STUDENT AGREEMENT

ERASMUS MUNDUS MASTERS PROGRAMME IN HUMAN RIGHTS POLICY AND PRACTICE (HRPP)

BETWEEN

1)Roehampton University trading as University of Roehampton, of Grove House, Roehampton Lane, London, SW15 5PJ, the Coordinating Institution of the Erasmus Mundus Masters programme in Human Rights Policy and Practice (HRPP) acting on behalf of the consortium formed by the Universities whose details are set out in Annex A (hereinafter “the Consortium”) and

2)[ ], born on [ ] in [ ] with [Student identification number: ], (hereinafter “the Student”)

RECITALS

  1. This Agreement sets out the terms and conditions which will govern the relationship between the Consortium and the Student during the Consortium’s delivery of the Erasmus Mundus Masters Programme in Human Rights Policy and Practice MA/Mgr(hereinafter “the Programme”) and the Student’s participation in the Programme.
  1. This Agreement must be signed by the Student and on behalf of the Consortium (hereinafter together called “the Parties” and each a “Party”) on commencement of the Programme, it will become effective when signed by both Parties and shall remain binding on the Parties for the duration of the Student’s enrolment in the Programme.

IT IS AGREED AS FOLLOWS:

1. The Student‘s Obligations

1.1The Student undertakes to:

(a)Abide by the rules, regulations, policies and codes (“the Regulations”) set by the Consortium and those that are in force at any given time at the University at which the Student is studying. These include in particular, Regulations relating to academic study, learning and assessment; conduct and discipline; use of services and facilities; payment of fees and expenses; health and safety; and intellectual property.

(b)Participate in the Programme diligently and fully by attending and taking part in classes and activities (including national language courses in Swedish and Spanish) and submitting compulsory course work and other assignments by required deadlines, subject to absence for medical or other reasons agreed by the Programme Board.

(c) Notify the Consortium and provide reasons if he/she is unable to attend or produce work.

(d)Reach the level of academic attainment required for the Programme by the Consortium in order to remain on the Programme and in receipt of funding under an Erasmus Mundus Scholarship where applicable.

(e)Conduct his/herself in a proper manner when undertaking any Programme related activity including activities outside of the Consortium/Partner Universities (e.g. field trips and placements).

(f)Comply with any professional standards applicable to the Programme.

(g)Provide the Consortium with up-to-date contact information including the name and contact details of his/her next of kin/ emergency contact.

(h)Submit his/her work to a plagiarism detection service if required to do so by the Consortium. The Student permits the Consortium and third parties authorised by the Consortium to make and to retain copies of such work in order to assess it for originality and to compare it at a later date with future submissions.

2. The Consortium‘s Obligations

2.1 The Consortium undertakes to:

(a)Abide by its own rules, regulations, policies and codes, and in this way will aim to treat the Student fairly. The Consortium may at any time make changes to its rules, regulations, policies and codes, and will make reasonable and proportionate efforts to bring any significant changes to the attention of the Student before they take effect.

(b)Provide a learning environment which, in its academic judgement and within its control, is appropriate for the Programme.

3. Programme Details

3.1 The Programme leads to an award of a Masters of Arts Human Rights Policy and Practice (Erasmus Mundus) - a joint award of the three constituent Institutions of the Consortium.

3.2 The Programme is composed of four compulsory modules each carrying 15 ECTS, plus a dissertation carrying 30 ECTS. Details on the Programme structure including methods of assessment are available at:

3.3 The Programme will run for 2 academic years, commencing on 21 August 2017. The Student will spend the first six months of study at Gothenburg University (August to January), inclusive of an induction week, followed by6 months at the University of Deusto (February to July). The Student will then spend5 months at the University of Roehampton (September - January) and the final 6 months at one of the three Consortia for dissertation supervision (mid-January to June). The Student is required to attend a dissertation symposium in June of each year at Deusto University. The Student is required to participate in questioning those presenting their research in the first year and present their research for questioning in the second.

3.4 The Student must spend his/her period of study in all three member countries of constituent Institutions of the Consortium [i.e. the United Kingdom (London), Sweden (Gothenburg) and Spain (Bilboa)].

3.5 The mandatory mobility periods as detailed in clause 3.3 cannot be replaced by virtual mobility, or be spent at institutions outside the Consortiumsave that the Student has the option of spending 3 months of the 6 month project research period (January - June) in a Third Country associate partner institution. This option is not available to Students holding a category A scholarship whose country of origin is the same as the associate partner locaton. During this project research period, the Student must be under the direct supervision of one of the Consortium Partners.

3.6 The Student must attend all taught sessions from commencement to completion of the session. As far as reasonable practicable, advance permission must be sought from the Programme Convenor to be absent from or late for a session or to be excused before the end of a session. Leave of two or more weeks will only be granted in extenuating circumstances and on the production of evidence substantiating the extenuating circumstances.

4. Termination

4.1 This Agreement will end automatically (subject to the Student’s rights of internal appeal) if the Student’s participation in the Programme is terminated by the Consortium for any reason.

4.2 On termination of this Agreement for any reason:

(a) the Consortium shall be entitled to refuse to enrol the Student on the Programme (if, at the date of termination, he/she has not already enrolled);

(b) the Consortium shall be entitled to require the Student to stop studying on the Programme and to leave the attending University immediately (if, at the date of termination, the Student has enrolled);

(c) the Student shall return to the Consortium ( through the Admissions department at which he/she is registered) the Identification Card issued to him/her on enrolment, together with all property owned by the Consortium and/or the attending University;

(d)the Student shall pay any outstanding Participation Costs and other amounts owing to the Consortium and/or the attending University immediately; and

(e)subject as provided in this clause 4 and except in respect of any accrued rights, neither Party shall be under any further obligations to the other.

(f)Any action taken by the Consortium under the above sub-paragraphs, will not restrict its ability to take any action against the Student, to which it may by entitled. Provided the action taken to terminate the Agreement is in accordance with these conditions or the Consortium’s procedures, the Consortium will not be liable for any loss or damage which the Student may suffer as a result.

  1. Participation Costs

5.1The Student will pay or make acceptable arrangements to pay to the Consortium all deposits, fees, charges and expenses (“Participation Costs”) when these fall due.

5.2Information on Participation Costs is published on the Consortium’s website and the Consortium will inform the Student of the date by which these shall be paid.

5.3 Payment of Participation Costs will entitle the Student to a number of services at each of the constituent institutions including: library services, tuition, the services of a dedicated programme convenor and project administrators to ensure adequate teaching and supervision; English Language support and academic writing skills support; appropriate IT courses;cultural UK, Swedish and Spanish programmes; field trips and other student services such as pastoral care; and services offered by the International and Accommodation offices.

  1. Erasmus Mundus Scholarship (EMS)

6.1 Any failure by the Student to participate in the Programme in accordance with the terms and conditions set out in this Agreement may lead to the revocation of the EMS.

6.2It is mandatory for any Student holding an EMS to comply with the requirements set out in sub-clauses 3.3 to 3.7 of this Agreement.

6.3 Any Student holding an EMS who withdraws his/her application before the commencement of the Programme or during the Programme, or who is excluded from the Programme as a result of non-performance or for other valid reason(s), will have his/her scholarship revoked.

6.4 Prior to revoking any scholarship, the Consortium will write to the EMS holder advising him/her of his/her non-performance or other breach of this Agreement and giving him/her a reasonable period of time to bring his/her performance or other conduct up to a standard satisfactory to the Consortium, in appropriate cases.

6.5On revocation of an EMS, the Student may be required to reimburse the Consortium some or all of the EMS funds.

  1. Accommodation and Insurance
  2. The Consortium partners will be responsible for arranging the Student’s accommodation for the duration of the Programme. Students may however make their own accommodation arrangements if they so wish, provided they inform the partner institutions in advance. Any arrangements which are made through the Consortium will be subject to separate agreements.

7.2The Consortium partners will be responsible for arranging insurance cover for EMS Students for the duration of the Programme. All third-country EMS Students are entitled to complementary insurance cover during their studies on the Programme.Detailed information about the insurance coverage scheme, claim forms and general rules is available at:

Any Student who does not hold an EMS has a personal responsibility to take out adequate medical insurance cover for the duration of the Programme.

7.3All Students are responsible for checking the extent of insurance cover provided by the Consortium and the institution at which they are registered. As Insurance cover may not be comprehensive, Students will need to take out additional cover with a private insurer if they wish to be covered for eventualities not covered by the Insurance provided through the Consortium (e.g. pre-existing medical conditions may not be covered by arranged medical insurance and travel insurance will not cover eventualities such as loss or theft of money, personal belongings and items of value).

  1. Confidentiality and Data Protection

8.1The Consortium will hold and process the Student’s personal data, including sensitive personal data, during and after the Student’s time at the University. The Student agrees to these data being processed in accordance with (1) Regulation (EC) No 45/2001 of the European Parliament on the protection of individuals with regard to the processing of personal data by EU institutions and bodies and on the free movement of such data; and (2) where applicable, the national legislation of the Consortium member where the data is being processed. The Consortium shall only process the Student’s data for those purposes and in the manner described in Roehampton University’s Data Protection Policy and in accordance with the Data Protection legislation referred to above.

  1. Complaints and Disciplinary Matters

9.1If the Student wishes to make a complaint about the Consortium or the University that he/she is attending, this must be done in accordance with the Students Complaints Procedure. This procedure has been devised to help to resolve any complaints by the Student as promptly, fairly and amicably as possible.

9.2If the Student remains dissatisfied after following the Students Complaints Procedure to completion, h/she has the right to ask the Office of the Independent Adjudicator for Higher Education (OIA) to review the complaint.

9.3If the Student does not act in accordance with the terms and conditions set out in this Agreement, or with any of the Consortium’s/ Constituent Institution’s rules, regulations, policies and codes that are in force at any given time, the Consortium may take disciplinary action against the Student in accordance with the Students’ Disciplinary Regulations . The Student agrees that all relevant staff will be advised of the outcome. One of the possible outcomes of disciplinary action is that the Student’s participation in the Programme may be terminated.

  1. General

10.1This Contract is only enforceable by the Student and the Consortium or its constituent members. No other person shall have any rights in connection with this Contract.

10.2If any part of this Contract becomes illegal or invalid, the parts of the Contract which are not illegal or invalid shall remain in force.

10.3Neither the Consortium nor the Student shall be liable for failure to perform any obligations under this Contract if such failure arises from circumstances beyond their reasonable control, including acts of God, war, terrorism, industrial disputes (including disputes involving the University's employees), fire, flood, tempest and national emergencies. If either the University or the Student seeks to rely on this Clause, then they shall ensure that the consequences of any failure to act in accordance with this Contract are kept to a minimum.

10.4Failure of either the Consortium or the Student to enforce any part of this Contract shall not be construed as a waiver of a right to enforce that part of the Contract and shall not affect the right later to enforce any part of the Contract.

10.5Any notice to the Consortium sent by the Student under or in connection with this Contract shall be deemed to have been properly served if sent by first class post or e-mail to the University Secretary and Registrar at the following address.

10.6Any notice sent to the Student under or in connection with these terms and conditions shall be deemed to have been properly served if sent by first class post to the last address provided to the Consortium by the Student; or sent to the Student’s Consortium e-mail account.

10.7This Contract is governed by the laws and jurisdiction of the courts of England and Wales.
