About the course:
On the basis of the recent Court of Final Appeal decision on the ShanghaiLand case, this course will
examine the extent a solicitor is required to judge the truth of a client’s instructions in carrying out his professional duties;
highlight the practical risks to solicitors associated with dishonest instructions from clients in corporate finance transactions;
explain possible ways to handle and manage stress for solicitors going through ordeals;
share ideas on how the Law Society can assist members during times of difficulties.
Course objective:
The aim of the course is to
alert practitioners to pitfalls and risks associated with corporate finance practices and in particular, areas of work that may seem common and routine;
equip practitioners with effective ways to handle stress;
facilitate discussion and solicit views on possible welfare schemes for practitioners.
About the presenter:
Presenter: Mr. Simon Lai
Moderator: Mr. Huen Wong, Immediate Past President of The Law Society of Hong Kong and Consultant, Fried, Frank, Harris, Shriver & Jacobson
Mr. Simon Lai was admitted as a solicitor in Hong Kong in 1985. Mr. Lai’s professional career (1983 to 2008) had almost been entirely with Deacons, in which he became a partner in 1993 and retired in 2008 following his conviction in the ShanghaiLand case. In quashing Mr. Lai’s conviction, the CFA stated that Mr. Lai left the CFA “without any cloud over his innocence” and emails relied upon to support his conviction were in fact consistent with the “honest discharge” by Mr. Lai of his duty as a solicitor to his client.
Mr. Lai specialises in corporate and securities laws, and has experience in various forms of commercial transactions. He has also served on a number of statutory or public bodies and held non-executive directorships in listed entities.
