PLANNING APPLICATION NO. 04/48300/OUT, OAKGLADE, LAND BOUNDED BY NEW BRIDGE STREET, THE RIVER IRWELL AND GREENGATE, SALFORD 3 - RENEWAL OF OUTLINE PLANNING PERMISSION FOR THE ERECTION OF 30 STOREY MIXED USE DEVELOPMENT COMPRISING RETAIL UNITS (3010 SQ. M), OFFICES (2850 SQ. M), 280 RESIDENTIAL UNITS, 720 BED HOTEL AND ANCILLARY LEISURE UNITS - SECTION 106 AGREEMENT

RESOLVED: (1) THAT the Director of Corporate Services be authorised to enter into a legal agreement under section 106 of the Town and Country Planning Act 1990, to secure the payment of a commuted sum for, and implementation of, environmental improvements in the local area to the value of £668,500.

(2) THAT the applicant be informed that the City Council is minded to grant planning permission subject to the conditions as detailed in the report now submitted, and an additional condition requiring the provision of recycling facilities on completion of such legal agreement.

(3) THAT authority be given for the decision notice relating to the application to be issued, subject to the conditions as detailed in the report now submitted, on completion of the legal agreement.

(4) THAT authority be given to refuse the application if the applicant fails to complete the section 106 agreement within a reasonable period on the grounds that the proposals do not support the aims and objectives of the Chapel Street Regeneration Project.
