or my own negligence. (2) Any damage to, theft or loss of my personal property whether resulting from my own negligence or the negligence of the Released Parties.

I also covenant not to sue the Released Parties and agree to hold the Released Parties harmless and indemnify them in conjunction with any injury, disability, death, or loss or damage to person or property that may occur by engaging in the Activities.

This release shall be binding on me and my heirs, legal representatives, successors and assigns to the fullest extent permitted by law. If any provision of this release is found to be unenforceable, the remaining terms shall be enforced. Pursuant to Minn. Stat. §604.055, nothing in this purports or intends to waive liability for damage, injuries, or death resulting from conduct that constitutes greater than ordinary negligence.

MEDIA CONSENT

In addition to the above Release, Waiver, Covenant Not to Sue and Indemnity, I hereby irrevocably consent to and authorize the use by Released Parties, of any and all photographs, video, voice recordings, written or oral comments, or other media taken of me concerning the Activities, including derivative works thereof and any reproduction of them in any form in any media whatsoever, whether now known or hereafter created, throughout the world in perpetuity.

I HAVE READ THIS PARTICIPANT RELEASE AND CONSENT, AND I FULLY UNDERSTAND ITS TERMS AND UNDERSTAND THAT I HAVE GIVEN UP LEGAL RIGHTS BY SIGNING IT. I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. By entering into this PARTICIPANT RELEASE AND CONSENT, I am not relying on any oral or written representation or statements made by the Released Parties, other than what is set forth HEREIN.

For minor participants, this is to clarify that I, as parent, guardian, temporary guardian with/without legal responsibility for any minor participants that accompany me, do consent and agree not only to his/her/their release of all Released Parties, but also to release and indemnify the Released Parties from any and all liabilities incident to his/her/their involvement in these activities for myself, my heirs, legal representatives, successors and assigns.
