Selecting a Name for Chambers

When selecting a name fora new set of Chambers, it would be inadvisable to select a name that is already in use or similar to one used by a Chambers or an authorised body supplying legal services. Rule C19 in the BSB Handbook requires that a barrister must not mislead, or cause or permit to be misled, any person to whom they supply or offer to supply legal services. The accompanying guidance refers to the Core Duties and in particular the requirement to act in the best interests of clients and maintain public confidence in the profession. To comply with Rule C19 it is important that clients and potential clients seeking a barrister, whether on a public access basis or otherwise, are able to easily distinguish between different Chambers and authorised bodies. In practice having the same or similar name can result in mistakes being made by clients, and other parties (for example, when sending privileged documents), that have the potential to impact negatively on clients and the barrister.
