Legal Fund

The following is a brief explanation of the Rules and Regulations of the Legal Fund Committee.

The Committee consists of (3) members each serving a three (3) year term. The purpose of the Legal Fund is to provide working code officials who are members of our association for at least one full year, assistance in defraying any legal expenses incurred in the defense of his/her official position. IT IS NOT INTENED TO PAY ALL LEGAL COSTS. The request for assistance must be in writing to a member of the committee who will meet to evaluate the potential impact that a decision may have on code enforcement. Any denial by the committee may be appealed to the Executive Board. If assistance is granted, a one hour meeting is scheduled with our associations attorney. The cost is paid from our attorney’s retainer fee. If it is decided to proceed, the committee may pay for costs up to three thousand dollars ($3000.00). Any additioal costs will require a majority vote by both the committee and Executive Board. STATEMENT

The “New Home Fire Safety Act” would require the installation of a fire suppression system in new single and two family homes during the home’s construction. The bill also provides that a certificate of occupancy may not be issued for a new home until the State or local code enforcement agency determines that the home is equipped with a fire suppression system that conforms to State Uniform Construction Code systems promulgated by the Commissioner of Community Affairs. Equipping new single and two family homes with fire suppression systems will provide protection for the State’s residents and firefighters. Any modifications made by the Commissioner of Community Affairs to the State Uniform Construction Code must require all fire suppression systems to be in compliance with State administrative regulations regarding physical connections and cross connection control, mandate the installation of separate shut-off valves, and a meter for measuring water usage dedicated to fire suppression. The bill permits municipalities and the Commissioner of Community Affairs to each establish a fee that covers the cost of inspection and the issuance of a certificate of occupancy. The requirements of thislegislation would not apply either to homes 1 not connected to public water systems or new homes built as part of a development plan or building permit approved on or before the bill.

On January 9 this bill passed the Senate 25 to 13. It now goes to the governor's desk. It's time to start writing letters to the following address:

Standards for Home Elevation Contractors

TRENTON — A bill that would require home-elevation contractors to register with the state and have at least two years of house-lifting experience was approved unanimously Thursday by the state Senate.

“Families along the Shore are undergoing the process of having their homes elevated to protect against future storms,” said Sen. Christopher “Kip” Bateman, R-Somerset, one of the primary sponsors of the home-elevation bill. “This is complicated, dangerous work and we need to make sure it is done safely and correctly.”

The bill, passed by the Senate in a 35 to 0 vote, would require contractors in the home-elevation business to register with the state Division of Consumer Affairs. To receive such a registration, a contractor would need at least two years’ home-lifting experience, under the guidance of a veteran contractor.

The passage comes less than a month after the Asbury Park Press detailed three instances in which homes collapsed or shifted during the lifting process. Three workers were injured in one of those incidents, when a home that was being elevated fell in Little Egg Harbor.

New Jersey requires no special registration for those in the home-elevation business. Instead, home-elevation contractors register as home-improvement contractors with the consumer affairs division.

A contractor who specializes in building decks or constructing additions receives the same registration as a company that is dedicated to lifting homes. More than 100 home-improvement contractors are now performing home elevations in New Jersey, up from about only a handful that were doing the work before superstorm Sandy struck.

Additional requirements of the bill would include the use of a unified jacking machine to complete each home-lifting project. Such machines use hydraulics to lift the entire bulk of a house at the same time and cost about $60,000. Unified jacks can lift a house at a rate of about one foot per hour.

Home-elevation contractors would have to carry $1 million in general liability insurance, and also would need $500,000 in so-called “cargo insurance,” a policy that covers the contents of a house during the lifting process. Traditional homeowners’ policies do not provide coverage for a home’s contents while the house is being lifted.

A companion bill is awaiting action in the Assembly.
