Draft request for guidance from WP.29
on exchange of information between Contracting Parties

Note: The need on request for guidance from WP.29 on the issue of exchange of information between Contracting Parties for facilitating implementation of UN Regulation No. 0 is stipulated in the IWVTA Explanatory Note (documents SGR0-05-03 and SGR0-05-03-Rev.1). This document is intended to explain this issue to WP.29. It formulates the particular questions, for which the guidance is sought for. If the Working Subgroup of experts on development of the draft UN Regulation No. 0 (SGR0) had agreed this document, it may be treated as a draft request of SGR0 to WP.29 .

I. Background

UN Regulation No. 0 seeks to establish an international whole vehicle type approval (IWVTA) scheme within the framework of the 1958 Agreement. Recognizing that Contracting Parties are in largely different situations in terms of the amount and stringency of requirements necessary for national/regional whole vehicle type approval is accounted for by creating a flexible or “IWVTA of limited recognition” scheme. This flexible scheme allows issuance and acceptance of IWVTA based on a part of necessary requirements to be listed in UN Regulation No. 0 and/or requirements of lower level than those to be listed in UN Regulation No. 0.

The IWVTA of limited recognition scheme allows many variants of IWVTA. In order to assist Contracting Parties the list of UN Regulations to which compliance is certified by the IWVTA of limited recognition shall be appended to the communication on that IWVTA.

Acceptance of IWVTA of limited recognition by a Contracting Party depends on the list of Regulations, which that Contracting Party mandates.

For efficient application of the IWVTA procedure, an exchange of relevant information between Contracting Parties has to be provided, bearing in mind that such information is subject to updating by Contracting Parties from time to time.

That can be done by means of a status document (similar to ECE/TRANS/WP.29/343), so the level of the requirements mandated by each Contracting Party could be clearly visible.

The Contracting Parties applying UN Regulation No. 0 will become obliged to submit their notifications for those versions of UN Regulations mandated for the whole vehicle approval process at national/regional level which differ from the level prescribed for universal IWVTA.

The same approach also can be applied to national/regional requirements of particular Contracting Parties with the intention to reach full transparency about requirements mandated at national/regional level.

The activity on keeping records of notifications received and maintaining status document should be carried out by a designated body. The UNECE secretariat may be an appropriate organization for this task, but the information can also be collected and maintained by another authoritative organization.

In order to facilitate the process, the Working Subgroup of experts on development of the draft UN Regulation No. 0 (SGR0) can collect from the Contracting Parties applying UN Regulation No.0 the relevant information on the UN Regulations and national/regional requirements mandated for the whole vehicle approval process at national/regional level based on the templates reproduced in Annexes I and II of this document and create the first version of the status document.

II. Request for guidance

The WP.29 consent is sought on the following:

(1)  The general approach to creation and maintenance of the status document on UN Regulations and national/regional requirements mandated for the whole vehicle approval process at national/regional level based on the templates reproduced in Annexes I and II of this document.

(2)  Invitation of the Contracting Parties having the intention to apply UN Regulation No.0 to submit the necessary notifications on UN Regulations (only deviations from universal IWVTA list of UN Regulations) and national/regional requirements mandated for the whole vehicle approval process at national/regional level to the [technical secretary of the] Working Subgroup of experts on development of the draft UN Regulation No. 0 (SGR0).

(3)  Designation of the UNECE secretariat for further maintenance of the aforesaid status document with its uploading to the WP.29 website.
