Environmental Protection Act 1990: Part II A Contaminated Land

Environmental Information Regulations 2004: Request for environmental information pertaining to: petrol filling station at ASDA Brighton Hollingbury, Unit 1 Crowhurst Road, off Carden Avenue, Brighton BN1 8AS. NGR: 531941, 109238.

Thank you for your Environmental Information Regulations (2004) Request for the site described above. Please find below, information and historical maps relating to this site.

On the maps below, premises which have had previous commercial and industrial purposes have been shaded. These particular premises have been identified as potentially contaminated land under the provisions of the Environmental Protection Act 1990. This is because their commercial uses may have resulted in some localised land contamination. It should be noted that the term ‘potentially contaminated land’ simply means that there is the potential for some localised land contamination to have occurred on site. To call a site ‘contaminated land’ has a very specific legal meaning, which carries with it associated consequences. To date, there are no ‘contaminated land’ sites as defined by the Environmental Protection Act 1990, within Brighton and Hove.

Potentially contaminated land sites have been risk rated for further investigation whereby the highest priority sites are rated as A’s and the lowest priority sites are rated as E’s. There are 3 Category A sites and about 1000 Bs. The details about the potentially contaminated land sites included in this search are listed in the Table below.

Based on former or current uses, there are approximately 3000 potentially contaminated land sites within Brighton and Hove. Due to this large number, it is not possible to provide a date when further investigation of those sites listed below will occur.

From the information below it can be seen that the search site has not been prioritised for further investigation under the provisions of the Environmental Protection Act 1990. However, the maps show that the site is located where there were once engineering works. Therefore, although this site is not currently prioritised for further investigation, due to its history of commercial use it is considered to be potentially contaminated land. Additionally, it is also next to other sites which have been prioritised as potentially contaminated land as outlined below.

Specifically, with respect to your questions:

1.  Is the Council aware of any contamination issues or specific incidents in connection with the site?

An: No knowledge of any specific issues or incidents. Please also contact the Environment Agency.

2.  Has the site been identified under the Council’s Contaminated Land Strategy for further investigation under the provisions of Part IIA of the EPA 1990? If so, please provide further details, including your predicted timescales for further action. If not, what is the likelihood of the site being identified in the future?

An: Please see information above and below. Regarding future investigations, as outlined above, it would not be possible to assign a date to any investigations. If ever the site forms part of a planning application, a full contaminated land condition would likely be recommended for any approved plans.

3.  Are there any closed, licensed or unlicensed landfill sites within a 250m radius of the site? If yes, what is their location (NGR) and what types of waste were deposited in them? Are there any known gassing issues? If any gas spiking/monitoring has been carried out, could you please supply the results?

An: No.

4.  Are there any private water supplies on your Local Authority Private Water Supply Register, within a 2km radius of the site? If yes, what is the location (i.e. NGR) and the source of the abstraction and its purpose?

An: No

5.  Does the Council have any information as to current and historical fuel storage on the site?

An: The derelict tank register for East Sussex Fire and Rescue Service (January 2013) has been consulted. There are no entries for Crowhurst Road or Carden Ave. Derelict tank records are held externally and if further information is required, I recommend you make contact with the Petroleum Officer, Mick Huckstepp at East Sussex Fire and Rescue Service on 01323 462130. Please be aware that a charge may be made for any searches requested in writing from East Sussex Fire and Rescue.

6. Are there any other Council information sources that you can direct us to?

An: Unknown.
