FISCAL COURT MEETING: Woodford County Courthouse,

Tuesday, January 10, 2017 at 5:30 p.m.

PRESENT: Magistrates Linda Popp, C.L. Watts, Gary Finnell, Ken Reed,

APPROVAL OF MINUTES

Judge/Executive Coyle called for any additions, corrections, or amendments to the minutes of the Regular Fiscal Court Meeting of December 13, 2016 and Special Meeting of December 29, 2016. Hearing none, these sets of minutes stood approved as presented.

REPORTS

Treasurer’s Report (Sabra Garmon) – Treasurer Garmon reported the financial status through today with the total cash amount of $3,866,812.31, less claims of $672,186.26, less payroll of $254,559.19, less a certificate of deposit of $400,000.00, leaving an adjusted money market checking account balance of $2,540,066.86. Treasurer Garmon also handed out the quarterly financial report to be approved at the next meeting.

Ambulance Director, Freeman Bailey asked the court for formal approval to place an ad for a new employee. Permission was previously given via a straw vote of the court.

1.  A motion was made by Jackie Brown and seconded by Gary Finnell to allow Ambulance Director Freeman Bailey to place an ad for a new employee.

County Road Engineer, Buan Smith reported that Ball homes is requesting release of the bonding instruments for the developments in Gleneagles Estates. Mr. Smith will prepare a letter to the court for vote at the next fiscal court meeting.

Also, Mr. Smith informed the court of the need to formally adopt roads in Gleneagles into the county’s roadway maintenance system. County Attorney Alan George informed the court that this would need to be done by ordinance, which can be prepared for first reading at the next fiscal court meeting if the court so wishes.

2.  A motion was made by Ken Reed and seconded by Jackie Brown to instruct County Attorney Alan George to prepare an ordinance relating to formal adoption of new public roads into the Woodford County Road System.

Mr. Smith also informed the court that work began on the Griers Creek Bridge on January 9th. He is hoping to reinforce the bridge and have it re-opened within a week, pending good weather and approval from the State.

Emergency Management Director, Drew Chandler informed the court that the LEPC has been trying to do a commodity flow survey and has found a grant opportunity. The funding mechanism requires a city or county government to be the pass through agency. Director Chandler asked the court for approval to act as a pass through agency so that the LEPC can request the grant money for the commodity flow survey. Director Chandler estimates up to a $5,000 total expenditure with the LEPC paying $1,000. The county will be reimbursed $4,000 by the state.

3.  A motion was made by Ken Reed and seconded by Gary Finnell to allow Emergency Management Director Drew Chandler to make a request on behalf of LEPC that Woodford County spend up to $5,000 for a commodity flow survey. The county will be reimbursed by the state in the form of a grant with the 20% match coming from LEPC.

Director Chandler also informed the court that the LEPC meets Thursday, January 12th at noon at the Emergency Operations Center.

Also, the CPR Training Center is now open. The first 1-hour bystander CPR class is scheduled for January 24th at 6:00 pm and is free to the public. Classes have been scheduled the fourth Tuesday of each month through December at 6:00 p.m.

Jack Jouett House Director, Jill Roseberry met with Tim Tombs of the Louisville Arch Dioces. He has discovered a Matthew Harris Jouett painting. This painting is around 10ft. tall and is known as The Dead Christ Mourned. The painting is damaged, so restoration options are being explored. Also, last year there were 6 Matthew Harris Jouett portraits displayed at the Jack Jouett House.

Approval of Sheriff’s Budget

4.  A motion was made by Jackie Brown and seconded by Ken Reed to approve the Sheriff’s budget for calendar year 2017. (Attachment)

The sheriff also submitted his quarterly report to the court for approval.

Approval of County Clerk’s Budget

6.  A motion was made by Jackie Brown and seconded by Gary Finnell to approve the County Clerk’s budget for calendar year 2017. (Attachment)

Clerk Jones also asked the court for approval of the Annual Order Setting Maximum Amount for Deputies and Assistants of the Woodford County Clerk’s Office.

7.  A motion was made by C.L. Watts and seconded by Ken Reed to approve the Annual Order Setting Maximum Amount for Deputies and Assistants of the Woodford County Clerk’s Office. (Attachment)

Sheriff Wright asked the court for approval of the Annual Order Setting Maximum Amount for Deputies and Assistants of the Woodford County Sheriff’s Office.

Re-Appointment of John Creech

9.  A motion was made by Jackie Brown and seconded by Gary Finnell to re-appoint John Creech to the Woodford Rural Land Board for a 4 year term ending January 10, 2021. (Attachment)

Approval of Agreement for Inmate Work Crews

10.  A motion was made by Gary Finnell and seconded by Ken Reed to authorize and direct Judge/Executive Coyle to sign the Memorandum of Agreement between the Kentucky Department of Transportation, the Kentucky Department of Corrections, and the Woodford County Detention Center for roadside inmate work crews. EDA Invoice

After some discussion, it was decided that the EDA invoice is right and proper to pay. The court must give a 30 day notice to the Bluegrass ADD in order to stop the contract.

John Soper Contract

The court discussed the proposed independent contractor agreement for John Soper. The contract has a start date of February 1, 2017 and is for economic development service and advice to the City of Versailles, City of Midway, and Woodford County. The monthly rate of pay per the contract is $5,720, with $2,002 per month being paid by the county and the remaining amount being paid by the two cities. The agreement is for a one year term and can be terminated by any party for any reason with a 30 day written notice. Some concern was voiced regarding terminating the agreement with Bluegrass ADD for economic development services. However, Mr. Soper assured the court that the ADD will still offer assistance to the county since the county pays dues to be a member of the ADD. However, if a large project were to occur that required more detailed work and expertise, it is possible that the ADD would charge the county for that particular project. It was noted that #7 of the proposed contract references paragraph 3 when it should reference paragraph 4. This change will be made before signatures are obtained.

11.  A motion was made by Jackie Brown and seconded by Gary Finnell to approve the independent contractor agreement between Woodford County and John Soper for a 1 year term beginning February 1, 2017 with the proper correction made to number 7 of the contract (reference #4 instead of #3). Following Executive Session, County Attorney Alan George reported that the court members heard from Emergency Management Director Drew Chandler regarding possible land acquisition. Director Chandler will be contacting the property owners discussed in Executive Session with the court’s response and will report back to the court.

14.  A motion was made by Jackie Brown and seconded by Ken Reed to approve the personnel orders as presented to the court.
