EUROPEAN COMMUNITIES (DEHYDRATED PRESERVED MILK) (AMENDMENT) REGULATIONS

I, AUSTIN DEASY, Minister for Agriculture, in exercise of the powers
conferred on me by section 3 of the European Communities Act, 1972
(No. 27 of 1972), and for the purpose of giving effect to Council
Directive 83/635/EEC¹ of 13 December, 1983, hereby make the following
Regulations:
REG 1
1. These Regulations may be cited as the European Communities (Dehydrated Preserved Milk) (Amendment) Regulations, 1987, and shall
come into operation on the 6th day of March, 1987.
REG 2
2. The European Communities (Dehydrated Preserved Milk) Regulations,
1980 (S.I. No. 152 of 1980), are hereby amended in Regulation 2
by—
(a) the insertion after the definition of "authorised officer" of
the following definition "the Council Directive" means Council
Directive 83/635/EEC¹ of 13 December 1983, and
(b) the substitution of the following definition for the definition
of "the Directive"; " the Directive" means Council Directive
76/118/EEC¹ of 18 December, 1975, as amended by Council Directive
83/635/EEC¹ of 13 December, 1983.

3. The European Communities (Dehydrated Preserved Milk) Regulations,
1980 (S.I. No. 152 of 1980), are hereby amended by the substitution
of the following Regulation for Regulation 11:
"11. (1) Subject to paragraphs (2), (3) and (4) of this Regulation,
the appropriate particulars specified in Article 7(4) (inserted by
Article 1.3 of the Council Directive) of the Directive shall appear
on the packaging, containers or labels of products to which these
Regulations apply.

(2) The particulars set out under paragraphs 2 and 4(a) of Article
7 (inserted by Article 1 of the Council Directive) shall appear in
the same field of vision as those listed in Article 11(3)(a) of
Directive 79/112/EEC.
(3) Where vitamins are added to products there shall be marked on
the packages, containers or labels of such products details of the
nature and quantity of such vitamins.
(4) Subject to paragraph (5) of this Regulation, the appropriate
particulars specified in Article 7(a) (inserted by Article 1.4 of
the Council Directive) to be marked on the packages, containers or
labels of the products defined in the Annex to the Directive shall
be clearly visible, easily legible and in indelible characters.
(5) A person shall not market in the State any of the products
defined in the Annex to the Directive if the particulars referred
to in paragraph 1 (a), (d) and (e) of Article 7 (a) of the
Directive (inserted by Article 1.4 of the Council Directive) do not
appear in a language which can be easily understood by the
purchaser unless the purchaser is given such information by other
means.
(6) Paragraph (5) of this Regulation shall not be construed so as
to preclude the appearance of the relevant particulars in several
languages; provided at least one of the languages is easily
understood by the purchaser."
REG 4
4. The European Communities (Dehydrated Preserved Milk) Regulations,
1980, are hereby amended by the substitution of the following
Regulation for Regulation 12:
"12. Where a product to which these Regulations apply weighs less
than 20 grams per unit and is packed in an outer package, the
particulars required by paragraph 5 of Article 7 (inserted by
Article 1.3 of the Council Directive) of the Directive need appear
on the outer packaging only, except for the designation under which
the product is sold required by paragraph 2 (a) of the said
Article 7.".
